	I am currently in a army reserve and at 80% VA rating My credit score is very in the 500s I am considering filling bankruptcy because I am going through financial hardship will this impact my VA benefits in the future if I want to buy a house ? Or my military service since I am still in the reserves? I just recovers from bone cancer so job wise is very slow but I am hoping to get a job soon . Any advice will be helpful

	Filed divorce in 2016, final 1/18.  Ex ran up as much as she could during the separation and contested everything along the way to prolong the proceedings.  14 days after the final decree, my CH 13 was filed.

	I did NOT reaffirm the house she was still living in and she refused to refinance in her name (or assume the VA loan, as she was a vet herself) and it went to Foreclosure.  It was <abbr title="Included In Bankruptcy">IIB</abbr>, as it was not reaffirmed, and was sold in late 2018, fixed up, then resold in 2019.  The initial loan was an IRRRL refi in 2/16.

	Requested a <abbr title="credit line increase">CLI</abbr> for my <abbr title="Navy Federal Credit Union">NFCU</abbr> cashrewards on the website, it went to get reviewed and was denied the next day. I currently have $5000 <abbr title="Credit Limit">CL</abbr> and have about $600 of a balance on it and I requested a <abbr title="credit line increase">CLI</abbr>.
</p>

	I was under the impression that you could request a <abbr title="credit line increase">CLI</abbr> every 91ish days and that was the waiting period. But then looking again through forums after being denied I saw that it might be 180 days instead.
</p>

	I was automatically CLId from 3500 to 5000 about 5 statements/billing cycles ago.
</p>

	Im currently waiting on the letter in the mail.

	If its the 180 day waiting period that caused me to get denied should I wait until the next billing cycle/the one after that to apply again? Or 180 days after I got denied?

	Also kind of irrelevant but not sure if it changed but some people said that they were able to ask how much they wanted to be increased by but I had to just put my current income  and they would decide the increase. Not sure if that means anything<span class="ipsEmoji">🤷‍♂️</span>

	Filed bankruptcy and its been discharged for 3 years. <abbr title="Navy Federal Credit Union">NFCU</abbr> was one of the creditors and I discharged $525.  Last month I paid that balance in hopes of reestablishing a healthy credit relationship with them. I have &gt;100k in various accounts. (Sold a house).  I've applied for a credit card via pre-approval and was only offered a secured card.

They informed me there is nothing they can do, and that I must contact Transworld Systems, Inc. When I contacted them I had to pay over $2000.00 just to get the payments within my budget. In December of 2014, I received a wage garnishment letter from Transworld. When I called, again they told me I must pay $2000.00 in order to stop the wage garnishment.<br />I sent a letter requesting the validation of the debt, I know I did not charge over $3000 on the card, the limit was not that high! In Texas, 3rd party debt collectors are required to file a bond with the Secretary of State, this is a free charge. I could not find them in the system, so I also requested that info. Here's what happened:<br />They filed the bond the day after they received my certified letter.<br />I received a letter back with the following break-down:<br />Principal: $1, 317.77<br />Interest: $672.08<br />Collection Charge: $528.95<br />Total Balance: $2, 518.80<br />The original letter I received in December states that I owed: $3, 329.32<br />What does this mean:<br />1. There is no explanation of why the debt went from $3, 329.32 to $2, 518.80. ($809.52 difference)<br />2. 15 USC 1692f 808(1), 31 USC 3711g (6), and Texas Finance Code Ch 392 Sec. 303 all state that they cannot legally charge the $528.95 collection charge.<br />3. Now with the balance of $1, 3717.77+672.08(interest)=$1, 989.85, less than what they wanted lump sum to start a payment arrangement.<br /><br />So... they attempted to collect a total of $1, 338.47 illegally from us. If they attempted to do this to us, how many other veterans were taken advantage of? If they did this to 10, 000 veterans, that is $13, 384, 700 they illegally profited off of.<br /><br />I am reaching out to other vets that have been contacted by this company. I want to put together an investigation in regards to ending this contract and getting you your money back!!! 	A relative who is active military just received a 2 page letter from an attorney claiming to represent a debt collector. The first page gives the standard spiel that federal law gives the debtor 30 days to dispute the validity of the presumed debt. The second page says the attorney doesn't have to wait until the end of the 30 days to file suit and he's filing suit in 14 days (7 days from this post).  Relative is in ND.

