  1. Thank you everyone for taking time to discuss this. I actually reached out to HSBC, and the guy there said that collector is lying - we are NOT interested in you at all. LOL he said they sold the debt a LONG time ago. He also said he would be happy to mail me a summary of my account, how it was charged off and this would provide me with accurate dates of when the debt was no longer collectable by the OC. HE also stated what I already knew - "tell them to VALIDATE the debt" The collection company is full of it and I NEVER got anything from anyone in 2012 about this Joe Cleveland. I also do not have anything on any of my credit reports for all of 2012 from any collection company about this matter. So, I am done talking with these guys. He had my current mailing address, so I said I need your address and I will be needing VALIDATION. To which he said, we don't have to validate, this is a litigation matter. I am done talking with this guy. Lets see what happens.

  3. Its been 11 years since this CO - That should be WAY outside the SOL Yes I have kept reports as far back as 2003.

  5. I received a call from a collection company, in fact they have called me several times over the last week. I did not at first respond back to their request to speak. They called a OLD employer home office and the lady knows me so she called me back to relay the message. The guy said that the credit card was opened in 2005 and last activity was in 2012 - to which I was shaking my head - no way did I have activity that late on that old account. He then went on to say that they HSBC wants to pursue this in court as a Breach of Contract and my attempt to defraud a financial institution. The balance they say I owe is $365.00. I went back and pulled a credit report from 2007 and it shows the card was open in 2005, but the OC charged it off as bad debt in 2007 and the debt was sold. The OC shows a $0 balance. I told the guy I needed documentation about all this, and he said that he could send me something after we figure out if this debt was mine. I said I need to check my records and I would get back to him by yesterday. I didn't get my records together till last night, and he called again yesterday and said hey, need to talk to you cause we need to get this taken care of and or we will have to take it to court and it will become a legal matter and could be significate because it is breach of contract to defraud a financial institue. He said he could hold it to Thursday at the latest. Today he called again and said he can only hold it until today, then they were "at this point if we do not hear from you today, the arbitration team is sending the judgment over to senior judge (Name) in the (region court) to which it will become a forcible recovery when it arrives at his office tomorrow afternoon........." I have searched courts and see nothing..but he did say it may not show on my credit report.. Also, I have NO IDEA who this guy actually works for..company name that is. Since this is a CO and it is OLD like 11 years old, can the OC actually sue me or the collection company sue me for this OLD debt?? I have no other information and I need to make a decision today.     We are in the market also for new insurance. In June my car was totalled out by SF after my paid for vehicle was creamed by a black bear, which ran out of the woods and right into my car. The bear didn't die.. and walked off after the accident. I had tons of witnesses who saw it happen. Claim stated Accident - not at fault - Collision So, i got a settlement for the old car around 4k Bought a 2015 Honda Accord 4 door sedan Hubby bought a new car the year before 2014 Tacoma We have a 1995 Chev SUV that is our spare emergency vehicle (Liability only) We are both over 45 - nothing on hubby's record and I have a speeding ticket from 4 years ago - Should have fought it, cause I was NOT speeding, cruise control was on. Anyhow - we were paying right at 900 every 6 months Now - insurance for my new car is 127 a month just for my car and monthly premium went up from under 100 a month to over 240 a month. Progressive seems the most reasonable with same coverages at $180 a month for all three vehicles. We had progressive before SF and they were awesome and i had claims with them for minor fender benders (2 of them I got hit by uninsured motorists and 1 i tapped the back of a vehicle when she slammed on the brakes ahead of me with no reason) Progressive paid out for the one that was my fault (1200 dollars) and NEVER RAISED our rates! Progressive was around 2100 Liberty Mutual was 2300 a year USAA was 2398 a year Am I being punished for the bear attack?? Cause SF decided to total my car??? the speeding ticket is over 4 years old and shouldn't be a issue. Other than me getting hit by every non driver in my area, I am a safe driver...
  8. yep, i use to like messing with them also, but they always throw me with SUE and COURT - I should know better, but alas, I have been outta the loop for some of this credit stuff and am not as confident as I once was - Yes, they put their information at the top of it mailing address and all - I will sent a DV or maybe even a FOAD letter?? Technically, if the original account number is NOT right, then at the very least, I can state...NOT MINE..and it would be true.. Very true. I'm personally a fan of the FOAD letter, but that is mostly for what "FOAD" stands for........ Me too - in fact - the one that is on the site as a reference letter is one that I contributed to the board!! Back in my days when I was sure of myself with all this credit stuff!
  9. Icanhasmoney: thank you for answering my main question! I just wanted to make sure I had the 5 years figured correctly. Cinn: I agree- however I never spoke with the original guy again after the good advice I always have gotten from here. I did not call them, I got a call from what I believe is a different company! I was taken off guard when the called my work - 5 months had gone by since the last call and nothing happened. My plan is to get a lawyer to handle this matter.
  10. Okay - so I looked at the Payment status on this charged off card - What is my CO date? January 2009? or 8/2008? does the SOL clock begin for DOLA? or the 120 days which was 12/2008. if they are saying 1/2009 which shows the CO in the payment status - and they are using the 5 years for a written contract to gauge the SOL- (which it was an online credit card application) then this month is the 5 year mark!? or should I assume that with previous information that it is 3 years for credit cards in the state of VA? Need some site admins to clarify - am I in the clear to poke them back? at the bottom of the "settlement" email document they sent me last Friday - the "this is an attempt language is printed on the bottom" should I just DV them? That would force them to respond within 30 days - and add some additional time to the attempt to wiggle just inside the SOL for 5 years? They clearly do not have my correct address and i certainly do not want to give them my current address. Since they don't have my current address, and I never reveived ANYTHING from them at the address they have or the previous address - can I assume that they can not pull my credit report because they do not have PP? If I provide them my current address, then they will then try to pull my credit and insert their CA information as a collection?? According to the credit report: Experian is the ONLY one that shows any payment history: TU and EQ show UNK for the 2 years. 2008 - January - July - OK 2008 - August - 30 days late - Date of last payment - 8/27/2008 2008 - September - 30 days late 2008 - October - 60 days late 2008 - November - 90 days late 2008 - December - 120 days late - REPORTED on 12/31/2008 to TU 2009 - January - CO 2009 - February - CO 2009 - March - CO 2009 - April - UNK - REPORTED to Experian on 4/17/2009

