Okay dh has paid off all student loans and we even received a letter from DOE stating that all monies owed were paid in full, this was in March 2004. Everyone but Equifax has updated his info to mark paid with 0 balance of course leaving the defaulted notations.

I have sent CMRRR to Equifax with a copy of the letter stating paid in full and it is still showing a balance. According to my green card receipt it was signed for on Jan. 24th.

What is my next step if it remains on the CRA? Do I threaten with violation of FCRA and ask it be immediately completely deleted? How long do I wait before doing anything else?

They have not sent any acknowledgement to any further investigation or anything since I received this receipt. Before sending a copy of the paid in full letter we had disputed it and they sent a letter stating they verified it with the OC. We have been in contact with DOE and they support that it is paid in full and has been for now almost a year and that they are reporting to credit bureaus that it is paid in full.

I'm just lost about what to do next.

This is not complex. We do this all the time.

First step:

Take one of your EQ reports and call EQ on the telephone. ANY old personal information must be deleted, including old addresses, misspelled names, etc. Make sure when you finish, BEFORE you send the next dispute letter, called a reinvestigation letter, that all your old personal information is deleted. Just tell the EQ rep " That item is wrong ". This is one of the means they have to match your accounts, so when the old information is not there to match against the negative entry, the cannot verify. Many times this alone results in a deletion.

Send a " reinvestigation request ", which again follows Federal Law. If someone feels the result of the initial investigation is not correct, all they need do is send the follow up letter to re investigate. Look in the Newbies section and search for reinvestigation.

After that, if you still don't get it deleted then send a " procedural request, again to EQ. Send all letters CMRRR.

I am betting if you do all this you will never see that negative item again, but if they still won't delete, try something else. Persistence is the key.

The one I'm talking about is the second time I've sent CMRRR a request for correction/deletion/investigation. (I previously disputed this paid off student loan and they stated it was being reported by DOE as a balance owing of over 2000 however, it has been paid since March 2004. I have the return reciept from that dispute as well as the report they sent to explain why it was not deleted.)

This time I sent a copy of the letter from DOE and I've called DOE to find out what is going on. DOE says it's not them because they are reporting a 0 balance and Equifax said their last updated info from DOE was Dec. 2004.


It's been over 30 days since their receipt of this last one and I've heard nothing in response, no mail or anything, last time they sent an explanation about what was disputed and why they did or didn't do whatever. I have been working on our credit for awhile now and all old personal info has been corrected and/or deleted.

So do I need to send another re-reinvestigate or should I now send procedural request. When I send procedural request how long do I wait to send demand for deletion? Do I have to wait 30 days for each to be sent. I will send these CMRRR, this is one thing I can say I've learned here smile.gif . I am going to type up a procedural letter tonight.

I was just wondering though that since it has been 30+ days with no response do I have any foundation to stand if I threaten with lawsuit, if this would even work.

The firs thing I would do is make sure all the old addresses on your EQ report are deleted. If you have a copy of your EQ report, tell me whether your current address is the only one on your EQ report. Is your current address the same as the one you had when you were a student?

I know the address seems completely unimportant to you, but it is often the core to any deletions.

So why don't you take a look at your report and let me know via this post. I would not take any steps until the matching (and therefore verifiable) addresses have been deleted.

The old addresses have been deleted including the one that was associated with this loan. I am not so much concerned with it being totally deleted as I am it reporting correctly that it is paid and showing zero balance.

They still are not reporting this correctly even though I have disputed 2x's and provided proof of payment. It has been a year now since it's been completely paid off.

How can you make them report it correctly when they are saying they are only reporting what DOE is sending them (which is supposedly a $2568 balance, and DOE says that they are reporting a zero balance and have been since last March.

I'm assuming the next step is a procedural request since they have yet to respond. Like I mentioned before it has been 30+ days since their receipt of the 2nd dispute and supporting documentation.

NO! not a procedural request.
Since the 30 + 5 days are up and they have not responded you send them a demand for delete letter.
