  1. I followed whychats program. oped out, deleted addresses. Sent first letter to OC. Waited. Sent letters to CRAs. CRA just informed me that the debt is valid. Now I have a voice mail from OC (auto loan company) for them to call back. I called and the service states it's OC's recovery department. I'm in Illinois, the debt is still with OC and the loan is about 5 years old.
  2. I submitted a "jack attack" letter via snail mail to TU. I did log in online and asked them to send me my results via email. There were 5 items that needed to be fixed. 3 collections that I asked to be remvoved as they are obsolete (should fall off by July) and 2 late payments that I am fighting. TU replied yesterday with "investigation complete" email. 2 collections deleted and 2 late payments updated (not in my favor). BUT they totally ignored the third collection that was due to fall off in July. Not updated, not deleted, nothing. Since it's 31 days today and the investigation is complete- what do I do? I'm assuming they will have to delete it now, but what letter do I write? (Can I just call?) Yes, I have my proof as to when I sent it.
  3. Her DH bought overpriced tools and a kuerig (spelling) at Fingerhut. UGH. I did offer to hold her cards. She declined and told me she already shredded them. Cried on the phone for about an hour about how she learned her lesson.
  4. CA's are supposed to know the law. If they violate the FDCPA, file a lawsuit. Short and sweet. thanks.
  5. I told her NOT to get payday loan. They are both only a week late, I told her just to wait until they get paid next week and then make at least minimum payment. I like the idea of having them turn over the cards to me to hold onto, but I think I'm done offering to help. If she asks me to hold the cards I will, but I'm not going to offer.
  6. Before they got married their church had them take a couples financial planning type class for 2 weekends. Sent them home with a huge financial planning book/books on tape type thing. I don't think they ever opened it.
  7. Maybe someone reading this will think twice about helping a family/friend build credit... I've been repairing & building my credit for a few months. Still such a newbie though I've been reading & reading & reading this site (and I'll admit maybe one other...) and asking questions as I go along. Learning slowly. My younger sister and I are very close and she might be the only one who knows how Chocolate Goodness my credit is/was. (Well, except for all of you... but you don't know me, so it's fine!) After confessing to her about all my new cards, and higher credit score she asked me to help her and her husband. We pulled reports and at age 24 she has basically NO credit. She has one small loan that is paid off with 2 lates and a collection from a cell phone bill. Nothing else. She told me she hates credit cards, hates banks, hates contracts and is happy with cash only. BUT... wants to build credit since she's recently married and they are talking about a house in a few years. Her DH has two auto loans (one paid) and a card that is at 101% util with a $600 limit. No baddies, but obviously high utilization issues. His AAOA is about 1.5 years. One thing I learned was how important it is to build early to allow age to grow. I'm an advocate of a thick file nowadays. So, I offered to help her with some shopping cart tricks and explained to him about utilzation. I shared this website with them. Showed how to read a credit report. Talked about addressing the late payments and layed out a plan to tackle the collection. I talked and talked and talked to her about the IMPORTANCE of NOT using the card except for a little cheap item and then PAY IT OFF! I stressed how I messed up by being young and dumb and charging things I didn't need and couldn't afford and how 6 years later it's still hurting me and how much work it's taking to try to fix it. I told them how embarrasing it was to have my first car repo'd. How depressed I was after that happened and how horrible of a person it made me feel. Etc, etc, etc. Things I wish my mom and dad would have taught us. So, she got a fingerhut card and he got a Victorias Secret. They weren't approved or offered anything else we tried and I didn't want to risk lots of inqs for builder cards. I don't want them starting out with high fee cards like I did (Orchard bank) just to close them a few years later. They don't have the money for a secured card right now, but they both are planning on obtaining one by summer. We laid out a 3 year plan. Worked the plan on paper together. They understood the concept & reasons why. This was about 3 months ago. Today I get a call from my sister. She's maxed out her (well, his) Vsecret card and fingerhut and missed both payments this month. Wonders if I can help them get a payday loan to pay it off. UGHHHHHHHHHHHHHHH. I made her life worse. I feel guilty. I knew how she was with money and was hoping her recent marriage would have helped. I don't know him as well, but seems to be thriftier. I was wrong. She wasn't ready for plastic and needs to learn her lesson like I did. It sucks. I wanted to save her the headache. I guess the only saving grace is she's still young and when she's ready she'll have someone who can tell here where to go to LEARN IT ON HER OWN! BTW sis... if you are on this site trying to read up on your own, congrats! Keep reading. It's confusing at first. Advice I wish I would have taken... don't even look at posts that have B* in the title until you have extra money to throw around and a clean report. Don't go on a wild app spree, it's easier to stick with just a few (like 3) cards and let them grow. And stop charging things you don't need!