	If it was me I'd let the attorney file suit and waste his money, but because the relative is military I'm thinking that's not the best way to handle it.  FTR, the debt is not owed and there is paperwork to prove it.

	I realize that this post is old, but I’m currently experiencing a similar issue. I got out of the Navy in 2012. Yet, in 2021 milstar is stating that I owe over 8 grand, and that my debt is still accruing from interest. I recently submitted the paperwork to receive a missing portion of my economic impact payment which was for my children. They garnished my entire return, so I called them. I stated that this debt was 9 years old. In response, the collector I was speaking with stated that the age of my debt didn’t matter as government debts do not expire and have no statute of limitations. I am at a loss and do not know how to proceed. Any help would be appreciated.

<p>My husband I introduced to <abbr title="United Services Automobile Association (this is not a Credit Union)">USAA</abbr> but would have qualified on his own for 4 years in the Marine Corps.</p>

<p>From what I understand, he doesn't qualify for <abbr title="Navy Federal Credit Union">NFCU</abbr> but I do.</p>
<p> </p>
<p>So...should I jump through hoops for this credit union or do you think there is nothing significant gained over <abbr title="United Services Automobile Association (this is not a Credit Union)">USAA</abbr>??</p>

<p>SERVICE MEMBERS BEWARE!!</p>
<p>My husband got a letter from Orion Recovery several months ago, while I was deployed. He responded to it, by phone message (noone answered),  that I was out of the country, and we would investigate the matter on my retutn. He got another letters, threatening our credit, so he sent an email to their "feedback@orionrecovery.com" address. He got a 3rd letter, which he did not open, but wrote "deployed" on it, and put it in another envelope with a little note stating the same. He sent this certified, and it was signed for. We saw that this was on our credit report. He called in to the Orion office, and was told that an account manager would call him back. No call back happened. I got back in May 2015, and we figured we would get it straightened out simply. I called Orion Revovery, and reached a guy named "C" w/a Southern accent. I explained to him that they had acted illegally by adding something to my credit, while I was deployed. He said that I should have let them know. I explained to him about the history with the letters, to which he responded "Do you want to worry about then, or focus on now?" I thought that to be quite rude, so I asked for a manager. I was put on hold, and it was answered by a woman "R" that identified herself as manager. I told her what was going on, and that I thought that her collector was not professional, and she put me on hold. When she came back on, there was a ton of background noise. People talking and laughing, kids (sounding) carrying on. I told her that I was having a hard time hear her. She put me on hold again. After a few minutes, she came back, and it was relatively quiet. We spoke briefly about the debt, and she advised me that since it was on my credit, my only choice was to pay or leave it on my credit. I said no, I have the right to dispute it. She said that it was past that point, and asked me for a credit card #. I said "you have to be kidding me", to which she responded that I was "kidding myself", and we disconnected. We live in Colorado, so we decided to get our paperwork together, and go to their office in Canon City, Colorado. We pulled up to the addressame our GPS took us to. It was a campground called Prospectors RV Resort. We thought it a mistake, so we drove a bit more, but then ended up back at this campground. We pulled in, parked, and went in to the office. When we walked in, we saw that it was a little general store and liquor store, with a registration desk. I went to the desk, where an improperly dressed brunette that had been outside smoking asked us if we were checking in. I said "Actually, we are a little lost. Do you know where we can find this address?" She informed me that I was at the right address. I explained to her that I was looking for "R". She said "yeah, that's my boss, but she's not here, but should be back soon. Do you want to speak to "M", her husband. I said "No, I will just look around a little." I got the brochure, and looked around the store a little. We walked out to our car, and got online to look some things up. We watched people come and go. I saw the girl come out to smoke and drink a beer with some guys at the picnic table. I saw people smoking what looked to be pot around the corner. I figured there must be an office here somewhere. We went down to a separate looking house along the highway. It was empty, minus a cat on the porch aND some bags of garbage. We went back to the office, where I went to the registration desk again. I asked if "R" was back, and was told no, not yet. I asked her if she was familiac with a company called Orion Recovery. She said "oh, yeah. That's "R"'s other business." I said "oh, good. Where do I find it?" She said "in there" &amp; waived st an office off the liquor store, where a young girl was surfing the Internet. I said "well, can I speak to someone?" She said that there might be someone upstairs, and got up and started heading to the back of this office. At what looked like a laundry room, she saw we were following her, and told us to wait. After a minute, she came back, and said everyone must be gone, and went back to her desk. I asked her what normal hours for the "office" were. She said it was hard to tell. I said "can you find out when "r" will be back? We drove quite a long way." She got on the phone, and I heard her talking to someone. She asked me if I was a lawyer, or had a business card. I said "no, I'm a client." She hung up the phone, and told me to call back Monday. </p>
<p>What the heck! We left. Thankfully, my hubby took several pics of the place. I emailed disputes in to the crefit bureaus, and filed complaints with the <abbr title="Better Business Bureau">BBB</abbr>, the Attorney Generals office, the Military Consumer website, Telekom, and to Orion Recovery. This place has a license, but it's pretty sketchy. I don't feel very safe having my personal information accessible to a campground, liquor store, and children. Something should be done about this place. Oh, and by the way, I got an email back from Orion stating that my debt had been canceled in their system and that there would be no further contact. I sent that to the credit bureaus, and I'm hoping they get it cleared up soon. </p>

