Happy 4th to all!!
DH and I filed chap7 in 4/07 and was discharged in 8/07. We did not keep our house. In Aug it is going back to the auction block for the 3rd time (horrible location). In 2006 foreclosure procedings actually started, but were put off due to the bankruptcy. We received a check from the mortgage company (CitiMortgage) claiming to be a refund of an overpayment on real estate taxes. I called the county treasurers office to see what year the overpayment occured and they were only able to tell me that they did issue a check to CitiMortgage in Jan for the same amount. They said I would have contact the mortgage company to see what year the overpayment occurred. So I did, and long story short, they said I had to speak to the treasurers office. I do not want this money if it is not mine (and I'm afraid after cashing it it will open up the door for them to get us to reclaim the house). I also do not want to give it back if it is mine. What can I do to find out the year the overpayment occured? Should I send it back or not?
Thanks!!
Sandy
I orginally posted this in the Bankruptcy forum, but I have had no responses.
