per bonbon's suggestion, i'm going to try to combine all my horrors into this one thread and get some help with this (and try to figure out where to go from here)...here are the two threads:

here's where we stand as of right now...

- medical collection popped up on my EQ report back in february or march, somewhere around there

- sent the pre-hipaa dispute letter to EQ, came back verified with nothing from the CA

- sent the medical DV to the reporting CA, got green card back

- sent follow-up dispute to EQ, came back verified again with nothing from CA

- same med collection shows up on EX

- opened complaint with the FTC, sent that along with medical DV, proof of receipt, etc etc, came back verified AGAIN with nothing from the CA

- EQ puts fraud alert on my credit file and also forwards the fraud alert to EX and TU

- called the hospital yesterday to get the account number and date of service, trying to figure out thru my paperwork if i have anything to figure this out with. i let her know that i've never seen anything from the CA...she puts me on hold and calls the CA, who lets her know about my medical DV. "i thought you said you had never seen anything from the CA. they said they received a full cease and desist from you in april, why did you tell me you've never received anything from them?" i tried to explain to her that it was a validation request, but apparently she was an idiot and wasn't comprehending...either way, she said if i pay them they are going to forward the payment to the CA.

- called EQ yesterday, the rep admitted to me that all they did to verify was electronically communicate with the CA and confirm my name, SSN, DOB and current address...that's it

now, the question i have is this: does her calling the CA and speaking with them directly, and them communicating via phone to her that they received the medical DV...does that establish the working relationship we're talking about? i'm going to be making another offer on another house soon, and i don't have months upon months to keep going thru this dance with the CRAs, especially when it's clear they're not going to do anything at this point other than electronically "verify" it.

any help would be greatly appreciated. i need to get this resolved ASAP...i've got the means to pay it, it all stems from insurance problems at work (which has also caused another collection to come up, but i'm still in the initial pre-hipaa dispute phase with that one)...i need help and i need to get this off my reports soon. it's bringing me down below 620 right now which i need in order to get my FHA mortgage...

I don't know what to tell you, YOU are the one who established the communication link between the OC and the reporting CA, you called the OC instead of doing everything in writing. IF you paid the OC with the HIPAA letter insert "a" ( and I am too tired to go back through your posts) and IF the account changed to a "paid" collection, and IF you disputed it and sent the OC the follow up letter with a copy of the dispute to the CRA ,and sent the CA the medical DV, then WHY were you calling everyone and their Uncle??

The ONLY recourse you MAY have is to send the follow up letter to the OC if you haven't already done so, or if you HAVE, then send them the courtesy letter and file a complaint with the OCR.

i haven't paid anyone yet. i've followed the process from the beginning trying to establish this working relationship and get this thing deleted. i still haven't gotten a full and accurate reporting from the CA, but it's clear at this point that they're not going to send me one.

as to why i went "calling everyone and their uncle":

- i called the hospital to get the account number and amount, and see if it matched the amount due on the old EOMB i found. it does.

- i called EQ because the letter they sent me said "additional information has been provided from the original source regarding this item" but there was nothing in the envelope from the CA. that's when she told me that all they did to verify it was electronically verify my name, dob, ssn and address...

...which is why i'm trying to figure out where to go from here - bonbon suggested that i do a simple recap as i did here so that you wouldn't need to go back thru all of my posts. i outlined exactly what i have done so far in the first post in this thread...i just linked to the old posts as a point of reference for anyone who might be interested.

OK, I read your recap and understand NOW why you are having so much trouble.

You had a legitimate bill that you had an EOMB on, you sent the initial dispute letter and it was verified, at that point the advice you asked for and was given was predicated on the assumption that the bill was not accurate, or had been paid etc. etc. You got "hung up" on the need to establish a relationship between the reporting CA and the OC when, in fact you should have been instructed to PAY the OC with the HIPAA letter insert "a" if the account was fairly recent AND YOU HAD AN EOMB THAT MATCHED!!

All the rest of the stuff you did was based on misinformation all around because you were posting in several threads.

Pay the OC with the HIPAA letter insert "a".
