  1. Okay...so I disputed with TU, and I got my results back today. Got 2 JDB's deleted, 2 JDB's with new info, and now showing Data factoring Account, but even more interesting was one CC that was charged off now shows "Paid in full, was a charge off" but I never paid anything to them. What would you do with this? LOL !
  2. Greetings, I haven't been around in a while...have been trying to keep my head above water and so here's my story. Had some trouble for about 5 months in 2009 which resulted in a few late payments and the closing of an AMEX Blue. High Balance was $11K and they cut it in half when I gave them $5K. Then they subsequently called in the line 30 days later...and I fought it which turned into a dispute that resulted in the account going to collections so I could no longer even deal directly with AMEX. I played hardball even though it was affecting my score and let the collection agency chase me with offers for the balance which was $5K at the time. They made offers every couple of months until they were down to about $1500. When the time had elapsed where they could no longer collect....the calls and letters stopped. My wife accepted an American Express Plat and added me as an AU to see if it would pass but it was declined. When I called AMEX to see how I could re-instate my membership..the agent told me I could either pay the $5K in full 'or' settle for $3250. I then asked if I would automatically be re-instated and move forward and she said that because she was in the recovery department, she could not confirm that I would be automatically re-instated....whether I settle or pay in full which was what started this whole thing in 2009. What would you as experts suggest...should I settle or pay in full in order to re-instate? My credit is now in the mid 700's and I have a car with BMW Financial as well as about $15K worth of credit cards which are all at $0 balance. Any suggestions, advice or experience would be greatly appreciated and I thank you in advance. best.
  3. I have a MACYS charge off listed on my credit report. Trying to find the best way to get this removed. It is not reporting with any CA. Any advice?   4. Hello everyone! I am so happy I found this forum. After reading success stories I hope to improve my credit situation as well. Little background: I am married with kids and taking classes in school but right now we live off 1 income, so times have been pretty hard for us, there were days when we didn't have any money at all and all the credit cards have been maxed out...we were living paycheck to paycheck. It's a little better now and I wanna get my credit fixed. I have 1 charged off account from IBC bank, i withdrew money during hurricane Ike and never paid pack so they reported it in 2009. I've heard that it's better not to pay and it will fall off in 2016? And secondly I have my Macy's account reporting 30 days late one time last year when it was just a neglect on my part, I bought a $12 Christmas tree ornament, forgot about it, didn't pay, they added late fees, then waived them but it's still showing as late. I tried to dispute it but the report came back as it was late I guess, it didn't get erased, so should I call and ask them for forgivness? Do I just call customer service? And it's been about a year or more since the incident and I had corrected it and never made any more late payments since then. Thank you all so much in advance for great advice, I truly appreciate it.
  5. I need some clarification: How long does it take a TL to fall off a credit report? 7 years from date of first delinquency or date of last delinquency? I am looking at my TU report, hard copy right now. I have a [30] from 03/2008, that would be date of first delinquency or not? (that is my first missed payment of this account and it says under account summary the date closed is 04/2008!?!) After the [30], there are 3 months of [60] then [OK] until 7/2009. From 7/2009, it goes [30], [60], [90], [120], [120], then 8 straight [CO]'s, with the last [CO] being 07/2010. DOFD or DOLD are not listed under account summary. However, date of last payment is listed at 05/2009. (even though i have an [OK] at 06/2009). The estimated month and year for it to fall off is listed at 05/2016... 7 years after date of last payment. Sorry if this is confusing... but according to this data... when should this TL fall off?
