Full Version: Next step? OC didn't respond to HIPAA, now CA reported to CRAs

I had to go to the ER on 3 occasions in early 2007 for a medical emergency within the same two week period of time (I should have known after having to return 3 times with a nearly fatal medical issue that the hospital was inept). All 3 times I provided the hospital with my insurance card. I had valid coverage, and should have only had to pay a $100 deductable. A month or so after my last visit (early 2007), I received bills from the hospital stating I owed them about $3,500 total for the 3 visits and that they had no insurance on file for me. I called the hospital immediately and told them I had valid insurance and that they had made a copy of my card all 3 times. The Account Rep said they had no record of my card, so I went to the hospital in person with my card and had them make a copy of it. A few weeks go by and I get ANOTHER dunning letter asking for the $3,500 and also stating I had no insurance on file. So I make another call and another trip back to the hospital with my card. I did this a total of SEVEN times over a 6 month period of time. The hospital eventually filed ONE of the claims (one visit) with my insurance company and it was paid in full (other than my $100 deductible). However, they never submitted the other 2 (I have a letter from my old insurance company showing every claim ever made on my insurance and whether or not it was paid or not). They show no record of the hospital ever submitting a claim. In 2008, I submitted a CMRR to the hospital stating they never filed with the insurance company on these claims and provided them a copy of everything the insurance company had sent me.

Fast forward to March 2009 when I (suprise!) get a letter from another CA dunning me for the same 2 bills. I immediately disputed this with the CA via CMRR, who never responded, but instead followed up in early May with another bill/form letter demanding payment. Then I sent a HIPAA letter to the OC (the hospital) with all of the info once again that I had provided them several times before. They signed for the HIPAA letter I sent CMRR (since they seem to like to lose things I went ahead and sent it CMRR) on May 17, 2009. As of today (more than 30 days later) I have not heard anything from the hospital. However, one week ago (after the OC received the HIPAA letter) the CA put the 2 collections accounts with all 3 credit bureaus which drove my score down by 62 points (nothing else on my report had changed since May 1, the last time I got my report and scores from MyFico.

I am at my wit's end on this and could use some advice. I am completely lost as to what to do next. I think I have "information overload" from reading too much here on this forum. LOL. What should my next step be? Begin the HIPAA complaint process?

Which Insert did you use when you sent the HIPPA letter to the OC?

This account is in error.
It has either been paid, is a billing error,or was not transmitted in a timely manner to my insurance company.
It is not a valid bill and has been properly disputed, therefore I request complete deletion from all your agent (name of CA)'s records and archives.

Your situation is a bit of a" hybrid" although your bills were totally whacked out and should have been submitted to insurance, but were weren't. There was still a co-pay due of $100.00. Did you make the 100.00 co-pay for the two accounts that are currently reporting on your CR?
