    USDA help

    My husband and I are in the middle of buying a new home and I am having a problem with USDA and my bankruptcy and short sale of my home. We filed for bankruptcy back in 09 and it was discharged in 6/09. Our mortgages were included in the bankruptcy but we stayed in our home and continued to pay on those mortgages. Back in 2011 my husband was fired from his job and under those circumstances with pay loss and etc. we ended up putting our house up for sale. The house sold in a short sale in December of 2013. USDA is now having a hard time understanding all of this. We have had to write a letter explaining why we filed for bk and about selling our home. They keep asking questions about why the house was short saled and whether or not we were up to date with the payment when the house sold. The reason USDA is giving us a hard time because on our credit report it is stated that the "account was paid in full for less than the full balance." The also reported this on 1/14. Now if I am correct they can not do this? I need some kind of advice about what I should do concerning USDA and the underwriters and should I also have my credit report fixed because they are reporting incorrectly. Any help would be greatly appreciated. Thanks
  2. We had a bk discharged in 6/09 and now my husband has lost his job as of 12/11. We haven't paid our mortgage since January and we are not sure what to do. We have been looking to relocate to another area in the state of Mass but we are having a hard time finding a place. We fill out the applications and we seem never to get picked. I have been told by some landlords that it is because we dont have enough money, or no job because he is on unemployment but has a job offer in the area we want to move to. So when I tell landlords that we have no rental references because we have own our own home for 18yrs. My husband is reluctant to put the house up for sale because he is afraid that we wont find a place to live. But they are going to start foreclosure soon and we dont have time to sit and wait and see what happens. How do I try to convince a landlord to rent to us? I have always wanted to do things the right way sell the house with a short sale and just move on but he is being uncooperative about the whole thing. The house is in his name only but we both did the bk. I could really use your help in this matter. What do I do about renting a place? The rental market has been really tight. We have been looking for 5 months and getting no where. Please help!!!!
  3. They said they had some programs to offer us so my husband got on the phone and gave them our financials. We find out that we don't qualify for anything because he is unemployed. And I asked them if they had anything and they said no. So I added my income (which I didn't have to because I am not on the mortgage) and then we qualified. First it was the forebarence (sorry about spelling) and it ended up that the payment was going to be $600-700 more than what I am paying now because I have to make up what I am behind on. Then I asked what about the unemployment program and they said that my husband didn't qualify because he's unemployed. I asked him that you have an unemployment program but he doesn't qualify because he's unemployed and he said yes. That still makes no sense to me. So i guess it's not matter what we do we still won't be able to buy another home for 3yrs. Is that what you are saying???? Now I kinda feel that we have wasted our time and money on our house because I thought we were doing to right thing but now I am going to have to wait 3yrs to buy again. I should have just let the house go back then. This is very disappointing. And I am having trouble finding a rental because we want to relocate and they want to know what your situation is and I try to tell them the truth but it just doesn't seem to work out.
  4. I had a bk discharged in 6/09. My husband recently lost his job and we are having trouble paying the mortgage. The mortgage was included in the bk and we did not reaffirm. I have asked for help from citimortage and they said that they have nothing for us. We already did a loan modification about a year ago. We want to relocate to another part of the state but we don't know what we should do with our house. I want to short sale it because I don't want it to go into foreclosure. But we are behind about 3 months now and my bk lawyer told me that if it goes into foreclosure it will not show up on our credit report because it was already included in a bk. We want to buy something that we can afford but we are not sure what to do. We live in Massachusetts. Thanks
  5. So your even saying that if I even short sale and I am late on payments then it would be difficult for me to get a FHA loan? I talked to citimortgage this morning and they have some assistant programs that we may be able to qualify for right now with our current mortgage. But I will probably end up being 30 days over because I haven't gotten any unemploymnet yet (its been about 4-5wks) and my wife was given a mutual fund that her father had started for her when she was born but now there is a problem with the bk because it could be considered that she was hiding an asset but she never knew about it. So right now its just a waiting game with everything. I was wondering what would lenders do about being late on mortgage payment but it was due to a job loss. We have been paying the mortgage on time since the bk and the modifacation. But my problem right now is that we had a second mortgage and it was bought by the first tennessee bank and they ended up charging it off or something and they said that they could foreclose anytime they want and they also put a lien on the house. But now I have checked my credit report and they have reported that the loan has a zero balance and that we were never late. But I don't see any liens on the report or anything. What could this mean?? Citimortgage also told me today that they had taken my mortgage out of the bk dept and put back into regular accts. I didn't know that they do this I always thought it stayed with the BK dept.
  6. We live in Massachusetts and my lawyer told me that we could let the mortgage go and not owe anything but will it really stop me from getting a mortgage?
  7. Thanks for your help I think I will contact my mortgage company and see what they can do for me. I know that I have an obligation to my mortgage and I have all intentions to pay but losing my job right now sure isn't helping the situation.
  8. I recently lost my job and we are unable to pay our mortgage right now. We just owe this month but we having been thinking about moving to a different part of the state and starting a new life. The job loss kinda just moved up up our plans. We live in MA and had a BK discharged in 6/09. We didn't reaffirm the mortgage. I know that I would need a job in order to purcahse a home but we wonder where we stand right now with being able to get a mortgage for a new home. We got our credit reports and scores and my scores run in the 620-650 and my wifes are a little better about 630-660. What type of options do we have??
  9. So maybe it would be better if we just sold our home maybe in a short sale or something. I don't think that there is any equity in the home. Never thought about our payments showing up as being paid on time. So now what do we do. I am unemployed and have a good job prospect right now just waiting to here from them I talked to my lawyer and he said that we should be able to get a FHA loan and that the foreclosure shouldn't show up on credit report but you are telling me something different. Now I dont know who to believe. He even told me a story of someone who was going through foreclosure with a BK he was saving his money for a new home and applied for a FHA loan and was approved while he was going through foreclosure.
  10. I am pretty sure what my BK lawyer told me is that the foreclosure will not show up on a credit report because the mortgage was included in the BK. We also had a second mortgage and while waiting for the first to go through modifaction the bank sold the loan to another and within a few weeks they charged off the loan. We have not paid that in the last year and a half. And on my credit report it show that the loan was included in BK with 0 for a balance and that we were never late. So I don't think that regualr foreclosure policies work in my case because of the BK

  12. My wife and I filed for bk back in 2009 and its was discharged 6/09. I was terminated from my job after 21yrs. I have applied for unemployment and still no checks. My wife works part time but her checks will not pay the mortgage. We included the mortgage in bk and we also had a second. The second was sold when we were doing a loan mod on the first. The bank that bought the mortgage ended up charging it off but told us that they can foreclose at anytime. We didn't reaffirm the mortgages and we live in MA. We have been paying the mortgage on time but haven't been able to pay this month. We have been planning on moving and buying another home. Now with our circumstances we just may be doing it a little earlier than we thought. My question is how long will it take to foreclose? Should we just short sale the home? And the foreclosure shouldn't show up on my credit report right? Not really sure what we should do right now. Everything just seems up in the air. If anyone has any suggestions please let us know.