  6. Hello everyone. A little over a year ago I stopped paying on my Discover account, which had a balance of over $9,000. I was working with a credit mediation company which Discover did not work with, so they charged off my balance without notice. A few months later I got a call from Zwicker & Associates, advising that they are collecting on my Discover debt that was charged off, and advising that I owe the $9,xxx.xx that was charged off. I did some research on Zwicker and found that they were sue-happy, and that several people that were sued by Zwicker were forced to go into bankruptcy. That was the last thing I needed, so my parents offered to loan me $5,000 so I could work out payment arrangements with Zwicker. I called Zwicker back and tried to negotiate a lower balance, before offering them the $5,000. They advised that they could offer me a lower balance of $6,xxx.xx (I forget the exact number), but told me if I agreed on that lesser balance that it would reflect negatively on my credit report because they told me it would show that I did not pay the balance in full. So I gave them the $5,000 and worked out monthly payments with them for roughly 12 months to pay off the rest of the balance in full. I recently started using USAA credit monitoring service, and became curious as to how the debt is showing on my credit report. There is currently nothing from Zwicker showing, only Discover. Discover shows up as a charge-off: Now, since I only just started using this monitoring service, I'm not sure if that $988.00 balance has been going down each month with my payments. I tried calling Zwicker this morning too see my balance with them was the $988.00 that I am seeing here on my Discover account, but Zwicker is apparently closed on Saturday's. So now to my question. Since I have, at this point, exceeded the negotiated balance I initially discussed with Zwicker, is it doing me any good to continue paying them the remainder of my balance if we can re-negotiate the lower balance again? Or am I safe to try to negotiate what I've given them so far as my final balance, and walk away if they agree to it? Is there any true benefit to paying the rest of the balance in full?? The reason I ask is because my next goal in life is to get my credit score and history back up and in order, so I can buy my first house in a year or so. I have some other debts that will be paid off in a few more months that have been impacting my credit scores, and I am hoping that a quick re-score will help out with things. But if I negotiate on a lower balance than whatever is left on this charge-off, will that reflect whatsoever on my ability to get approved for a mortgage, or will it impact my credit score/history negatively in any way? Additionally, once paid off (either at the full amount or at a lower, negotiated amount)... is there any way to remove this from my credit report? Discover told me they are not allowed to remove it (even though I told them it is only optional for them to have posted it in the first place, and they can remove it at their own will without any penalties to them), and they won't even discuss it further with me since the debt is no longer in their hands. Any suggestions?? Thank you!!
  7. I have recently Dv'ed 2 CAs reporting on my CRAs and waiting to hear anything back from them. I have 3 other accounts reporting, all OCs, that need tending to. Chase - Charged-off - Still showing the balance. Captial One - Charged-off - Still showing the balance. Macys - Charged-Off - Still showing the balance. I want to take care of these prior to them selling the debt, which I am surprised they haven't yet. DOFD on all 3 are around Feb/March 2012. I've been reading that OCs hardly ever delete. What should I be asking for if they tell me they won't delete? I can pay them, just want to pay them and get the best action done to help my CR. I'm going to call them up in about 2 weeks to try to clear up the debt so I don't have to worry about CAs.
  8. Hi. I've been trying to get my credit score up- I'm embarrassed to say how low it is, and need a question answered. I took out two 'bad credit' credit cards and I'm trying to not miss even one payment on anything. I signed up for MyFico.com and when I got my first credit report it said that my last late payment was Feb. This was for a card that was charged off and sold to a collection agency, that I'm dealing with. Can Chase charge off my credit card debt, sell it to a CA and STILL report that I'm not making payments to them? How long before a debt is considered bad? After 120 days? Thanks in advance for any help.
  9. Hi All, I'm buying a house in 2 weeks and need this removed. Just kidding! I would like this removed though somehow if at all possible! Here is what Cap 1 shows on my EQ Report: I'm trying to determine if the missing Date of Last Activity or Date of First Delinquency or Date of Major Delinquency are somehow showing incorrectly? If so can I argue as inaccurate reporting? Also trying to determine what date my SOL starts, would it be June 2011 or Feb 2012? If June of 2011 then June of 2015 I should be past SOL in TX (4yrs). If Feb 2012 can I argue incorrect reporting since March 2012 shows account as current? I have already tried calling EO office and made offer of PFD at full $750 and had them do a manual review to accept PFD twice and verify that manual review was done and still they said all they can do is settle for $400.00. I told them settling does me no good as it will still report as CO and the EO agreed and told me I'd be better off keeping my cash! Thanks for looking at this, I'm just trying to see if there is another angle I can attack this on.
