  1. I know you teach us that "service" accounts fall under each state's UCC. Where can I FIND that? In NM's, I can find no reference to services... 55-2-102. Scope; certain security and other transactions excluded from this article. Unless the context otherwise requires, this article applies to transactions in goods; 55-2-105. Definitions: transferability; "goods"; "future" goods; "lot"; "commercial unit." (1) "Goods" means all things (including specially manufactured goods) which are movable at the time of identification to the contract for sale other than the money in which the price is to be paid, investment securities (Article 8) and things in action. "Goods" also includes the unborn young of animals and growing crops and other identified things attached to realty as described in the section on goods to be severed from realty (Section 2-107 [55-2-107 NMSA 1978] ). Do medical services just fall under "goods"? Thanks in advance!!

  3. Typed - the initial dispute is the only handwritten correspondence in the program.
  4. Neither - make sure you are reading all the instructions carefully, and keep asking if you aren't sure.   6. Good evening, Why Chat I was served a civil summons today from a CA on an account I had deleted with the HIPAA program a couple years ago. (Still not reporting.) I know I need to study the "I've been served" forum to help with my response - but I don't know if I'm within SOL. I'm in NM (4 yrs) I had 2 separate appointments with the OC - one was 1/31/2013, the other was 7/8/2013. I don't have my EOMB's in hand yet, but spoke with my insurance co today. She said the 1/2013 shows patient responsibility of $984.45, and co-insurance of $327.25. The 7/2013 shows patient responsibility of $268.93. Suit is for $793.10. I assume (do not know!) that this is the balance from BOTH appointments, less payments made. Can I use the SOL affirmative defense, as it appears that most of this amount would be from the 1/2013 appointment? Thanks for all you do!!
  7. Yes- as soon as usps.com shows delivered, print out that screen and include it with the follow up.
  8. Absolutely DO NOT send a copy of anything to the CRAs. Wait for your results from the CRAs.
  9. To re-cap, you have sent the initial disputes to the CRAs, the DV to the CA, and the follow-up dispute to the CRA(s). All of your medical accounts were deleted from TU and EX. You have 5 medical accounts still reporting on EQ, with no "disputed by consumer" notation. Medical services were in 2010. Is this correct?
  10. Your charts are confusing me - of the 4 left on TU, 3 say "no dispute" and 1 says "updated after online dispute". I thought that you had NOT disputed online with TU, and that you included all the accounts in your initial HIPAA dispute??

  13. Do NOT click on that link for online results. You should be able to get in the back door now, or allow time for the letter to arrive.
  14. NO - you send the information to the CRAs (Experian, Equifax, & Transunion), definitely not to the CA. Send it priority mail with delivery confirmation (tracking). Good luck!!
  15. They should send you the results, if not check the back doors - go to the CRA website and click to "File a NEW Dispute" (don't ACTUALLY file anything), this will bring up your current report. If the collection IS gone, be sure to print out a hard copy and keep it for your files.
