  1. The amount they have me owing is much higher then thought.
  2. I submitted a debt Validation letter to Midland credit management. There repsonse was our records are accurate and they currently are not reporting to credit report agency. And they won't contact me any further unless its respond to the dispute. They did include one copy of a bill. Nothing else. Oh and they said I was requesting accuracy of credit reporting. What letter should I send next? I'm confused why they said the reason for me contacting was for that when is was debt validation
  3. Elderly parents had a debt in 05 had a judgement against them. They forgot about it and dec 2017 a FiFa was placed (didnt know until I called court today). Recieved a collector letter today for it which is not the Fifa holder (she is no longer with the other company). Does the current collector have rights to take lien off once paid off?

Okay I have a problem the past three times I have tried to dispute a balance on an old Cap One card that was paid in full with the Courts, I have my letter from the court saying paid in full...>yet Experian keeps reporting a $350 balance as of Nov 2012. It was paid in Full Oct 2012...what can I do now? Equifax shows 0 bal 0 owed It says the following Account charged off. $1,079 written off. $350 past due as of Nov 2012. I paid it off 1079.00 plus 100 court fees to Fred Hanna and associates

Now a couple months later of back and forth with lawyers...It comes down to us , if we can't get a loan we are out, Even though we did everything legally and providing reciepts for every payment.. BUT being the bank refused to take payment from us when we found out about this, the lawyer said they will have to own up to that one..We had a clause in the paperwork that clearly said if the seller defaulted on the loan we could make payments directly to the bank, in which the bank would not accpet payment.

Credit report was disputed as inaccurate CRA verified it as accurate...but i paid off in full got my notice from court and cap one reported that we still owe...what should i do next?? And months i paid lawyer never reported balances for each month were way off

I currently pay on an old debt with cap one, thru fred hanna...I made arraignments thru the court to pay, its almost finished paying...Now I noticed on my credit report Cap One report a balance almost 400 lower than what Fred Hanna said was my balance/.....Do I contact the court, Cap one or Fred Hanna office???
  9. What A nightmare this is turning into be!!! I probably broke the cardinal rule by never call..... I called.... For the 4th time They sent a letter saying it was forwarded for review (this was the 3rd time) BUT they couldn't get a hold of me..... Seriously.... They said this was for an online School from 2004 (first time I called they said 2001)... And supposedly i made a 5.00 payment on in 2004, turned to collections in 08. Transferred to LVNV in 2011 and that resurgent now "manages it" They tried to peddle me for my social, I said no!!!! Upon me asking why they couldnt get a hold of me, they said i had to send a police report or affidavit....saying its not mine and I suspect fraud. So I then asked where is my letter stating this, so I know what to do...OH WE DON"T SEND that kind of paperwork out, you HAVE TO call us to find out. I told them NO, send me paperwork...Woman said they couldn't (she was nice)...I asked for supervisor.(I have his name)..He said we never send paperwork out, you have to call in to find out. Me: so if I had never called, I wouldn't know...Right? Him: yes your right, we dont send paperwork when its in review of what u need to send in...Me: seriously....Im not signing my name to anything for you guys, nor am I making copies of my license for you to HAVE. (per the affidavit)... Other question were thrown around....... I asked if they had original paperwork from this "supposed" University, and was told we aren't the orginal creditor so we can't get that..I asked for proof on paper about the address used and what type of payment used...... Them: Oh we can't get that, we aren't the original creditor. Me: so if I dont send in affidavit or police report, what happens...Him: then we will continue collections... ME.....Thats nice...Statues ran out years ago anyway........>CLICK!!!!!!!!!!!!!! Should I just not worry anymore? report? Do what ?

  11. We have retained another lawyer yesterday as the first one said there was conflict of interest...There was no due on sale clause... But there was a clause in their that we are entitled to pay if the Seller Defaulted which the bank did not know about...So hopefully now it will get straightned out

I recently mailed out a verify debt to Financial Recovery in MN, Resurgent Capital in SC , sent a letter saying that my bill (for which is not mine AT ALL, never went for Bridal Consulting or college for it) was placed with them. and enclosed a verification letter..On the bottom of first letter it says that LVNV Funding cant sue because age of debt and LVNV will not report to CRA and unless i dispute Validity of debt it is assumed mine.... Original creditor is Ashworth University, then current owner is LVNV, Letter sent from Resurgent Capital...Letter last month was Financial Recovery... Am I screwed? Or should I send a Letter of dispute validity? It is not mine, they say I paid on it in 2004 but its from 2001...Never did such a thing.. The verify debt letter says lvnv owns account number ......... orignated by ashowrth university, aquired by Arrow Financial...Balance was 628 but is now 847.81 and that my balance would continue to change day to day i should call them to find out exact balance
  15. Recieved letter from Greene&Cooper, says they represent Midland Funding LLC for a Credit One account.... I need to know what letter to send them I want to settle on a lesser amount making payments. The debt is mine and SOL doesn't apply. I want to get our credit back on track. Last time I got a lawyer letter we went to court and they agreed to terms. So don't wanna do that again if I can avoid it...
  16. Thanks for all the input everyone... Spoke to the bank, they met with their foreclosure lawyer. They have nothing about the sale of the home as a WRAP mortgage, our contract says its WRAP closing sale documents with cost breakdown have it as New note and New loan.. Just one jumbled mess.... Now we have to retain a lawyer even though none of this is our fault.. We followed everything the lawyer said at closing
  17. When he sold us the house he still had a mortgage on it, he did what was called a WRAP around mortgage, which basically is a second mortgage. I didn't think anyone offered wraparounds any more. If his mortgage company recorded their lien, then that lien will need to be repaid when you sell the property. Yes they still offer them, it was a small community bank that did it. We never defaulted, the seller did..We have all the recipts

We talked to the lawyer that was doing foreclosure, he stopped it because the deed is in our name, the bank never knew he sold the house, the foreclosure lawyer had to call the bank and tell them they can not foreclose on something that isn't in the mortgage holders name. So now everyone is confused as to what gets done, but the lawyer did say they cant foreclose. We pay the taxes the bill come in our name and it is also on record in our name on tax assesor and land records I'd ask your lawyer specifically how 'in the clear' you are. The lien is on the property, not the owner. Since there is a lien on the property, you won't be able to sell without that lien being paid and cleared. Did you have a title search done and purchase title insurance? Talked to the foreclosure lawyer he said he couldn't place a lien on the house because it isn't in the mortage holders name, so therefore he can't legally foreclose on something that not the mortgage holders name. So thus is all the confusino between bank and lawyer, how the mortage holder got a mortgage. Bank says that he never told them it was sold, so my thinking is that he just took out a second mortgage on the home.. Yes we did the title search.

Here is out situation, we bought the home in 2009 , the seller agreed to finance the home.So he holds the mortgage...Well now he has dafaulted and the home is up for auction Aug 7th. we just saw the notice in paper.. We have all our records saying we paid him on time since 2009....What is going to happen now? we live in GA
  23. I sent out two Verification letters , there was a 30 day wait inbetween the two.. Now I haven't heard anything from Letter #2. What would be my next step?
  24. Sending out DV to both companies. It is not SOL, it was about a year ago..I already C & D UNited recovery, then it was misteriously sent to Hanna and assocaites...But I am sending a DV to both places tomorrow