  10. Hello All, I am new to this forum. I have been working on trying to repair my credit. I made mistakes, I was bad, I've grown up and realized the damage that I have done- time to fix. I am struggling to understand the relationship between a charge off from an original creditor, and the same account once it is sold to a collection agency. Goal- Obtain a mortgage Stumbling Block- From everything I've read, there is no way you'll get a mortgage with charge offs on your credit report I have two charge offs on my credit report, one from Orchard Bank, the other from Credit One Bank. Both were credit cards. They both were sold to Midland Funding/Midland Credit Management, who is now the collection agency on them. Question 1- Lets say I have the money to pay the collection agency, Midland Funding, off in full for both of these charge offs. How would that end up showing as a paid charge off (which a mortgage lender would want to see) when the collection agency isnt the one reporting it as a charge off. They are reporting it as a collection account. The original creditor is the one reporting it as a charge off, a seperate tradeline. How does satisfying the debt with the colllection agency coorelate to the original creditor updating status to a paid charge off? Question 2- Is it possible to make arrangements with the collection agency to pay the same above referenced collection accounts for agreement of deletion, essentially pay for delete of their tradeline, and still have the original creditors tradeline updated as paid charge off? Perhaps I need to know the answer to question 1 before I delve into question 2 too much, but it seems like they would go hand in hand. Thanks in advance for any input, guidance, and help.
  11. Hey there, I am posting here for a friend. I have learned so much from here and I was telling her this and she asked me to help her out. She has 2 charge off accts (credit cards) that are a little over a year old. She is prepared to pay in full but they are in the hands of a collection agency. She just wants to pay them off but I told her that may not be the best thing to do for her credit. What is the best plan of action for her to take? Who should she dispute with first? Can she do a PFD to the OC? I have read never to pay the CA anything but Im not sure with them being fairly recent.
  12. We need some advice for dealing with Dell - we had fallen behind a few months and sent several letters asking for a payment arrangement which were all ignored. We called several times and only got non-English language operators who only wanted full payment. I called to setup payment arrangements and they accepted the terms which was $500 a month for 10 months which pay the account in full. After setting everything up they informed me that our would be charged off and even after the last payment was made would reported that way to the credit reporting agencies and would not be reversed for any reason even payment in full. I was told at the end of the payments I could write letters to the credit bureaus and dispute that I had paid it off and show proof to get the balance to zero. But they would never remove the charge off. This is crazy - I am willing and able to pay this account off and I get told they will do what ever they want even with payment? All our other credits agreed to a debt management program and after $65,000 are paid off. We were told Dell would not accept any debt management plan. Now our debt management plan is over and we cn afford to pay off Dell. I am very hesitant to send them any money until I can learn more about charge-offs and my rights. This does not seem like it should be allowed. Any advice for those having dealt with them?
  13. Dear CBers: I recently reported a Macy's Charge Off (paid in full to CA) to the CFPB as the CA told me it would be a PFD and was never deleted from any TL. I contacted Macy's first and they were no help and wouldn't even give me the name of the collection agency who handled it! This is the response I got from Macys: "I am in receipt of your complaint filed with the Consumer Financial Protection Bureau and forwarded to Macy's Executive Office on February 10, 2014. As a liaison of Macy's Executive office, I was asked to review and respond to your concerns on behalf of Department Stores National Bank. Your Macy's account was charged off due to serious delinquency on August 7, 2012, with a balance of 239.06. Your account is not currently assigned to a collections agency, but is was assigned to FMS Inc., when you paid 239.06 on January 23, 2013, bring your account to a zero balance, as reflected on the enclosed February 7, 2013, billing statement. The account is being reported accurately with a paid-in-full charged off rating. Because we do not remove accurate information from a credit report as part of a payment agreement; I must decline your request to delete your account from your credit report as you requested. Enclosed is a snapshot of what we are reporting to the credit reporting agencies. If you have anything in writing from us stating that we will delete this account from your credit report, please forward a copy to me for review. It would be against our policies to make such an offer to any customer. Our records show that on April 12, 2013, we instructed the credit reporting agencies to update their records and report your account as "customer disputes reporting". If I may be of further assistance, please do not hesitate to contact me at the telephone number listed below." How should I best go after FMS?