	I've been googling myself into cross-eyed-ness, and I can't find a straight answer...what exactly are the credit requirements for a VA mortgage loan, specifically a cash out refinance? What are the minimum credit scores, <abbr title="Debt To Income">DTI</abbr>'s considered? Anything else? We live in our house, this is our primary/only residence. Does each lender have a different guidelines, or are there specific ones that all lenders that do a VA loan comply with?

	My husband and I are in a pickle. Trying to get a cash out refi with bad credit (<abbr title="Bankruptcy">BK</abbr> in 2016) and we modified our mortgage but they are showing late payments over the past year. I demonstrated we made each and every payment during 2018 and so far in 2019, they are saying those payments were for a couple months late in 2017. It's a mess.  So...I've redone my student loans. They're timely and good. The mortgage has been modified as of 5/1/19 and is good and "current".  Due to the <abbr title="Bankruptcy">BK</abbr>, the mortgage is not reporting on our credit scores. I wish it was, if we could refinance into a new loan, it would be reported. All our bills are on time, but we do have a LOT of bills, both debt and medical and just living expenses. We thought a cash out refi would provide us the ability to pay off those bills and live comfortably without debt. We have about $200K equity in our house, and only wanted about $80K. We have secured income. Thank you for your help!

	So, I have two 30-day late payments on my Capital One Credit Cards (one on each card) from Nov 2017.

	Before I left on military orders on September of 2017 for training, I called them and told them I was being deployed and wanted to try and pay the annual fee a few months in advance, so I wouldn’t have any late payments since I wouldn’t have any contact with the outside world for literally 9 whole months. They said they don’t charge military members the annual fee, and they would waive it for me.

	After getting back on May of 2018, I pulled my credit report and saw I had 1 missed payment reported on each card. And I’m still confused to this day why. I thought it was probably just a mistake, and I was accidentally charged the annual fees. So I called them, and they said it was from some pending charges as well. I remember leaving with no balance though, and some of the charges don’t seem too familiar to me. Especially one place that I don’t think I’ve ever even been too. My memory is a little foggy though, since it was last year. Even to this day, and being with Capital One for years, I’ve never missed a payment. That is the only time to this day that’s happened.

