  1. hmmm, my SO banks with Wachovia aka WellsFargo. From my convo with csr there about the opt in/out issue was that if you didnt specifically request to opt out the bank pressumes you wish to maintain overdraft protection. And from what I just skimmed thru this seems to be permissible. The other thing, you made an electronic check payment ? That's what I was kinda thinking on the Opt in/opt out issue but wasn't sure.. and yes this was an electronic check payment.. but cable company wouldn't stop it on their end to let me use my CC when I called them the next day when Igot CC.so I called my bank told them cable company wouldn't stop the payment, and wanted a Stop payment issued for the correct amount. I was only told that it might not work if it didn't have the correct amount, which it the stop payment did. I've never had a problem with Stop payments.. even from this bank. I've had one before and they honored it. So i'm pretty sure they are in violation of at least Regulation E. I just talked to my neighbor about this, she works for a bank. She's saying that really it was an electronic payment with "preauthorization" kind of like what happens when you swipe the ck card at the pump, even though there wasnt a "hold" placed on the account the bank has to honor it. She suggested you look at the account disclosure, to see what their specific policy is regarding this. And call the escalation or executive csr at the bank . Edit to add: Some companies present ach payment in whole dollar amounts, then when it "posts" it's the actual amount. Nope the actual amount of the ach is presented as pending at the moment. Cable company usually does the correct amount when they do an Ach transacation. I told the bank it was an Ach transacation. My feelings are, that there was a stop payment on it, and they should have honored it per Regulation E I just e-mailed execs so we'll see what happens. I've never had a stop payment NOT stop a ach or regular check. I can understand the cable company sort of not being able to stop a pre-auth check,but the bank shouldn't have to honor it when there is a stop payment in place, that's the whole point of a stop payment. Well, like I said I have only done it once before without a problem. But most ppl I know have had more problems then not from stop payments. Hopefully, contacting the execs will resolve this for you.

  4. I have only had to use "stop payment" once, but as I understand it they cant guarantee. I personally think its a useless feature, since 9 out of 10 times the check will still be presented. Sorry this happened.

  6. Are you sure that its a new pull? Since you said it was a fako EQ score that dropped. There is usually some lag time with the Fako monitoring to report changes IME .
  7. I have an Express card and as of today it was still reporting. Did you dispute it?
  8. I have had it also for 4 months PIF everytime, my last payment is on hold again. Really annoying and no one can explain why they put a hold on it. No late, multi pays ect.
  9. I also found these guys sitting on TU today. Now Im wondering about their reporting and the many ways I am going to stick it to them. I review my reports daily and order hard copies from all 3 every month. (cleaning for house purchase at the end of year) They have never appeared on any report. This is how they are reporting for me Date Placed for Collection 01/2010, Date Updated 06/2010, Date Verified 03/2010( Never disputed ) Estimated Date of Removal 08/2011 Original Balance 50 Past due 285 Current Balance Due 388 I am not even playing with these fools, they tanked my score by 40 points. So, now where to go from here??

Based on your parents being eligible, You are eligible for membership. If a MSR tells you different, ask them to confirm with our membership dept. Some of our MSR's have been there awhile, and still go by the old Field of Membership. Call again Well called again today, think they are starting to wonder about my sanity lol ! Explained my dads retired military and mom DOD to 2 different people and got the same responses as before , they have to be members in order for me to join. Ugh! So before getting really ticked , I decided to chill out for the weekend and do as ASIB35 suggested. Thanks, by the way

  12. Okay, I must not be liked by Navy Im a USAA member, my dads retired army and my mom is DOD . I have called 4 times and been informed I cannot open an account nor membership without either of my parents having membership. Am I missing something?
  13. Thats the thing I dont know. The screen shot from the cable company just shows the balance and disconnect date. No charges for service ect.
  14. Background, checked CR and found CMI sitting there, never received any calls or letters from them . So I send out DV. I got there response yesterday. They sent a copy of a screen shot from OC (Cable Company) showing that CMI was assigned to work account, date of disconnect, account notes and balance owed. They also sent a copy of a form letter from Cable Company advising me they charged off the account between July 1, 2007-September 30, 2008. With my service disconnect date of July 2007. And the account was sold to CMI December 2009. My question is how do I determine if I do actually owe them 360.00? I called Cable Company to try and get a billing history so I can see whats , what and they told me they no longer have that information. So, I called CMI (recorded the call) and asked them about billing history to confirm the amount being collected is correct ect. They tell me the only information they can provide they sent in the letter I received yesterday.
  15. I have had that happen on several ocassions, I have also had an account deleted..... I dont dispute late notations anymore, to much risk with loosing an account for me.
  16. Please tell me you have this convo on tape. Yes I do have this recorded dont talk to anybody when it comes to this type of thing without recording it. Sent out a DV. So will see what they do in response if anything.
  17. They know they arent reaching me. The Voicemail clearly states the name of my SO.
  18. Called them again yesterday, same group this time I gave them the number as requested. Then the guy tells me that the number isnt in their system??? WTF?? I told him that cant be right since they call on average 2 times a day in the past week, so how are they calling if they dont have the number? I gave him my name again. Nothing. He then tells me he needs to get a supervisor to figure this out. The supervisor gets on the phone and all of a sudden I am found. He tells me that because I waited so long to call back that they had no choice but to verify my employment and income. He refused to tell me who, how much they are trying to collect or give me their name or confirm that its OMNI . Just kept insisting that he would terminate the call if I didnt give him a credit card number or set up an ACH . Ummmm hello why would I give that information to a person that refuses to Identify the company they work for, their own name, the amount, and who they are collecting for? After refusing to do as demanded he told me he will give the ok for a garnishment of my wages.. and that I am screwed for being stubborn. and hung up. Ok I know thats a bunch of crap right there..... I have nothing on all 3 reports from them. The negs on my report are all accounted for. Im sending a Limited C&D and DV today.