  14. I recently learned that I have charge off of several hundreds of dollars from comcast that is being reported on my CR although I have an active account in good standing with comcast. I contacted comcast and after several calls one csr was able give some details about why this was showing on my CR. She stated some catv equipment was ordered a few months ago and never returned. I explained that I've never ordered any equipment and had the same service for several years. I assured her that I never requested any upgrades or new service. After asking for the date and location of activation she was able to give the address of services and the person who opened the account which is not my address nor anyway related to my name. She eventually realize that this appeared to be fraud and told me that I would have to fill out the following form: http://www.consumer.ftc.gov/articles/pdf-0094-identity-theft-affidavit.pdf and get a police report Once I filed a police report and completed the form I would have to go into a local branch and show proof that I filled out this form. I attempted to iterate that this account was not created by me and that comcast needs to investigate why new service was allowed to be created especially since it would've been trivial to identify that service already existed for said ssn, but she stated nothing could/would be done until I completed the process she requested. My question is since Comcast is making the claim that this is legitimate isn't the burden of proof on them and not on me. Legally they made a claim so why do I have to prove my innocents? I have not sent any formal validation request to comcast but based on our phone conversation I do not think I would get any different results as all they will see is an account was opened with my ssn. This really isnt a post about the validation process but more of a question about burden of proof and what is consider proof... Is an account showing in some company's system enough proof? Should I be able to sue comcast - not that I necessarily want to to do this but its clear they were negligent or did I somehow forgo my rights to sue when I signed up for services? I will probably submit to their request and fill out the form and police report but if there is any other recourse I may consider taking legal action. To be completely honest I do not feel good about filing a complaint with the sherrifs office. I'm no criminal and have a clean record but I choose to limit my dealings with government agencies. I like to keep my digital profile as non-existent as possible and I simply do not want to acquiesce to any additional contracts.
  15. Hey all, I am new to the credit repair but I am trying to get rid of all my bad debt and start new. Currently I have more medical debts than anything that I am using WhyChat's method. But I do have a MACYS CC that was a charge off. Currently only the charge off from MACYS is reporting but I did receive a notice from a CA (which is NOTon any of the credit reports). The SOL is expired and it will be removed (or is due to be removed) in Nov 2014. I want to try to buy a house in a few months so I am trying to get this off now. I am willing to pay it but I am only willing to pay for delete...but the CA cant remove the OC charge off?! Right? What is my first step? Do I send a DV letter to the OC or the CA (who is not on my credit report)??