	After calling several times, they said I could mail in a credit dispute with the description of the situation and how I’d like it resolved. I was going to mail in this letter (down below) along with my military orders, and the credit reports of the dates the late payments were reported. I’m hoping to be able to get this removed, as it’s affecting me of getting a better interest rate on a loan I’ve been shopping for.

	About 6 months ago I started getting letters from AAFES stating that I owe them about $4000 and that I need to contact a collections agency called Transworld. This is from when I cosigned with someone for a credit account with AAFES, this was in 2008. Is there an <abbr title="Statute of Limitations">SOL</abbr> for this kind of debt? I've read a lot of contradictory stuff, some say it;s 7 years, so say it's 10, some say there is no <abbr title="Statute of Limitations">SOL</abbr>, can someone give me a definitive answer?

Then of course there's gov which the anewest BTW to the disabled veteran is yes it can be discharged based on disability alone and should be more military benefits too. OK now I will give you names of some people who can and will definitely help. First is Holly Petraeus (yes his wife) she runs Consumer Finance Protection Bureau Military Programs. Next is Michael Pasquale atty he helps with vet benefits pro bono. Specializes in those been denied disability or other benefits and also helps get pension and family health care. David Block provides free financial planning and he has charito called Homes for Our Troops which build homes free for injured vets. Also has Financial Independence Training- a non profit. Caroline Ciraolo- tax litigation pro bono. started first US tax court program and also is working in <abbr title="Flyer Talk">ft</abbr> Meade to help with taxes. Is now US Justice Dept Acting Asst Atty General in charge of tax division. Other one I know of is similar to another I listed but his name is ding-a-ling Power ret. Army Colonel provides free financial advice and also has program called Homes for our Troops which provides free housing for injured vets. <p>My husband got hurt in 2010 and was ETS out of the Army (long story but his unit screwed him out of a medical discharge because it was quicker to ETS as he was stop lossed when he got hurt). When he ETS we had a balance on the Star Card at about $9,000. We planned on paying it back when he get his retro pay from his disability claim. </p>
<p> </p>
<p>When the retro pay came Dfas took nearly all his retro pay to pay back his separation pay they gave us when he got out so we couldn't pay the Star Card. </p>
<p> </p>
<p>Last year our tax refund was garnished and the whole amount went to the Star Card debt ($6,987).  We are finally in a place financially where we can start taking care of all this debt so I called the debt collection office for AAFES and they said they sent it to NCO. I called NCO and they said they sent it to another company (DECA?). I called DECA and this is where everything gets interesting. They have been sending notices to a PO BOX I had like 5 years ago that was NEVER associated with this account. In fact the name on this PO Box was only me with my previous married name before my husband and I were married. I asked why they sent notices to that address and they said that is the information that came with this debt. I wasn't going to argue because I know that is pointless. I asked for their mailing addy so I can debt validate as well. </p>
<p> </p>
<p>I then asked for the amount to pay off the debt - he said $8632. Umm.... WHAT???? I said that can't be right because we paid nearly $7,000 on this account and $4,000 in interest and fees is a little much. He started stumbling his words and was confused and not sure what to say after that. </p>
<p> </p>
<p>I am PISSED. We want to get our debt taken care of but we don't want to $4,000 in interest either. </p>
<p> </p>
<p>I have seen other posts talk about asking AAFES to recall the debt but how can they do that if the debt was sold again?</p>

Nor does this payment prevent NF from engaging in lawful collection activities as to any debts that you may owe the credit union.  This may include NF exercise of its statutory lien athority or securty interest in member funds to satisfy outsanding debts to the credit union."</em></p>

<p>The account in question was opened from 2008 to 2012.  First reported delinquent in 9/2012 and settled for less than full amount in 3/2013.  Shows on my credit report as a charge off and settled for less than full amount.</p>

<p>Should I cash this check?  <abbr title="Statute of Limitations">SOL</abbr> has passed on when they could collect (3 years).  Or is cashing it re-opening that window?</p>

