I think the OP should sue, drag the Judge in that dismissed the ticket and have him explain why he is going around quashing tickets while others have to pay. I would reiterate what I said earlier but I got a warning and a lolipop from the principals office. I know alot of judges too, doesn't mean if I'm wrong about something I'm going to run to them and have them throw it out. But hey it's your life dude go right ahead. When it backfires on ya and I guarantee it will, they'll have this thread to look to and not only will you drag your DW down with ya but your friend the judge as well. JMHO if you want to get upset and run off about the FDCPA and mini miranda violations go right ahead. I'll cheer you right on and when the judge gets yanked into JQC I hope you have the money to help him/her out of the problems you've created for him/her. <{POST_SNAPBACK}> Flath-- It must suck to be the type of cop that hangs out at speed traps throwing tickets around because they lack the motivation to actualy PROTECT and SERVE by patrolling streets and neighborhoods like they should be. And then when it comes before a judge who can read between the lines and he/she throws out the redicules fine(s) the cop levied against joe public. If I were that kind of cop I'd be pissed too. I'm NOT saying that your that kind of cop but your doing an awful lot of squaking about it. You talk about beating a dead horse, I think you've successfully dropped the tree on the "dead horse". And be sure to tell us when you require the shovel to unbury yourself and your friend the judge from the pile of crap you are about to step in.

  7. Hmm speeding is speeding. The 45MPH speed limit sign doesn't mean 47MPH or even 51 MPH. If it did it would read 47 MPH. Slightly speeding is like saying a woman is slightly pregnant. Either you are or you aren't.
  8. Breeze I understand. My philosphy though is you have a warrant 2 options really exist. Well really 1 but for the sake of argument 2. 1. Go to jail and sort it out in front of the judge. FTA are quite serious, at least here in Florida. Try to get a bond without collateral with a FTA even if for a Traffic infraction. 2. Pay the fine and it's cleared up. Yes no one likes to pay a fine especially for something 6 years ago. But then again the state didn't hold a gun to a traffic violators head and say "Don't pay so we have to expend time and taxpayer money to hunt you down." I know alot of property owners including myself gripe about increased property taxes and services like MTSU's and Law Enforcement taxes. But it's unreasonable to expect the government to collect from the deadbeat traffic violator by expending more taxpayer dollars to get it. I mean in effect there is two alternatives Go to Jail or pay the fine. The option was extended to go to court when the citation or infraction was issued for what ever reason, whether it was forgetfullness or irresponsibility to just an honest mistake you owe the government that money. Again I'm simply going to pose this question. Would you rather go to jail? Or be offered the opportunity to avoid an arrest record and pay the fine despite how sleazy the CA is and how you might feel. Again serving warrants I opt for the CA collecting the money. It would make my job alot easier to concentrate on finding felons and true criminals rather than a traffic violator. Again I apologize JAB and to the other CB'ers. But I still stand by what I said. It's looking a gift horse in the mouth when a CA or a Government agency gives a violator an oppty to clear up a legal matter without involving your DW being taken into custody. Perhaps the other alternative would be better. Send all the bench warrants and capias out to be served with a zero tolerance policy. D6 the license and stick it to em. If the CA in this case was adding on a huge fee to collect I would be upset but they aren't. They are probably saving the taxpayers 10's of thousands of dollars. But it's not being looked at in that fashion and that's what got me riled up. Carry on.... FWIW I would check to make sure that the BW has been recalled or it could get quite ugly and check and make sure the state isn't posting it to DW license. I arrested a woman with a similar situation she had the receipt showing where she paid the court and the DL office but a clerk made a clerical error and never recalled the capias. I had no choice in the matter but to arrest her on the outstanding capias. Good Luck.
  9. Snot nosed brat may have been a bit harsh. But I still stand by the fact that DW had a Warrant and this isn't a FDCPA case. Those making it into one would be in for a rude awakening. But heh I would have still arrested her and she could have dealt with the FA judge. Obviously one doesn't have the comprehension of how many warrants are backlogged in each county... Some of these traffic infractions/warrants can be better served by collecting the money, but it's obvious that the OP would have rather argued instead of "rolling over". I apologize for my snot nosed brat comment. Although my comment may have been harsh, it must be nice to call up judges to quash warrants stemming from DW's irresponsible behavior. I still stand by the fact that the OP and others so situated are looking a gift horse in the mouth. But heh go after the CA and let us know how it turns out...
  10. JAB you are obviously misinterpreting what I said. You not I nor anyone else stated that your DW had a Bench Warrant out for her arrest. She obviously didn't pay a fine or show up in court or provide some proof of something. A CA is nice enough to send you and the other countless others who negated their responsibilitys to "comply" with a legal directive a nice sweet letter stating pay up or else. Call it rolling over or hand over your checkbook I quite frankly don't care. If she would have been in my area and I pulled her over she would be in non frilly cuffs and explaining her sob pathethic story to the first appearance judge. Again it's not that I don't sympathize and think that CA's are scumbags. But at the same token the approach taken with this case is laughable. My wife didn't appear and take care of a traffic ticket, the clerk confirms she has a warrant but you are still looking for a way to weasle your way out of responsibility or trying to be the protector and champion of others. What others? Other folks that obviously don't pay attention and have bench warrants out for them? You said it was dismissed. Well goly geez what a spoiled snot nosed bratish way of going about it. Waa Waa I don't want to pay a CA, so let's call a judge and have him dismiss it, but continue to want to go after a CA for damages REALITY!!!!!!!

It's like the PP thread, theres going to be people that just push the system and ruin it for others. DW had a warrant!!! Mini Miranda schmanda she should have been hearing Miranda. But drag the CA through the mud. No I'm not a sympathizer either, crooks like NCO and Asset should go down. But now folks will fight the CA on warrants and I hope honestly they get greeted with the Police with the warrant in hand. Geesh.......
  12. No and No. Had it and tried that and all it did was tie up the money I deposited into the savings account. I should say transfered from checking into that savings account. Had to fight the powers to be to get it back. Went from 500 1 year later to 1,500.00 to 2,500.00 to 12,100.00 now. Your best bet with this card is to always stay under the CL. Pay multiple times a month if you bank with BOFA and remember when your anniversary date is and wait 1-2 weeks after that and CALL them. Request CLI doesn't work until it's unsecured in online banking. I would say YMMV, but I was told by 3 different CSR's that you can't add to the savings account on the 99/500 to get a CLI. If your trying to rebuild use that card and get a Nat City Secured card. If your good to BOFA they are definetly good to you.
  13. I'm nodding with jsk on this one. No offense but it's like looking a gift horse in the mouth. I talked to a buddy of mine today and he feels the same way. Don't want to pay the ticket or the CA is "violating" some provision of the FDCPA, so be it. But if you have an outstanding capias or BW then fighting them is looking a gift horse in the mouth. Shadowing, hmm would it have been better to have a NCP Officer show up at your door to execute the warrant? I mean if you do have all that free time then by all means stick it to the CA. But then you're just hurting all the other folks out there when the court says "screw it" they didn't pay the fine suspend their license and execute the warrant. I would have been thanking my lucky stars above that I hadn't been picked up on the warrant. Now have a judge dismiss it and then protect all the other little people by going after the CA. while you are ahead. Glad you got it dismissed, now make sure in about a week or so you have them check the OK state Database to make sure the warrant shows recalled. Good luck..... Unsubscribing.