  12. Also, this is only on my Experian and TU. Both are showing the last payment date of 8/27/08 - one was reported 12/31/2008 and the other reported 4/01/09 - (I am assuming reported date is the date the OC reported the account information to the credit bureaus). I have not spoken with this guy since Friday - I did leave him a message that stated that I had questions and we could talk on Monday. I still need to make sure that the 5 year clock is over. Not sure if there are any rules about that - is it actually 5 years from DOLA or 5 years and 14days? LOl..just checking. After reviewing the document they sent me - the original creditor name is correct, the "original" acct number is close - but the last 6 digits are not the same. They have their "file" number on there also - so they are trying to pass off the "original account number" as the Original account number - which I have a copy of my credit report and it isn't the original account number - NOT the same. Also, I do not see ANY Collections on my credit reports - none - not from this company or any other. Also, the address on the coorespondence he mailed me is NOT my address - it is an address that is over 6 years old in a county that I do not live in. If this was still inside the SOL - wouldn't they just report it on my credit reports? But, since I don't see it on any of my CR's - I am assuming that the 5 years is up - based on the DOLA which was (payment) 8//08 - hmmmm.. So he might get one of my original FOAD letters?? basically the document he sent states, "upon receipt of funds and your signature...mutually agreed upon settlement amount" if no receipt of signature, this settlement is null and void.. I guess I have to to agree to this now, huh? Since I said I had to see the documentation before I agreed to pay anything - he never asked me if this was my debt?
