  2. I apologize in advance but I need clarity. I feel like I read the same statements over and over, searched threads over and over and I want to make sure I have this right because this always confuses me. I've accomplished a lot since joining this site, but this is one thing I can't understand. Maybe I'm simply making this harder than what it really is. I'm trying to figure out when my Capital One CO will fall off my credit report. Date Opened: 03/2007 Charge off as of Jan 2008 150 days past due as of Dec 2007 120 days past due as of Nov 2007 90 days past due as of Oct 2007 60 days past due as of Sep 2007 30 days past due as of Aug 2007 So, if the clock starts ticking 180 days after DofFD then it started Jan 2008, is this correct? Another thing that confuses me is do I add 7.5 years as stated in the FCRA or do I go by the Statute of Limitations for the state of GA (which is different)? Thank for your help guys...try not to chew me out too bad
  3. I understand that in Georgia it's not very clear whether the SOL is 4 years or 6 years and after reading a few topics on CB apparently most judges rule in favor of 6 years. I have two OC's on my report, BofA and CAP1. The date of last activity for BofA was 08/08 and for CAP1 it's 03/08 and neither creditors are taking me to court. Since I have no judge involved can I just dispute to have them removed after the 4 yrs is up?

  5. My credit application for an Express CC was denied (at least the letter gave me my credit score at the bottom - would that be my fico?). I would like to at least TRY for a recon because who knows...it may be successful or they'll just say no a second time. They pulled my EQ which is the only one that currently reports a closed charge off from CAP1 & nothing else. Here's the reasons for denial: - Unable to verify credit history I do the credit underwriting for an apartment complex. When we say "unable to verify" it's because they have 3 or less TL's is this the case here? - Limited credit experience Sounds like unable to verify to me, but only because at work we consider that 3 or less TL's. Maybe i'm wrong??? - Delinquent past or present credit obligations with others I can definitely assume they're talking about CAP1 because they're the only ones reporting to EQ right now. I want to make sure i'm understanding their reasons correctly. This is the address they provided for "any questions or assistance" - in case anyone is in need of an address.   7. My grandmother has an auto loan through bank of america, we applied for refinancing so that I could be included on the loan because I have been making her payments on time for a year. Of course they pulled EX and denied me but a representative requested that an underwriter gives me a call to look further into the file. I received a call today and spoke with a foreign woman who politely told that they will not add me because i do not qualify (obviously, which is why i'm asking for a recon) and that there was nothing she could do. It was due to 2 reported chargeoffs from 2007 and no satisfactory accounts regardless of the fact that I've been paying every penny on time or earlier than expected. I don't want to take over the loan I just want to be added so that they can report since after all I am paying the damn thing. Does anyone have any suggestions or contact information for a dept that could help. She also mentioned that some institutions have refinancing programs for people with "bad credit" but couldn't refer me to one....any ideas who?

    call Denise back. Tell her(as many times as needed), you can't provide me with proof of April cancellation because I cancelled earlier than that. This is not my account, send me the fraud package." You get her fax number, and send her a copy of the police report for ID theft and you fill out the fraud package. if she gives you crap, tell her in no uncertain terms that you want to speak to her supervisor. Repeat(as many times as necessary) "if you can't help me, get me someone who can." Do not take no for an answer, and do not engage her. Just repeat, I need your supervisor. This seems like an easy resolution here. Sometimes you just need to let people know you aren't taking their crap. Thanks for the encouragement. I guess everyone agrees that I should file a police report.

    It is my bill and it isn't my bill lol. I had service at that address but the service continued after I cancelled. I really did cancel but I have no proof other than the fact that I moved out. AT&T is saying they don't care if I moved out, i'm still responsible. The verification that I received from the apts stating that they have "no records" is because I lived there so long ago they shredded it (their leasing agent told me this yesterday when I visited). I found my original lease agreement yesterday, however it shows my ORIGINAL lease terms - because i wasn't supposed to move out until June 2009 but i broke the lease. I'm afraid that If I file with the PD with my lease agreement to back it up then I look guilty because of the dates, but if I file a report and back it up with the faxed verification then I feel like i'm lying because I know, and AT&T knows that I lived there and my driver's lisc. still has that address on it too.

    if it's off your report why do you care? just send them a cease and detest letter.... I didn't think about it at the time, but I don't think it "disappeared off my reports" - i disputed it so I assume thats the reason why I don't see it reported anymore (???)

    So, after my vacation AT&T finally contacted me in regards to my complaint with the BBB. After our discussion, they decided to send me a "fraud packet" in the mail for me to complete and send back. Well, before I even received the packet Denise from their collections dept. called me as well stating that they came to the conclusion that I am financially responsible for this account because their records show that I didn't call until April of 2009 to cancel (may I remind you i moved out October 2008). I KNOW I didn't call 6 months after I moved out to cancel the service and requested a copy of this "record" but she can't provide me with it. I asked her who the heck was paying the bill from November 08 - April 09? She said no one, so I told her I definitely didn't call in April, are you sure it wasn't disrupted due to no payment? Or maybe the next resident after me called set up their service and it created conflict. I work at an apartment complex partnered with comcast, sometimes if a resident was evicted or skipped their comcast service remains which creates a problem for the next resident and we have to call from the office to cancel the prior residents service - how am I supposed to know that this isnt the case??? Regardless, I know I called in October to cancel and i'm furious. I've been tearing my house up looking for ANYTHING that can help. If i have nothing to provide to prove that I cancelled how can I get the CA off my credit report? I'm so frustrated.

    Have you filed a police report for Identity theft? My thought is if you send them proof you did not live in the apartment at that time, and the bill can't be yours, this should be farily easy to get rid of. Send this info to Ginny Walker the Compliance Officer for ERC. She is at the Bayberry Rd, Jacksonville address. Thanks for the info! I tried calling AT&T today which was awful, it's seems like no one knew what to do so they would transfer me instead. I was transferred around 7 times with no answer. I guess a copy of the lease at my current address will do?? I've been here 3 years. I think a police report for ID theft would be better. Just because you had a lease at that time, doesn't necessarily show the CA you had no responsibilities at the old apartment. It seems Someone there had to have started service in your name for that apartment number. ETA: Did you have any roommates that remained in the apartment or anything like that? Also, when dealing with AT&T, if they can't answer or find the info, I would repeat, over and over, if you don't have the information, you need to get this CA off my report. I've had success with 3 OC's this way. Give them no info, and, if they have no info tell them to get anything associated with this account off your reports. That's a good point. I work at an apartment complex and faxed a request of rental verification over to our old community last week. I finally received their response today via fax - for whatever reason they have no record of me, my boyfriend or our roommate ever living there (strange). Also, to answer your other question, no one remained in the apartment, we all moved out at the same time...we broke our lease agreement. I'm wondering if AT&T never really disconnected the service....I had that same issue with them last month for a service at my current home which they resolved quickly. Also, after getting no where with AT&T I filed a complaint with the BBB - hopefully one of their superiors will contact me. Do you still think a police report is the best idea? If so, will that affect my credit report in any way?
