    AFNI Validates

    Wow... wasn't aware taht so many people were fond members of the AFNI appreciation club! Here's a copy of the letter I fired off to them today: AFNI, Inc. 404 Brock DR P.O. Box 3427 Bloomington, IL 61702-3427 06/21/2006 RE: Account # 1559473XX / Charter Communications Dear Sir/Madame: Thank you for your recent reply. This is not a refusal to pay, but a notice that your reply does not constitute the requested validation. This is a fourth request for validation made pursuant to the Fair Debt Collection Practices Act. Please complete and return the attached disclosure request form. Be advised that I am not requesting a "verification" that you have my mailing address, I am requesting a "validation;" that is, competent evidence that I have some contractual obligation to pay you. You letter of verification also lists your address as the address of the original creditor and I am unaware of any accounts I opened with your institution. Please legally validate the information within the statutory window for responses, as you last letter was received outside of the 30 day window provided by my second letter and outside of the extra 15 days requested by my third letter. If you cannot respond within the statutory timeframe or provide legal validation, then I will have no recourse but to file a complaint with the Better Business Bureau and the Federal Trade Commission. You should also be aware that sending unsubstantiated demands for payment through the United States Mail System might constitute mail fraud under federal and state law and that reporting an invalidated debt to any consumer credit reporting bureaus would also place you in violation. Your failure to satisfy this request within the requirements of the Fair Debt Collection Practices Act will be construed as your absolute waiver of any and all claims against me, and your tacit agreement to compensate me for costs and attorney fees.     AFNI Validates

    *BUMP* for the morning crew. I'm going to fire off another letter saying that they verified the debt, and I asked for validation and they aren't the same thing. Thanks for all the help so far... please keep the ideas coming... THANKS CB!!
  3. Ok, here's the history...I get a letter in January stating they are collecting on behalf of Charter and they want me to pay. I fired off a letter asking for validation. They postmarked their reply on the 30th day and proceeded to ask me to supply information such as driver's license and current phone number. I fired off another letter, stating that I wanted them to prove that they legally had a right to collect, giving them another 30 days. When day 35 rolled around, I fired a THIRD letter, reminding them and giving them 15 days to reply... that would mean that they needed to respond to me by April. Now in the middle of May, I get the following letter from AFNI: Dear Valued Customer, This is in response to your recent inquiry regarding AFNI account number 009892873-XX. We have verified with the creditor the following information: Creditor: Charter Communication Original Creditor: Charter Communication 404 Brock DR (AFNI's address I might add) Bloomington, IL 61701 Creditor Account: 1559473XX Balance: $1052.35 This letter serves as verification of the debt. Upon mailing of this letter, in accordance with 15 USC 1692g, AFNI will resume collection activites. If you have any question, please contact our office toll free at (866) 857 - 7203 Monday through Friday 8am - 5pm CST. This is an attempt to collect a debt. Any information obtained will be used for that purpose. You have the right to inspect your credit. This letter is from a debt collector. Sincerely, AFNI, Inc. OK, so they verified the debt, which I never asked them to do, I asked for validation explicitly and noted that my letter wasn't a refusal to pay. Have they legally validated the debt? Aren't they outside the response window of 30 days? What should I do now? They haven't put anything on my credit reports yet.... I'd hate to pay the bottom-feeders, especially if they're not playing by the rules... THANKS CB!!!

    PFB CITIBANK

    Has anyone here had any luck doing a PFB on a Citibank account? I had a charge-off with them... could dispute because it reports as "CHARGEOFF" every month, even after I paid them everything, including fees and whatnot. I'd like to rehab my relationship with them, and I know there's a letter written by a CB member directed towards Citi... I'm just curious if it's even worth the time or energy... THANKS CB!!

  6. I've got 2 paid CO's, one with Citi and the other with Bank 1, now Chase. Both have been paid off and, according to the AMEX credit monitoring service, the last updates were: Chase - Experian - August 2004 Citibank - Experian - November 2005 Since the initial CO is more than 2 years, and they've both gotten what they wanted plus costs, do you think that I'd be blacklisted? I really want to add a VISA to my portfolio. Have Discover, Mastercard and AMEX... If not with these two, does anyone else offer a good deal on a Visa. Looking for a TU puller in Texas... Thanks CB!!
  7. Ok, called them and what happened was I used an old work number when I got my Gold Card. This number can still reach me, but it's not my direct extension... when I opend my Knot Credit Card and my Blue Cash, I used my updated work number. The CSR politely explained that it was a question of confirming identity and that if it had been something serious, like F/R, they would have contacted me. I have to do the conferrence call in that was mentioned in the link Shawnee posted above... off to get this corrected... thanks everyone!!
  8. BradJ - Did it affect your ability to use the cards? I carry a Discover and MC for back-up, but I'd be extremely embarressed if my AMEX got declined... Shawnee - I'll probably call them, maybe I just used both accounts too soon. Bought a Dyson Animal at Best Buy and plane tickets to see my brother on the Knot Card... I wonder if they're just concerned about seemingly random, high dollar charges...

  10. I think after this, I'll just stick with preapproved LUV... I'm looking to establish a good and long relationship with AMEX and if that means no dancing, then so be it... You guys are great!!
  11. Thanks for the link Shawnee... I searched for "Amex open credit case" and got nada... should I let this slide or should I call?? P.S. : I just activated my soon-to-be-fiance's AU Knot Credit Card today, and I didn't get sent to a CSR... think that's a good sign? Hey, off topic, where's the donate button at?? Can't find it on the site anywhere...

I used my Gold Rewards Card just the other day and it went through fine, but even that one is wierd... under "Check My Spending Ability" there's a note that says: Once this account is brought current, all charges will be accepted... That scares me because I've never, never been late on a credit payment in 2 years... and I've always paid off the Gold Card every month, I've never called and asked to pay charges over time on that thing... the APR would kill me if I did...

I have 2 cards with Amex, a blue cash and a knot credit card... the other day I checked online and when I went to reallocate my credit line, not wanting to dance... just a legit move... my accounts were listed as open credit case... Is this F/R?? I haven't been contacted by AMEX by email, mail or phone... their website says to call them for assistance, but I'm scared too... I hope I'm not going to get kicked out of the AMEX family... Any ideas... I'm pretty worried about it...

    HOLY CRAP!!! I just checked AMEX's website to see if I qualifies for a CLI and got the forms... no big deal, but then I checked the dance screen and got a notice saying *******Active Credit Case********** Does this mean the dreaded F/R??? Not that I'm too worried about it... just would hate the trouble and hoops to jump throught...
  15. I asked via email after my APR went from 18.99% to 36.99% Their answer: We can't lower rate, blah blah blah and all that BS...