  8. Thanks for the breakdown! Saves me the headache... I love costco's food quality. I'm not able to apply for amex yet, but hopefully soon! It would be nice to get some cash back (even if it's for in store).
  9. Debt is 6 years old. First time it's been listed on my CR, but I've recieved plenty of calls from them. Calls stopped about 8 months ago. CA just placed collection on Credit Report about 3 weeks ago, I haven't recieved dunnings. To Whom It May Concern: This letter is being sent to you in response to your recent communications. This is not a refusal to pay, but a notice that your claim is disputed. Under the Fair Debt Collections Practices Act (FDCPA), I have the right to request validation of the debt you say I owe you. I am requesting proof that I am indeed the party you are asking to pay this debt, and there is some contractual obligation which is binding on me to pay this debt. Your legal staff will agree that compliance with this request is required under the laws of Indiana and Federal Statutes. In addition to the questionnaire below, please attach copies of: · What the money you say I owe is for; · Explain and show me how you calculated what you say I owe; · Provide me with copies of any papers that show I agreed to pay what you say I owe; · Provide a verification or copy of any judgment if applicable; · Prove the Statute of Limitations has not expired on this account; · Show me that you are licensed to collect in my state; · Provide me with your license numbers and Registered Agent. · Agreement with your client that grants you the authority to collect on this alleged debt, or proof of acquisition by purchase or assignment. · Agreement that bears the signature of the alleged debtor wherein he or she agreed to pay the creditor.   11. I will send a 623 letter to Peoples Gas, but do I send TWO seperate letters since they are Two "accounts" showing on my reports? I don't know why they are showing two accounts & two different amounts. I am and have been current on all other accounts with them. I do have old bills & correspondence with them, just stating I was late and owed them. I don't have anything showing they set up a payment plan. I do have final bill, as I had moved out of that apartment with the $1200 bill. That bill was then set up on a payment plan of about $100 a month. Not only did I pay it off (after about a year), I had actually overpaid by one month and was given a refund (I have a copy of that check). When I dispute with the CRA, what should I say?
  12. Oh- for the collections thing. When I orginally called to find out what this was about, the first rep I spoke too said that I never officially went into collections... that I was slated to go into collections but I had called them just in time to arrange a payment plan- therefore keeping me out of collections. She (first rep) said she didn't understand why I was "in collections" on my credit report, but not in her system. Next lady I spoke to was a supervisor after I bitched on BBB... and told me I had always been in collections- but just in house.

Peoples Gas (utility) was reporting a $1200 collection on my account, I believe this was incorrect as I never knowingly went into collections and I was on a payment plan (that I paid on time) with them for this high balance from 2 years ago. So I disputed it first with them by calling to find out what this was (before I knew about CB) and then disputing it with TU and Equifax. Equifax promptly removed. TU had removed it pending results from investigation. 6 months have gone by and just today TU puts TWO collections on my account from Peoples Gas. One for $1200 and then one for $600. Different open dates. Different account numbers. Different reporting dates and one says "Collection account, closed by consumer" and the other says "payment after charge off, collection account, closed by consumer". I don't know if it makes a difference but it's listed under my "other accounts" instead of collections on my TU reports when I look at it online. HELP! What do I do now? I'm super upset about this. I've been cleaning up my reports and adding new TL... my score had jumped almost 100 points in the past 5 months... this just hurt bad AND it's wrong!
  14. Not having it on her credit report would be the best option. Don't do anything before you DV.... then start researching your options.