<p>I commissioned as a 2LT in the USMC this past February and was looking into taking advantage of the <abbr title="United Services Automobile Association (this is not a Credit Union)">USAA</abbr> Career starter loan as I've just found some solid employment as I await my reporting date to TBS.</p>
<p> </p>
<p>Well, not thinking anything of it I went to <abbr title="United Services Automobile Association (this is not a Credit Union)">USAA</abbr> and applied and denied for the following reasons:</p>
<p> </p>
<div><ul><li>Serious delinquency</li>
<li>Time since delinquency is too recent or unknown</li>
<li>Length of time accounts have been established</li>
</ul></div>
<p> </p>
<p>I was completed caught off guard as I've only ever had two credit cards and student loans. One is a Capitol one that is current and the other Macys that has no balance. Seeing this I just pulled my credit score for the first time ever and found my score to be a whopping 574 because of a Bank of America credit card charge off from 2009 to 2011 for the amount of $33. Yes, a thirty three dollar charge off with a bank I've never had an account with. Ever. </p>
<p> </p>
<p>I am going to go into Bank of America tomorrow to sort all of this out, but there's gotta be someway to have this expunged. It's ridiculous. </p>
<p> </p>
<p>Also, the date of the charge off was when I was at Officer Candidate School in Virginia if that makes a difference in regards to SCRA.</p>

<p>We are looking to purchase a new van.</p>
<p> </p>
<p><abbr title="United Services Automobile Association (this is not a Credit Union)">USAA</abbr> approved the line of credit we asked for (38k). However, they said they will only allow us to use 80% of the amount of the vehicle according to what they say it is worth. MSRP is $38,055. They claim it is worth $36,275, so they said we could only use $29,020 of the loan. Which leaves us quite frustrated. I'm not sure why they would approve us for a certain amount but we aren't allowed to use it. Spoke to 2 different reps to verify this situation. We don't have the cash to pay the 20%, all the fees, and our lovely 10% tax here as a downpayment to get to where we'd only need the loan to be 29k. It would take about 4-5 months for us to have the cash which is doable, but with the issues I'm having with my current van I'd rather not wait.</p>
<p> </p>
<p>A friend suggested we try <abbr title="Navy Federal Credit Union">NFCU</abbr> so I thought I'd get your opinions on that. We just submitted a membership application (husband is active duty) and they said it takes 3-5 business days to confirm eligibilty and to become members. So in the meantime I'm antsy to know if we might even have a shot with them.</p>

<p>We're doing the loan in <abbr title="Dear Husband">DH</abbr>'s name as he is the one with the income. As of Feb 22nd his credit score was 691, certainly room for improvement, but we are getting there and should be debt free (aside from a potential new car) within the year.</p>

<p>To make a long story short, I have been with <abbr title="United Services Automobile Association (this is not a Credit Union)">USAA</abbr> since 1994, and when I was in IRAQ I decided to get a <abbr title="United Services Automobile Association (this is not a Credit Union)">USAA</abbr> <abbr title="Credit Card">CC</abbr>. they gave me on with a 2,500 limit not to bad but wasn't great considering pretty good history and length of history. Well I have had their card for 3 years now and never once received a <abbr title="credit line increase">CLI</abbr>.</p>

<p>So I called <abbr title="United Services Automobile Association (this is not a Credit Union)">USAA</abbr> to ask about a <abbr title="credit line increase">CLI</abbr> but didn't want another hard inquiry on my report. So only a month ago I decided to diversify a bit from <abbr title="United Services Automobile Association (this is not a Credit Union)">USAA</abbr> and open a <abbr title="Navy Federal Credit Union">NFCU</abbr> account. So yesterday I decided if I am going to use a inquiry I want to try a new line and have heard good things about <abbr title="Navy Federal Credit Union">NFCU</abbr>.</p>

<p>I applied and within 30 seconds they approved me for a <abbr title="Credit Card">CC</abbr> with them for 25,000 ! I was pretty shocked and finally felt like I got what I deserved. We have all made a few credit mistakes in past, but <abbr title="United Services Automobile Association (this is not a Credit Union)">USAA</abbr> is terrible with it and for the most part a proven track record of not coming through for their members with loans and CCs</p>

