  1. I think my lawyer is not being upfront with me and I would be really pissed to have to make more than one monthly payment outside of the plan. Tomorrow I will call another attorney to see if I can get assistance and a full refund.
  2. Thanks for the reply. Question will I be making one monthly payment? I was told let say my plan payment amount is $1800 per month, I must still make my regular home loan payment & car loan. Is this correct?
  3. Hello All, I am really seeking help as I am in a really bad place at the moment. I bought a home in 2016, I have made every payment in 2016, 2017, and Jan & Feb or 2018. I am currently now 5 months past due and got a intent to foreclose two weeks ago and today I got a letter from lawyer saying they been retained by Company to foreclose. I fell behind due to job loss, divorce, and really high child support payments. I contacted the bank with my new paystubs and the information they requested which was sent back because, they said I forgot to sign it and i missed a paystub. The total I currently owe them is $8,190.00. I am scramblling to get 4 months payment right now to pay them in hopes that they will work out a payment plan with me so that I can get caught up. I retained a lawyer last week as well just to be on the safe side. I was thinking about filing Chapter 13 to help stop this and get back on track. I currently now earn $98,000 per year my lawyer said I passed the Means Test, and he can have my car as well included into the 13. Which currently have $6500 negative equity in it my home I purchased it for $252K in 2016. My lawyer got some current market price for it which came back at $220K. So apparently, I have no positive equity in the house. I want to keep my home which is a FHA loan, and I am now working so I will be able to make the monthly payments going forward. Question for current or previous Chapter 13 filers will I have to pay my current payment of $1,633 and all the past due of $1,633 as well if I went into a 3-5 year plan or will I be paying the current amount and a portion of the past due within the 3-5 years. I think I will resend the paperwork to them tomorrow, and see if they can take 3 or 4 months payment to stop foreclosure and allow me to workout some sort of repayment plan to get caught up. What to anyone of you out there think is the best solution or direction I should now move in? Thanks for any advice.
  4. Think you misread, the CO sent her a copy of the lease and what looks like a breakdown of how they came up with $842.00 I would think for electricity and heat in any apartment would amount to more than $842.00.
  5. I filed the complaint this morning with Maryland Utility. Should she send the CO, another letter of some sort I would hate for them to place it on her reports.
  6. Hello All, My sister who rented an apartment in Maryland. Moved in the apartment in Oct 2015, she moved out Oct 2016 with no unpaid rent. However, last month she got a call from a CO located here in MD- Fair Collections & Outsourcing,Inc- I gave her the info to DV them which she did as soon as she got the letter in the mail. They are trying to say she owe $842 for utility services from the apartment for 1 year. She got a letter from her utility provider which she has, she also have the bill from the first month she moved into the complex. The CO, sends her a package showing what they charged her for services at the apartment. My concern is that the CO ignored any of the things listed on the DV and just sent a copy of the lease which does not prove anything with regards to the utility bill. This is what she stated in the DV Letter. You letter you sent me does not provide me any of the requested information below. Please provide of I will be filing complaints with the CFPB, BBB, FTC, and my local state attorneys office. I respectfully request that your offices provide me with competent evidence that I have any legal obligation to pay you. Please provide me with the following: Agreement with your client that grants you the authority to collect on this alleged debt, in my state of MARYLAND and proof of acquisition by purchase or assignment. 1. What the money you say I owe is for. 2. Explain and show me a break down of how you calculated this amount you say I owe. 3. Provide me with any paperwork or copies of papers that show I agreed to pay this amount you say I owe with my signature. 4. Identify the original creditor's name, address and phone number. 5. Prove the Statute of Limitations has not expired on this alleged account. 6. Prove that you are licensed to collect in my state. 7. Provide me with your license number and any registered agents. 8. Provide me with a copy of the agreement between you and the original creditor that allows you to collect this debt for the original creditor. 9. Agreement that bears the signature of the alleged debtor wherein he/she agreed to pay the creditor. At this time I will also inform you that if your offices have reported invalidated information to any of the 3 major Credit Bureaus (Equifax, Experian or Transunion), this action might constitute fraud under both Federal and State Laws. Due to this fact, if any negative mark is found on any of my credit reports by your company I reserve the right to bring legal action against you for the following: Violation of the Fair Credit Reporting Act, Violation of the Fair Debt Collection Practices Act, and Defamation of Character. If your offices are able to provide the proper documentation as requested, I will require at least 30 days to investigate this information and during such time all collection activity must cease and desist. Also during this validation period, if any action is taken which could be considered detrimental to any of my credit reports, I will consult with my legal counsel for suit. This includes any listing any information to a credit reporting repository that could be inaccurate or invalidated or verifying an account as accurate when in fact there is no provided proof that it is. If your offices fail to respond to this validation request within 30 days from the date of your receipt, all references to this account must be deleted and completely removed from my credit file and a copy of such deletion request shall be sent to me immediately. I would also like to request, in writing, that your offices make no telephone contact to my home or to my place of employment. All future communications with me MUST be done in writing and sent to the address noted in this letter by USPS. How should she proceed forward?

  8. No this was for a utility bill they are trying to say she owes it was not charged off because she DV as soon as she got the call and asked them to send her the information in the mail. They sent her a copy of her lease, and a list of the charges nothing else.

  10. That's a great limit for your scores, and it should help you get other decent lines in the future. Was so surprised when it said approved 22.5k. I was thinking maybe if I'm lucky I'll get 5k. I called them immediately to have the card rushed and it should be here Wednesday. Congrats! That is a great starting limit. PF is generous when your EQ is super clean.
  11. You need to do some more reading on here I see. Almost all your cards are store cards with baby/toy limits why would you rush it when you were so close hitting 700? It would of been better for you to ask for directions before you did that so call store app spree.

  13. I am in the same process now. Offer submitted, seller accepted, file was just sent to Underwriting on Friday. Closing date is 29th, my fingers are crossed that all goes well. I will say that it is a long process and that the banks keeps asking for so much stuff is crazy. I think I have written 4 LOE thus far and other stuff. I do hope that UW, approves the loan by next week so that I can proceed forward.

  15. Update I got the disputed accounts corrected with TU, EX, and EQ. Wrote a letter of explanation for the address Provided a detailed LOE on Job history. Loan officer got back to me today and is asking for all HR contacts for jobs in 2015. Someone told me to write a letter of compensating factors. I am unaware what this is and or where to find it. Can anyone assist?
