PL Thanks you so much for that response, I don't know how to follow this up, I do not trust the attorneys and I do not trust Midland, I don't know whether I should write them and if they fail to comply within a certain amount of time, then proceed with it back to court but I would not know what to file, or just skp contacting them and head straight back to the court, It's paid that should be the end of it, and I know the reason you explained is the reason why they're trying to use trickery with me They aren't trying to trick you. No doubt they send exactly the same notice to dismiss in other cases where they have settled. As I said, if you sign it you would be in exactly the same situation as if they had never sued but had settled and sent you a letter confirming the settlement and payment for less than the full amount. They have admitted there is no longer any debt obligation. Period. It's just what lawyers do. In all probability, if you send them a letter saying you'd be happy to sign a notice of dismissal with prejudice they would do so as they still want to avoid going to court, running up more costs, and having a judge so dismiss with prejudice which is pretty much a given because you've settled. OK Thank you again I will send them a letter, I really appreciate your help

I just typed this page so you can see it, It's the final part of the stipulations some parts read with trickery Upon signing of this agreement consumer releases & discharges creditor , it's agents, attorneys from all claims of any kind, including violations under the FDCPA and applicable state laws that consumer may have with respect to the account including all claims that were asserted or could have been asserted in this action and any claims stemming from debt collection efforts of Releases, upon payment of all amounts due pursuant to this agreement the creditor releases a& discharges the consumer from all claims of any kind, both known and unknown that the creditor may have with respect to the account including all claims that were asserted or could have been asserted in this action This is from the stipulation that was signed in court it clearly says I will be released from all that crap, I refuse to sign without prejudice but I want "paid collection "on my CR with a 0 balance and no future ties with this company

I have a question & hope I'm in the correct forum. I paid a debt collector, I had no other choice, we went to court, they produced everything, I was able to talk their attorney down to about 40% of the original amount. OK Done, I received a letter stating that the debt was settled for less than the original amount on such and such date. So now I received a letter they want me to sign, stating that in order to discontinue the lawsuit, I have to sign this paper that says I agree to dismiss without prejudice. Now I'm not genius but I do know that , it means they can re-file this case at anytime if I agreed to it, but it's paid in full, and they have no future business with me regarding this, so why should I sign this ?? My Question is What do I do, Is there some kind of motion I can file in court to have it dismissed with prejudice ? By the way, it's Midland and I know they are dirty

Thank You Flacorps for a speedy response. I know I don't owe the bill. Will I be able to ask the CA to validate the amounts I owe? I read somewhere sometime ago that due to Hippa, there is certain information that hospitals can not release to anyone. -

When a business huts down in bankruptcy the trustee sells off everything of value, which includes the accounts receivable (debts that the business once expected to collect). The purchasers of those receivables are now the ones the former patients must pay. But there are likely to be questions about what is and isn't owed ... hospital billing is an area that creates a lot of room for dispute. With items this small, perhaps owed perhaps not, your best bet would be to negotiate a PFD or a TLF. If you can't get those, you may want to just let 'em twist slowly, slowly in the wind. Perhaps the debts will be sold to someone else who you WILL be able to deal with. -

Equifax is reporting the only 2 derogatory entries on my CR. They are 2 very small alleged unpaid medical bills that a CA is now trying to collect on. 1- is $59.00 and the other is $67.00. I have no idea what it is for. The hospital that the original alleged bill is from closed down in 2008. I disputed this with Equifax twice and each time they verify this bill. Just recently I received a noticed from the Us Bankruptcy Court District Of NY informing me that since 2008 this hospital has stopped working and has filed chapter 7. The notice also stated that the hospital may have copies of my medical records and how to go about to get copies. My question is can a CA try to collect on a debt that was from a hospital that filed bankruptcy?? Can someone please advise of a way to go about getting this off my CR. Thank You -

Not True, I've been using Verizon for well over 7 years and they never reported to the bureaus, Now maybe if you become delinquent, that may be another story, if your account go into collections, otherwise I have to say the answer is No, they don't report -

All 3 agencies removed 3 accounts that were near 10 years old and all reported paid and never late. This cause my score to drop because it's showing my length of credit to be only 2 years. Please help what can I do. Can I request to have these accounts placed back on my CR.

Cohen & Slamowitz are dirtscum In 2004 I came to this board with the same situation, I received a notice of a judgement against me, by C&S. I went to the courts to pull the records, and it stated that they served me, and even put a phoney description. See Thread : http://creditboards.com/forums/index.php?s...mp;#entry481458 The results to that were, the judge gave me to options, #1 was to have a hearing to determine if the summons was served to me, that meant bringing in the so called processor, But the judge warned me that even if I won that hearing, they would only serve me again in the future OR #2 The judge would set a date to come back and vacate the judgement I chose to have the judgement vacated When I was going through that situation with C&S I googled their company name, and we are not the only 2 they done that to, there are numerous complaints about their practice, and they tactics

Thanks Neen I have a court date on Dec 17, against a CA, I have a gut feeling their not licensed. I finally found a NJ address for them but not much more I really appreciate the help

I know that in NYC a CA need a DCA license to collect in NYC. Does anyone know where or how I can find out if Rab Performance Recoveries is licensed in NYC, I can't find their address anywhere, I'm assuming they are in NJ they phone area code is (201), and their not listed under the BBB