<p>I opened a military star credit card in January of 2012. I had a perfect paying history until October 2014 through December 2014. I thought I had set up automatic payments for the payment to come out and did not. When I realized what had happened, I phoned customer service around January 15, 2015 to catch the payments up. They refused any payments and informed me that my account had been sent to collections. I tried several times via telephone to get a payment in to catch up the card to no avail. Yesterday is the first time I received anything from Transworld about this account.</p>

<p>Should I just agree to pay them, a collection agency, and set up payment arrangements. I owe $3500 give or take. </p>

<div><em>To understand today’s order [PDF], let’s back up to the <abbr title="Consumer Financial Protection Bureau">CFPB</abbr>’s original complaint against SNAAC, which specializes in lending money to active-duty and former military to buy used motor vehicles in more than two dozen states.</em></div>

<div><em>The <abbr title="Consumer Financial Protection Bureau">CFPB</abbr> claimed that since July 2011 SNAAC collected millions of dollars from thousands of servicemembers who defaulted on their loans by using aggressive collection tactics that took advantage of borrowers’ special obligations to remain current on debts.</em></div>

<div><em>The amount that each borrower was to receive would have corresponded to the amount of debt they were allegedly unlawfully pressured into paying. A written compensation plan was to be submitted to the <abbr title="Consumer Financial Protection Bureau">CFPB</abbr> for approval.</em></div>

<div><em>This, according to the <abbr title="Consumer Financial Protection Bureau">CFPB</abbr>’s new action, did not happen.</em></div>

<div><em>In fact, the Bureau found that instead of proving refunds to consumers with settled-in-full or bankrupted accounts, the company issued worthless credits. These credits provided account holders with no actual benefits as they no longer owed the company anything and could not use the credit toward a new or existing loan.</em></div>

<div><em>Additionally, the company failed to properly give redress to consumers who were still making payments.</em></div>

<div><em>For instance, the Bureau claims that some SNAAC customers were making payments under a settlement agreement. However, when providing these customers redress, SNAAC allegedly based the refunds on the original, higher account balance.</em></div>

<div><em>As a result, the <abbr title="Consumer Financial Protection Bureau">CFPB</abbr> found that the company issued credits that exceeded consumers’ settlement balances. Because their settlement balances were then improperly credited, some consumers unwittingly overpaid SNAAC to settle their accounts.</em></div>

<div><em>Under today’s consent order, the CFBP ordered SNAAC to pay $720,000 in refunds to 925 account holders, issue $370,000 in new credits to more than 1,000 consumers with remaining balances, and properly credit 1,000 accounts where payments were misapplied.</em></div>

<p>I was deployed in 2011, I decided at the last minute to join the deployment team that I had to leave power of attorney for a friend to move out of my apartment. Fast forward to 2012 and I noticed there is something on my credit for sure deposit, I wasn't sure what it was for and continued for several years to dispute. Finally last year I received a copy of the paperwork stating it was an charge from my old apartment complex for a carpet stain. I did some research and see it is past the <abbr title="Statute of Limitations">SOL</abbr> but it is still affecting my credit and score. I thought of paying it off and seeing if they would delete it, but then I was worried that if I paid it off now it would start the clock again. It is a very small amount $160, I would have paid it if I was notified of the issue when happened. What should my next move be? Leave it alone, pay it in hopes that it will be removed or worse updated as current.</p>

Today she received a notice from Transworld Systems Inc that the AAFES was issuing an AWG due to a star card debt for over $8,000.  This was completely out of the blue as she has received no notices from them previously, and had no idea this debt even existed.</p>

<p>Now, she was the primary account holder on the card, with her ex-husband, who is still in the Navy was a cosigner since his credit was bad.  However, she did not work and had no income when they were married.  Is she just <abbr title="Statute of Limitations">SOL</abbr>?  Is there any way to convince the creditors to only go after her ex-husband?</p>

