I asked for a deed in lieu and they said I would have to have the property listed for at least 90 days. I did that, then called them for the next steps. The rep told me that he needed to update my financial information, then send it over to the deed-in-lieu area. I told him nothing had changed since May and he said ok and the Deed-In-Lieu dept would give me a call in 30 days. BoA called me yesterday and said I owe them a lot of money. I told the rep that I was doing a deed-in-lieu and she said the only thing they see is a short sale request and I did not request a DIL and would need to place the house on the market for another 90 days. I went insane on them on the phone.Edited to remove inappropriate language I haven't lived there in 2 years and they are playing games. They said that I requested a loan mod (which is a lie) back in June that was approved. What do I do?

nothing, they've always called me or I called them. They claimed I requested a loan mod which was approved and that is a lie. They even said they send me the docs in June and I never got anything. I just want to be rid of the house.

Anyways, OP, they may not have right to the deed and probably don't own the note.

Dallas Loan Guy happens to be the moderator of the Mortgage forum (and has been for quite some time), and he is around quite often actually. I can't, for the life of me, figure out why you're posting this way towards another poster, nevermind a forum lead. You've been around long enough to be quite familiar with the TOS.

I've read that BOA/CW is a real pain to work with. You'll likely be in NOD/NOTS/foreclosure limbo for many months. I think that it's hard to get a DIL from them (or any lender).

Hi OP and Others. The lesson to be learned here is simple. Get everything in writing. What is said over the phone means nothing.
Communicate via US mail with return receipt request. Keep good records. Fax and copy all letters.
If need be, record all phone conversations. Do not believe anything they tell you on the phone. Get it in writing and signed.
Remember the banks and mortgage company's and loan processors are not your friend. They are trying to get your money.
They will lie, they will cheat, they will try to deceive you. This is business and business is war and war never ends.
You need to be better at it then them. Good luck.
