  1. UPDATE: DW went down and talked to the people in person. Not only was she able to convince them to accept payment, but they were kind enough to accept 50% of the judgement amount with NO interest. They signed the Release of Judgement and DW filed it with the court today. The Lord is smiling on us today. -jaz
  2. Just an update... Appraisal came back with no issues, appraised for more than the selling price. Now we are just awaiting our closing date. It was originally going to be later this week, but now it looks like middle of next week. I am SOOOOOOOOOO ready for this to be over with. I think that life will go back to a semblance of normalcy once we close, wishful thinking maybe. Not knowing exactly when closing will be really messes up ones scheduling. -jaz
  3. Howdy All! My DW and I are in the process of buying a home and we are a few days from closing and were notified today that an outstanding judgement on DW credit report MUST be paid before closing. It's in the ballpark of $1000 for a broken apartment lease. Well, we decided that we are not going to let this stand in the way of getting our home so we were going to simply pay it. That's when the hilarity ensued. She called the apartment complex and they have no record of her, period. Not as a former tenant, not as owing them money, NOTHING. They said that they have changed management since the time that she lived there and have NO RECORDS from before they took over. So, she called the court house. They told her that she needed to get the apartment complex to sign a Release of Judgement. Without that document, there is nothing that the court can do. She called the apartment complex again, told them what the court said and they refuse to sign a Release or accept any payment since they have no record of the debt. I have never in my life had so many problems getting someone to TAKE MY MONEY. We are less than a week from closing so, obviously, time is of the essence. DW is going to personally visit the courthouse and apartment complex tomorrow to see if anything can get accomplished. I am at a complete LOSS! If they will not accept our money and it is a required condition for closing on the loan, what can we do?!? -jaz

  5. My wife and I decided to take the plunge and buy our first home before the $8000 tax credit expires. I shopped around for a mortgage guy and ended up deciding to use someone from this forum. So far, he has been great and very responsive. He goes by DallasLoanGuy and I would highly recommend him to family & friends. I decided to post here to share my experience as I go along. When I first decided to go for it, I was scared to death and mostly because I just didn't know what to expect. I am still very early in the process but I already know much more about what happens than I did when I first began. Here is what we have done so far: 1. Pre-approval for the loan. Thanks again to DallasLoanGuy, he made that process VERY easy. 2. We found the home of our dreams. 3. Contacted a real estate agent. We have a GREAT agent! If anyone in the Houston area is looking for a real estate agent, let me know and I will pass along her info. She really is awesome. 4. Made an offer (& counter-offer) and it was accepted. (now under contract before the April 30th deadline for the tax credit. YAH! ) 5. Had a private inspection done on the home. It is a relatively new home so there weren't any issues. Now, we start the waiting game. I don't do well with the waiting game, but I don't guess I have much choice. The next step is the appraisal. That should happen sometime next week.   6. Local phone service is through AT&T. I checked the availability of DSL online and it told me there was nothing available. I am going to call them tomorrow just to verify, but I am pretty sure I'll be SOL. -jaz
  7. I've been in negotiation with on a house/property and we have finally come to an agreement on price. It looks like I will finally become a home owner. The house sits on 10 acres and is beautful. This is in a very rural area so DSL and even cable internet is out of the question. I have read that there are satellite internet providers out there but I was wondering if anyone here has used one and can let me know what their experience was. I really don't want to go back to dial-up if I can avoid it. -jaz

  9. I got the "suspicious" letter. I filed a complaint with FTC, my state AG and even wrote my Congressman. Not sure exactly which one got them moving, but they completed the investigation as they are supposed to. -jaz
  10. You would need to get your hands on the original T&C's from that time period. They usually aren't too hard to find if you look hard enough. You might also want to create a new thread and see if someone can help you dig up a copy. Knowing exactly what the original contract states is essential in knowing whether or not the interest is allowable or not. -jaz

  12. It is frustrating, VERY frustrating. But I am going to say this for anyone who comes along later and reads this. This isn't a slam on you at all Joey! Before you pay a RED CENT to an OC/CA/JDB who promises a PFD, have a letter IN HAND that states clearly that they will delete the tradeline and that the debt is PAID IN FULL. They will tell you anything and everything to get you to pay them. -jaz
  13. That's the worst thing you can do. Although, getting a PAID collection off of your report is no easy task. By paying the charge-off you lost the only leverage that you have. Best thing to do, IMHO, would be to let the dust settle and then try disputing it with the CRAs (on grounds other than NOT MINE) and see if it will go away. On the brightside, the older it gets the less it will hurt you. -jaz

  15. It's hurting you. Paid collection is just as bad as unpaid collection as far as scores go. -jaz
