Full Version: Can they take it?

I am behind in my mortgage payments and have been for some time. I keep sending them in each month but for only one month at a time. It is just enough to keep the bank from starting foreclosure on me. I have asked them for help in making it easier to make my payments. I need to send them two months worth of payroll stubs and a hardship letter, plus my husbands stubs and a letter from him stating it is okay to use his income since he isn't on my mortgage. They also said they are going to do a credit check. Now if after all of this if they don't feel there is enough income, can they take my house even though I am making payments? I am afraid that in trying to help myself I am going to end up shooting myself in the foot.

My understanding is that if you are making your payments the mortgage company can not take your house just because they think you don't make enough. The big thing here is to stay on time withthe payments, but my experience is that you have to be several months behind (three to four) before paperwork is sent out to start the foreclosure process. I'm not an expert, so definitely consult with one.

Absolutely. They have enough houses in their REO inventory already. If you are making payments, they are on time and in the correct amount, they should be leaving you alone.