<div>Hopefully, I am posting in the right area even in the enlistment process. I am in need of both credit and military expertise here. I am working to get into a rating in the Navy that requires me to get a TS clearance. This clearance will be checking my credit history and I have a debt under $900 in collections. The internet gave me some answers but not enough to clear my doubts.</div>

<br /><div>1.) The credit card was activated in 2010 and expired in 2013. I don't know when it was sent to collections as I was out of a job and was wondering who and what to start calling to get rid of it. I also do not remember my last payment, even knowing the company was willing to settle for half of it when I became unemployed. Can I dispute it for being unemployed and unable to pay it? I need to get rid of this ASAP and I don't have time to take anything to court. Same for asking them to knock it off my credit reports as well. I know they aren't obligated to do it, even if it is paid off.</div>

<br /><div>2.) Should I start a payment plan with them that will upset my credit for the next seven years, even with it marked as paid, to more likely guarantee my job letting me in?</div>

I will be getting everything in statements and writing when I can help it. </div>

<p>I am new to this and really happy to have found this board. I am currently enlisted with Army and wanted to join <abbr title="United Services Automobile Association (this is not a Credit Union)">USAA</abbr>, a military specific bank. They asked me to send in LES along with DL. </p>

<p>I am not applying for any of their credit products at this time. While I don't mind sending in LES,  I am a bit reluctant to send in a full LES since it has so much more information on it. I wanted to ask if it</p>

<p>is recommended or acceptable to block off other information on LES such as Ent, Allow, wages, leaves etc and leave only identifying information for them to read.</p>

<p>I was just referred over here by some online friends who think that this board might be able to offer some help to my situation. </p>

<p>My husband retired from the USAF on 1 May 2012.  We moved from Spangdahlem AB, Germany to WA. We live over an hour away from the base and I'm not sure their legal department could help us since this has become complicated with Germany, Colorado, &amp; Washington State all in different time zones and 2 languages.</p>
<p> </p>
<p>Backstory:</p>
<p> </p>
<p>We first arrived in April 2009 on Spangdahlem.  On the 29th, we enrolled in the TKS Surf n Talk flat rate phone/internet access under his name for our house.  I signed up at the same time under my own name, same office/ same representative for a cell phone with a 24 month contract, autobilled through our Community Bank account. </p>
<p> We were supposed to be there for 5 years, but circumstances changed that he retired on 1 May 2012. </p>
<p> </p>
<p>I completed the original 24 month contract and was told that it would go to a month to month basis after it expired.</p>
<p> </p>
<p> </p>
<p>TKS Office had no difficulty terminating our household phone/internet account, but I was instructed to send a form letter directly to the T-Mobile/Telekom headquarters in Bonn.  The representative wrote "Marschbefehl" as the 'reason for termination"  (Marching Orders) on the paperwork and I sent it. </p>
<p> </p>
<p>Cancellation date was set for 3 May - 2 days after we were due to fly out.  It was sent on 22 April via certified mail.  The representative had not said that there was any time limit.   </p>
<p> </p>
<p> </p>
<p><strong>6 Feb 2013,</strong> I received a letter from Aurora Collections Agency in Colorado, "Your creditor has referred your account to this office for collection."  They requested $295.64 on behalf of Telekom Deutschland GmbH.  I replied within a few days via certified letter requesting validation of the debt according to the <abbr title="Fair Debt Collection Practices Act">FDCPA</abbr>. </p>

<p>I never heard back from them.</p>

<p><strong>20 Aug 2014</strong> -- A letter, this time from Orion Recovery, also in Colorado, requesting a slightly higher amount.</p>

<p>Sent them certified letter on 22 Aug -- same request as to Aurora.</p>

<p>Today (as usual on a Friday, right?) I receive a package from Orion.</p>

<p>---copy of my original contract dated 29 Apr 2009 IN GERMAN, even though it was transacted on a US military base. The  contract was for 2 years and I thought switched to  a month-by-month after that - standard fare. </p>
<p>When we arrived, it was supposed to be for 5 years.  It was shortened a three year tour due to changes in high year tenure.   </p>

