  2. I was just notified by Truecredit that a judgment was just granted against me. I have fought off CA's on this one for four years. Each time I DV one collector, they pass the account to a new one. The judgment was from a new collector that I had never heard of. I never received a letter or phone call from. They just went straight into court and got a default judgment. I never received a summons about the court date. The account is past SOL in my state. I spoke to the Clerk of Court and she said I could file a motion to have the judgment vacated. She indicated that it would be easily granted in this court. She also suggested that I write to the lawyer that handled the case to see if they would vacate voluntarily. I don't hold out a lot of hope that the collector's lawyer will say, "Oh, I am sooooo sorry. We'll just vacate that judgment right away." What do you think?

    Should I bother writing to the lawyer and collection agency or just file the Motion to Vacate? Your opinions will be appreciated. Thanks.

  3. I've been helping my son with his credit repair. He has a few small charge offs that we have had no luck getting deleted. These accounts aren't scheduled to drop off until early 2010. He is going to New York in September for a one year job assignment. If we pay these accounts now, they will drop off shortly after he moves because of New York's five year reporting rule. What happens after he comes back from New York?

    Do these accounts stay off his reports?

  5. A newbie's opinion


    The government needs to enforce the regulations that are on the books for collections of debts and debtor abuse.


    Also, the FICO scoring should be "Unpaid collection/charge off = BAD" "Paid collection/charge off = GOOD". This seems more reasonable. It shows the debtor ran into problems and then did the responsible thing.


    I tried (before I found CB) to call my original creditors and offer to pay in full for favorable reporting. Guess how many took me up on my offer? NONE!!


    I will NEVER pay a penny to a CA. I don't care if the put me in debtor's prison, boil me in oil and then throw me in a dumpster!!

    (I'm very brave now that all my accounts are past SOL!!!

  6. Thank you for the great advice!!! We pulled his reports this afternoon and will sending off letters for omitting old addresses on Monday. Then we send the dispute letter. At last I have a use for the really ugly pink floral stationary my grandmother gave me!!!

  7. My brother had a repo four years ago. The deficiency balance is showing on his CRs as "repossession, charged off $16,877. GMAC has never tried to collect on this. During the time of the repo, he and his ex were fighting over everything including the mail. He knows he never received any certified mail from GMAC but he wonders if the ex might have received the notification of sale, etc. sent by regular mail.


    My feeling is that if it was a legal repo, GMAC would have been all over him to collect the balance. I think he should proceed with WhyChat's letter. He can't be any worse off, right?
