I just got my report from Early Warning. I have one item in there, can someone explain me what i that??

NAME: BANK OF AMERICA
CONTACT NAME: ANTI FRAUD EXCHANGE
Description: "Transaction or attempting to transact, with a check in a fraudulet manner, including but not limited to the passing or depositing of forged, altered closed account, stolen, counterfelt check, or non-negotiable item, the kiting of checks, drawing aginst insufficient or uncollected funds, empty ATM deposit or keying errors".


I have no idea what they are talking about! How do I remove it????

BTW I dont owe any money to BOA

I have recently been informed that there is negative information reported by (name of bank) in the file EWS maintains under my Social Security number.

I am not just contacting you to evolve in a frivolous dispute for you to validate this claim. I am contacting you because you are in violation of many banking regulations and Federal Credit Reporting Act consumer laws:

Name of bank (banking institution)
Sec. 3403. Confidentiality of financial records

(a) Release of records by financial institutions prohibited
(cool.gif Release of records upon certification of compliance with chapter

Sec. 3410. Customer challenges (all as such)
Sec. 3412. Use of information (all as such)

EWS-participating as consumer reporting agency
[(p) The term “consumer reporting agency that compiles and maintains files on
consumers on a nationwide basis” means a consumer reporting agency that regularly
engages in the practice of assembling or evaluating, and maintaining, for the purpose
of furnishing consumer reports to third parties bearing on a consumer's credit
worthiness, credit standing, or credit capacity, each of the following regarding
consumers residing nationwide:]

§ 602. Congressional findings and statement of purpose [15 U.S.C. § 1681]
Consumer reporting agencies must correct or delete inaccurate, incomplete, or
unverifiable information. Inaccurate, incomplete or unverifiable information must be
removed or corrected, usually within 30 days. However, a consumer reporting agency may continue to report information it has verified as accurate.
A credit report includes information on where you live, how you pay your bills, and whether you've been sued, arrested, or filed for bankruptcy.



My report from EWS reads as such:
Your name
address
phone number
date
$-no amount showing or what your report states
Transacting or attempting to transact, with a check in a fraudulent
manner, including but not limited to the passing or depositing of
forged, altered, closed account, stolen, counterfeit check, or
non-negotiable item; the kiting of checks, drawing against insufficient
or uncollected funds, empty envelope ATM deposits, or keying errors.

For you to state such horrific, detrimental and most importantly false information on an individual means that you (name of bank) took such evidence and said copies of such activity(s) and sent them to my state attorney’s office to have me arrested and prosecuted. I don’t know what the correlation of you (name of bank) which may exist, but to use me as an example to gain more customers or to prevent them from receiving a good law abiding customer(s) is very unethical and against the law.

What mostly disturbs me is that when this account was submitted to my attorney for a debt with my Chapter 7 bankruptcy in January of this year, you (name of bank) replied with “no such debt found for social security number”. Please provide copies that I need to turn over to my attorney in order to have this matter resolved. In the absence of any such documentation bearing my signature, ssn, address or likeness thereof, I ask that this information be immediately deleted from the file you maintain under my Social Security number. I also request that upon deletion that EWS forwards this information to (name of bank) on my behalf.

This is the letter I've got back from them:
"After reviewing our records, we have verified that some of the information that you provided to Customer Inquiry was reported to us by another financial institution as inappropiately used, and that the information reported to us resulted in a financial loss to , or other potential loss with respect to, the reporting financial institution."
We are enclosing a copy of the information in our records that was reported to us..."


So they sent me the same letter!Company name: Bank of America. Contact Name: Anti Fraud Exchange.

MCA - I'm not up to speed on EWS. Can you fill me in on them? BOA closed my accounts back in 02/09 and I was notified when I went to make a withdrawl. I'm hell bent on BOA now. They didn't like how I deposited a check from my Fidelity account into BOA and said it was a "risk" and therefore they are closing. I'm now wondering who they all reported WHAT to..... I'm seriously looking into just closing all my checking accounts as they make me nervous with the banks being like they are. Thanks Mary.

HI HL, yes EWS is a nightmare. They think that they are above the law in most cases. There is a good chance that BOA would also have reported you to EWS, not just chexsystems. Early Warning Services is a limited liability company owned by Bank of America, BB&T Corporation, JPMorgan Chase, Wachovia, and Wells Fargo. I believe some of them are using EWS and no longer using chexsystems

Those wishing to obtain consumer report information should contact their Consumer Call Center at 800-325-7775

EWS is a credit reporting agency the same as chexsystems. Because of this, you are entitled to see a copy of your report and it is your right to dispute.

When you request a report from chexsystems, ews, or telecheck, avoid giving them any information that is not absolutely necessary.

For example: if they ask where you work and for the address, phone etc,. I would not give them the number. Tell them you are currently unemployed.

If they ask for current checking account information. Simply say you have none. Do not volunteer any information and only provide the information that is necessary

I'm a little outdated from the Chexsystem nightmare and it's counterparts.... So hearing about EWS is no shocker -just makes me so sick. I only have left my Credit Union checking and Tab.... and citing privacy concerns and such, I doubt I'll ever open another. Unless some "new" bank decides to be less of a proctologist. Thanks for the INFO. I'll call EWS tomorrow and see what they may have...