  16. There's growing chatter here as of late about the flurry of 1099-c forms going out to (former) debtors. Before the threads go in a hundred different directions, I was hoping we could wrangle all the questions and answers into one thread or perhaps one of the board gurus can slap together a Master Thread. I ask this not only in the spirit of altruism (so that future generations can find a central repository for our knowledge and not go nuts as we all did in the past looking in 100 places for one answer to one question), but also for personal reasons... The gurus here helped me fix up my wife's and my credit years back (thanks again) so I moved on to helping the family. My brother's repair has been a thorn in my side for YEARS. It went well at first and I took care of everything EXCEPT two chargeoffs...I've been stuck on them for YEARS. I've tried everything (except paying, LOL) without any movement. Today, however...he got two of those 1099-c forms stating "We will no longer attempt to collect the unpaid debt on your account"--one from Chase and one from Citi. This, obviously, is something new and I want to figure out how to leverage it in my favor with regard to credit repair. In other words, any movement on the part of the creditor is good news--it's just a matter of figuring how to work it into a deletion. So...If I'm reading the other threads correctly (and please correct me if I am wrong): 1) The amount on the 1099-c must be factored into his income and taxes paid on it. In other words, if chase is 2k and citi is 1k, he's going to owe tax on 3k. Assuming federal tax to be around 30% for his current bracket, that would be about $900 which is great news as paying that would be a lot less than $3,000. 2) Furthermore, if he can prove he was insolvent at the time (he was), he will pay nothing 3) Any "Identifiable event code" other than "H" (his was "G") means that the debt was written off and not sold off. In other words, no CAs will be harrassing him (?). I don't know if that's all correct, I'm culling it from other answers in other threads. If not, please let me know. Anyway, this brings us to the big question vis-a-vis credit repair (this is the purpose of the Web site, after all): ARE THERE ANY NEW SUGGESTED STRATEGIES FOR REMOVING THE CHARGE-OFFS ASSOCIATED WITH THESE ACCOUNTS NOW THAT THE LENDERS HAVE OFFICIALLY WASHED THEIR HANDS (1099'D) OF THESE DEBTS? I see the angle here for the lenders--the banks are probably getting more of a net addition to their balance sheets by writing it off as bad debt since, in this day and age, collection agencies are bidding less and less for debt (especially small debt) and with any luck they will soon go the way of the dodo. In other words, the banks are doing it with the bottom line in mind, not to help people (even if they do so in a roundabout way). Anyway, the banks are minimizing loss on the debt and they are happy, does that mean (I'm assuming/hoping so) that they now could care less whether or not there is a CO on Joe Schmoes CR? In other words, will a deletion through a dispute--or, perhaps a Goodwill letter--be easier now? Any answers from experience, gut feelings, crystal ball-readings or jut plain educated guessing will be great for the discussion.
  17. I filed Chapter 13 Bankruptcy in June 2008. The bankruptcy was discharged March 2013. Experian has some of my my accounts listed as the following: Account History: Charge Off as of Sep 2012 Debt included in Chapter 13 Bankruptcy on Mar 18, 2013 They have my account being eligible for fall off in 2019, which means that its been reaged as well. Ive disputed this info numerous of times. Is this info being reported correctly, or would I be able to prove violations of the FCRA AND Federal Bankruptcy violations. Thanks, Art
  18. I had an old (well not that old) bank account from 2012 that charged off in January of 2013. I haven't heard hide nor hair from anyone and I haven't moved, so I called BBVA today to find out where my account was at. I spoke with the 800# for BBVA and was told that my account was charged off in January of 2013 and sold to a company called CBCA, then I was given a number for the collection agency. After reading up on the number provided by BBVA it sounds like this CA are real psychos. So, I called the branch that I used to bank at and the teller looked up my account and informed me that I was still able to come in and make payments at the branch until the account was paid off and I would be taken out of collections. What course of action should I take? Should I just make payments to the bank in person or should I attempt to contact the CA? By the way, I've been checking my Chex and credit reports and there is no reference to my BBVA account.
  19. Good Morning Fellow CBers! I am down to my final and last baddie. Here is a little background and i would love to have ANY and ALL input on what direction i should go... (BTW with the help of YOU folks i have had success in moving my FAKOs from the mid 500's to 695...I know it isnt true FICO but it is an improvement so i really appreciate the helps from ALL!!!!) Okay: Capital One original Bal 500 charged off to a little over 1750 out of SOL (in texas) I have contacted their "help" line and was willing to pay the total amount charged off for a deletion but lady told me they "cannot" delete information.(which i know is inaccurate..probably what she is scripted to read) even if i paid the full amount. I am really stuck at this point on what to do...PLEASE HELP....
  20. I have a couple of charge offs that are 4.5 years old and the OC's still report a past due balance. I find it hard to believe that an OC would hold this debt on their books this long. I disputed with the CRA's and they both came back verified. The SOL in my state is 4 years. Has anyone experienced this? The two OC’s are USAA Bank and Discover.
