  1. First of all Happy New Year VintageWillow! Thanks for getting back to me, and no worries, I understand with the holiday and new years. I have not spoken to the lawyer yet, I am waiting to get paid and have a day to go to the County Clerk to get the paperwork first. Would it be better to skip the one two punch and go straight to file the complaint? Thanks!
  2. Hi VintageWillow, hope you had a great Thanksgiving. I have been MIA because for awhile it just feels hopeless - feels like whatever I am doing doesn't go anywhere. I received a couple of letters from CA stating they will be removing their trade items, so I'll follow up on that. I followed up with Chase and they were trying to reach me because they want to mail me a 1099C saying they will stop collecting and that the money I owe will be taxed as income. I have already received a letter from the IRS saying they will adjust my tax returns to reflect this. Also how do I start tackling HSBC, s

  4. Thank you. I am trying to work a settlement. In other news, a rep from Chase called regarding my old account and was asking for my social security number. I said I would call them back because I don't want to simple give out my ss number over the phone to a phone number I don't recognize.Any idea what it might be? Since they have not reached out since I defaulted on the payments years back.
  5. Quick Update: I e-mailed a rep from Cedar Financial and he said that my current balance is $2,581.62 and the $4,744.73 would only be owed IF I decided to stop making payments. I asked for the paperwork which he said he will look up and e-mail to me. In the meantime I asked if the agency would be open to settling. Any suggestions or ideas are welcomed.
  6. Bump. Does anyone know a good/decent lawyer I can speak to? Thank you.
  7. I understand that now but at the time they were able to garnish more than 25% of my paycheck, especially since I was struggling financially the idea of paying $50 a month seemed small in comparison. I have been dealing with family issues and I know this is not an excuse, I have been actively trying to fix my credit, but there are moments like these where it just feels so hopeless and frustrating, especially since I am not exactly sure which direction to turn. I'll google a lawyer.
  8. I don't understand that either. To be honest, I have been just blindly paying because they were able to garnish my wages before so I'm afraid that they'll do it again if I stop. Should I seek help from an attorney? I would definitely speak to someone. This is way too shady, and makes no sense. You've been making payments so how can the balance go up?? You've paid $1,792 towards this and yet you owe $238.11 more. Impossible. I don't want to give you wrong advice, but if it were me I wouldn't make another payment until I spoke to someone concerning this. I don't understand eith

  10. Yay(?) So what do I do now... do I just continue paying Cedar Financial? Btw they don't send me statements or anything, they just call at the beginning of the month and I just pay them $50.00 Should I get some form of paperwork? You should definitely call and ask to someone concerning statements. They should be providing you with information pertaining to your account. To be honest, and not trying to scare, but it sounds super shady. How long have you been paying them? I understand that you canceled the automated service, but how are they obtaining their payment now? Are you givi
  11. Originally, it was an automatic monthly payment, but a few months ago I turned off the service so now they have to call me once a month in order to process payment. Should I try and settle? How do I reach out to this ... ICAN you speak of?