<p>--copy of cancellation request for 3 May 2012.  We left on 2 May and I know there was no usage after that day for sure.</p>

<p>I followed the instructions of the T-Mobile office on base to send it in.  There was no time limit, just that we were exiting the military and leaving Germany.  Military clause was in effect as far as I knew.</p>

<p> Reason for cancellation: "<em>Marschbefehl</em>"   (meaning marching orders) &amp; the t-online rep wrote it on the cancellation paperwork before I sent it certified mail. </p>

<p>Then there's xeroxed paperwork in German for each billing month through October 2012. </p>

<p>May's bill IS slightly higher at  20,13 euros .  I thought that my bank paid it before the account was closed down, but I'm now almost certain the 'request' for May might have been a day or two late and IS a valid debt.  . </p>
<p>My community bank account was closed on 5 June 2012 which where the statements were billed &amp; paid automatically.  For me to get copies of the monthly statements is $2 per month via cashier's check/money order.  I have through May, but nothing about June.   </p>

<p>I think I might be able to locate the response from Telekom's customer service manager somewhere in my moving paperwork.  He wrote me, acknowledging my cancellation request,  and said that I OWED them another year for my contract since I'd only had it for a year  and that's why he wouldn't allow me to terminate the account. </p>

<p>I hadn't been able to find a copy of my original contract, so I couldn't reply to him with any truth... thanks to Orion, I now can prove that I had my phone for 3 years. </p>

<p>My questions:</p>
<p>If I pay any amount of money on this debt (May 2012 bill), will it really go to Telekom?</p>
<p> </p>
<p>Or is this just a debt collector who bought it up for pennies on the dollar in hopes of making some money off of me?  </p>

<p>Orion &amp; the paperwork for Deu Telekom claims that I owe on a 12 month contract, but the "debt amount" is for only 6 of those months PLUS interest.  IF I do pay, will they come after me for the other 6 of those virtual months? </p>

<p>  Will it screw with my credit rating to pay on it?  (I checked last month and this 'debt' is nowhere on any of the three company's radar.) </p>

<p>What exactly would be the statute of limitations on this debt?  IF I pay on this and it does show up on my credit history as a 'default', how much of a hit would I take?  How many years would it affect me?  I have really excellent credit.  I don't want this insanity to wreck it. </p>
<p>It's a German company, but a Colorado bill collector and I reside in WA.    </p>

<p>Does anyone know why and how they can deal with spouses differently than the military member(MM)?  </p>

<p>Case in point: Me &amp; spouse filed ch13, got dismissed, AAFES then immediately took our tax returns that next tax filing.  Called them and they did give it back barring I (MM) setup payment arrangements.  They said nothing about the spouse.  </p>
<p>Now, I've got a charge off showing from them starting at the time of the ch13 filing and I'm paying my debt monthly.  My credit is not being helped by my payments. </p>
<p>The wife though, still has access to her cards, online account, and is still able to use her card/s.  </p>
<p>Just this past week I wrote them a letter asking why they weren't sending her accounts to the <abbr title="Credit Reporting Agency">CRA</abbr>'s.  Well I'm glad I did because they updated her accounts to show all good.  Her reports just kind of stopped being reported by them at the ch13 filing. I'm not sure if it said charge off but it might have. </p>

<p>What I don't get is why they would treat us differently?  We're still married and I was retired when all this went down, if that makes any difference.  </p>

Since then, the company has changed its name, only to go bankrupt, but that hasn’t stopped prosecutors from coming after it. Today, the defunct retailer reached a multi-state settlement deal that could result in USA Discounters customers receiving millions of dollars in forgiven debt.</em></div>

<div><em>To recap: USA Discounters was a Virginia-based chain of stores — also doing business as USA Living and Fletcher’s Jewelers — with locations that were frequently found in close proximity to large military and naval bases.</em></div>
