  2. Revised (yet again) I am writing collection agency in regards to a derogatory trade line account number_____________ listed on my credit report. I dispute this alleged account in its entirety. However, in order to resolve this matter amicably, I am prepared to pay. I am offering to pay $342.00 (three-hundred and forty-two dollars) on the condition that collection agency , in writing, agree (1) that all listings related to the account mentioned above be removed from all three credit bureaus; Experian, Transunion and Equifax, and (2) that any lawsuit filed against me will be dismissed and no future litigation related to the account number listed above will be filed against me. To be clear, anything written in this letter shall not be construed as a new promise to pay or an admission that the alleged debt is owed, i.e. novation. I am only seeking to have this completely removed from all credit reports from the three major credit bureaus listed earlier and want to avoid the time, expense and trouble of disputing the alleged debt. This is an equally beneficial compromise since the alleged debt is quite old and has done its damage to my credit report. If collection agency and I cannot reach an agreement based on these terms and these terms alone, I am more than willing to have this fall off of my credit report. If you agree to the above terms, please prepare a letter on your company letterhead explicitly agreeing to the same terms as the above settlement offer and have it signed by an authorized representative of collection agency it will be implied that this letter shall constitute a legally binding contract, enforceable under the laws of Massachusetts. Your response must be postmarked no later than 15 days from your receipt of this settlement offer or this offer will be withdrawn and I will request full validation of this alleged debt, as provided for by the Fair Debt Collection Practices Act. Upon receipt of the signed agreement from you, I will send you the money order in the amount I have proposed.
  3. Yeah I assumed the same thing, again, this revision was based on lawyers "off the record" comments. When I have time, I'll change the wording and pick up on some of the other errors
  4. This letter seems to have quite a few problems with spelling and grammar, inappropriate capitalization, style, etc. in almost every sentence. For instance, in the second sentence, you are really saying "I still contest the fact that my research lead (sic) me to believe that...". I don't know if this works in your favor, or against you. I'm not sure where you're seeing the spelling errors or grammatical errors but I have fixed the inappropriate capitalization. I've gone ahead and re-written the letter and will update OP accordingly. I've also spoken to a lawyer to get their "off the record" advice regarding the letter and they've commented on it which is what the revised letter will reflect. Like stated above, requesting a validation (as well as looking to resolve) does not reset the SOL, so I should be ok in that regard.   5. I probably should have provided some context. So here's the situation. I'm in the process of "cleaning" up my credit report and this is one of the baddies. Its been about 5 years so this is set to fall off soon. The collection agency hasn't communicated since this debt was incurred. To avoid resetting SOL, I've written this letter in order to pay it off in full and have it completely deleted as if it never existed. I run the risk of resetting the SOL thus losing any leverage I may have to get a pay for delete, so I'm trying to avoid acknowledging the debt is "mine" and rather than letting it fall off I want to pay if off and have it go away. the debt was from an ex of mines cell phone bill in which i co signed since she was under 18 at the time.

Hi all, I've just recently paid off one my collection accounts and when I spoke to them last, the send to call back in 3-5 business days to have a release of debt sent out to me so that I could forward it to the Credit Bureaus. 1) How effective are the release of debt letters ? 2) Would it really matter if I forwarded the letter to the CB's 3) Should I be sending this to the original creditor as well? 4) if so, should I be sending a GW letter so that they may or may delete the negative TL any info on what to do would help, thanks in advance!

  11. So I agreed to resolve one of my negative tradelines and had done this before learning about PFD. I'm close to paying this off and I realize I haven't given them (the CA) an incentive to delete the negative tradeline since I called them myself and agreed to pay them. Now that I am close paying the whole amount what should I, or can I, do to try to get my tradeline deleted.   12. So I'm beginning to realize this may or may not have been a mistake based on what being said in the MANY different topics on here. So here's my story, I have a few outstanding debts (two credit cards one in the 1200's the other just 400) who have gone to Collections Agencies, I've tracked down who "bought" my debt and I'm trying to pay what I owe in full. I've been told that settling doesn't look good and stays negative. Even if I pay in full, is that account considered a negative account? I just found about Pay to delete and may write a letter for a P2D to the CA who owns the 1200 debt. Is there anything I can do about the rest of my debt that I've already agreed to pay? Can I still request a P2D? whats my best option to improve my FICO score and show that I'm responsible (now)?
  13. I actually have the same question and seeing the answer above this post, that will be my exact first step. My situation is that I had student loans that went into default and I went through the rehab program. Once that was done, the rep said the would follow up with me to continue the payments. That was two years ago, and now my score is in the low 500's. I've since contacted older lingering debts (called CA's, which I'm finding out isn't the right thing to do?) and I'm in the process of paying off the smaller debts in full (by small I mean in the 300's or 700's). My question, which is most likely answered in PsychDoc's document, is is doing this snowball effect with paying the highest interest acct down first then trying to get a secured CC a good way to build up my cred to what it was two years ago (700)? I want to show that I'm responsible (at least now) and that I'm working to be better financially but there are so many hurdles along the way and because I don't know what the best approach is, I'm been recommended to this board. tl;dr HALP!
