  1. Ok. Thanks!! I am calling them this morning. Would I need to get it in writing that that they will accept the offer and set aside the judgement before making the payment? Definitely. If they won't put it in writing, don't do it. +10,000. Ok. So I was told there is no settlement offer at this time for me. I have to pay in full. I was also told that this writ of fieri facis was because of my two missed payments and the fact that I went from paying $100/month to $50/month. I was told that if I didn't continue to make payments as consented in the consent judgment agreement, there would be further collection activity. I'm still confused about this and will call back later and speak with someone else. I also set up to have the payments taken monthly from a pre paid debit card...they are sending me the paperwork on this.

  3. Right. I've been through garnishment before...it was horrible and I was working crazy overtime for 3 months to make my normal pay. That's why I would just rather pay it off.
  4. Just received today from McCullough Payne & Haan, LLC. Yes, I entered into a consent judgment and was paying $100/month towards the $2689.23 owed from car repossession and sale from 2012. I couldn't afford the $100/month after the September and October payments, so they let me do $50/month and I started this in December and made another payment in February. So, yes, I missed my November and January payment... Certificate of Service Letter is dated December 23, 2014... I have the money to pay what's left...$2,004.94 principal, $153.80 interest, $225.49 attorneys fees and $5.00 costs...Should I just pay it? This is in Georgia...

    The fee has kept rising. Started at $4.95. Then it went to $6.95 (where it is now)...Yes and they explained why, people are screwing them! When your on Chex and or any other reports and can't just go any place to open a checking account you can't be picky about fee's. Your lucky to be able to find a place that will open a account for you. Ok

    I picked up the paperwork from Magistrate Court because I received a notice in the mail they had some paperwork for me. I will post this in the HIBS forum as well.

    No So they've shown you no proof that the "debt" is both valid and yours? Correct. All that came with the suit was this "statement" dated December 6, 2012 to December 6, 2012 showing a previous balance of $589.52. And you're just going to pay it, no questions asked? No. I am going to go ahead and file my answer, go to court and ask for proof. The statement doesn't "show" anything (payments, interest, principle, fees, etc). They need to prove it's my debt...I know that much.

  12. In January 8th, I went to my Magistrate Court (Georgia) due to a notice I received in the mail. Emmett L. Goodman, Jr. is the law office representing LVNV and is suing me for $589.52 plus $98.00 cost to date. Since I have 30 days to answer, I planned on answering and telling them (per advice of an attorney) that I deny all claims and that I never made a contract with LVNV; my contract was with Credit One Bank. Today, I get a settlement offer from this law firm with two options: PLAN A: 45%off your balance with one payment of $475.85 PLAN B: 35%off your balance in two payments each of $280.60. These options are only available until April 20th (capitalizing on tax season). Any advice? ~~~~~~~~ETA: Settlement offer letter shows current balance as $863.37

    Maybe...letter was dated 12/22. However, I don't reside in any of those states and therefore never submitted a claim.

    No. This was in regards to a Fingerhut account I had back in the day. Account went from me owing $150 to $250 (with MCM).
