does anyone know if perkins student loans are dischargeable through a chapter 7 bankruptcy?

another question since the perkins loans have gone to a collection agency can i request them be rehabed and with who?

Perkins loans are not dischargeable under Chapter 7 bk.
If they are in default and you have other student loans (other Perkins, Stafford, Direct loans) you can ask the US Dept of Ed if you are eligible for a Wm D. Ford consolidation loan.

Unless you're really needing to get your payments down right away, I'd say you'd want to look into rehabilitation instead of consolidating right away (default notation goes away with rehab). As I understand it, Perkins loans are eligible for rehab (and are not dischargeable in BK, except in some really, really rare situations). You'd need to contact the CA for info, not the OC. That's who I worked with on mine.