  21. I really need some direction here on this case. I have a CO from Capital One, in July of this year I wrote them a GW letter and they took it as a dispute (the TL was reporting accurately AFAIK). After the dispute out of nowhere the entire TL changes. Late payments moved from month to month, the CO date changed, an insane high balance and payment was reported, all false. I can prove on the new TL all payments stated late were made on time. However when I contacted Capital One with both credit reportes they claim thier reporting to EX is correct and the errors in with EX's side and if I had issues with the reporting to contact EX.   22. CBer's, I want to ultimately get a second mortgage charge off tradeline removed or at least changed to a more favorable status. First attempted a loan mod that was eventually denied. I then proceeded to do a short sale. The dates and amount from the short sale are correctly reported on my CR. I have read Psych Doc's transcript, which had a lot of good information, but I didn't see specifics for dealing with a mortgage charge off. When dealing with the OC he recommended using the FCBA, but to me that seems more for credit card billing errors. I am thinking I should try sending a validation letter, but wanted to get some advice. If it matters the OC is B of A, the amount is $73K, first payment missed was 12/2009, short sale closed in 03/2011, and I am in California as was the short sale. Any help would be greatly appreciated. Regards, Erik
  23. I am new here on the forums and on my journey of credit recovery. On my credit report I have 9 negative reports. Five in which I believe I can handle on my own since they were medical bills and my insurance was suppose to cover it. In Collections: MidLand Funding LLC - OC Tmobile - 754 RENTDEBT AUTOMATED COLLE( OC 2 East 8th APTS) - 2,051 FAIR COLLECTIONS AND OUT( OC 2 East 8th APTS) -2,051 How can the same debt be on my credit report twice under two different CA? Is there anything I can do about that? 
Then there is some credit card debt.. Citi Bank - Collection / Charge-Off - 1,443. I really don’t even know where to beginning. I’ve read so many things. The first thing I wanted to tackle was the citi bank charge off because one I am still getting statements from Citi and my balance is growing interest. I didn’t even think that was possible because when I called them they said my account was closed and now in the hands of a collection agency. When I contacted the CA (xMonarch Recovery Management) about a PFD they said they weren’t able to do that I would have to ask Citi. But they did try to cut me a settlement of 350 on my debt of 1443. Should I take it and then just try to get the paid charge off off my CR? Can anyone give me some advice to handle these negative accounts on my CR? Thank you

I disputed a Credit One paid charge off a while back, and just noticed that it was updated as a "charge off" with a zero balance instead of "paid, was a charge off" like the two others I had with other credit cards. So on EX, it's showing as a KD this year, when it was charged off in '12. Anyone have an idea why that one would be reporting differently?
  25. What should I do next? Progress detail below....... OC has been reporting CO and a remaining balace of $22 every month since 2007. This acct was settled for less than payoff on 2/2009. I called them explaning that this is wrong and that they should not be continuously reporting this every month because this was a settled CO. This acct is so old, they could not find proof of settlement nor do I have a copy either. So, the rep saw where the acct had been sold to a CA and directed me to pay the $22 remaining or call the CA and take it up with them. I politley requested to escalate the call for further help and she did. (Background Info: In Sept 2012, I online disputed both TL's listed for this acct with EQ. OC(as not mine) the CA(as duplicate acct). They were both reporting each month on EQ. Only the OC TL was showing on TU, no disputes filed with them. Resulted in EQ deleting the CA TL only. Comenity (OC) stayed and continued to report.) Back to the present....... Call sent to a supervisor, explained this to her. She said that the CA did not file the Settlement Letter like they were supposed to. She typed one up and email it to me. She said that it would remove all the mthly postings back to 2/2009, and change the DOLA to to 2/2009 as well. The letter does not imply all of this thou...... How should I move forward with this? It is due to fall off 5/2014 according to TU.......
