Full Version: Help! Received call from RCS

I'm not sure what's going on with this. I went to a college about 4-5 years ago and due to life changes I had to stop going. My Ex-wife handled it all (I have to admit I was a completely stupid about that kind of stuff) Well anyway. I know she let it go into default status, and I had taxes taken from me this year due to it.

I got a much better job, went to the "Who has my loan" link on the sticky, and after about 3 phone calls found out who currently handles those loans. ECMC. Got it all worked out to clean up with them. Have everything in writing etc...

Well Today I receive a call from RCS a collection agent for the college I went to. He said that when you default it goes back to the college and I have to pay the college directly, not ECMC. I told him that wasn't what the government said... the website and the government loan # that I called said I owed my money to ECMC and no one else.

He called me a liar, said I should have paid them and not ECMC. He then got really rude with me, and said he's considering this a refusal to pay so the college can file suit. At that point I just said all further communications concerning this must be in writing and not on the phone (I know I need to mail them a letter stating the same)

Please tell me he is wrong. If he is correct and I am way out of the ballpark on this one. If it goes back to the college and not as a government loan would that follow as a private loan and follow normal SOL's and no tax taking (sorry just mad right now and can't think of the word lol)

Also I should add... It wasn't a traditional college, it was more of a technical college (another big mistake, but that's another issue lol)

Sounds like you might have a perkins loan....those are collected by the school. ECMC will have your staffords.

But it doesn't make sense...

I went for a little while, ended up having to leave. About a year later (still owing from the first time) I went back, to leave again. When I left I owed around $6000. ($3000 each time)

RCS is saying I owe $6000 + their interest+ fees, to them (the school).

I have (Had) 2 loans out with ECMC for $3000 each + Plus their interest + fees (now my balance is pretty much paid off) Is the school trying to double dip?

Since the school is trying to collect it and not the government does it follow the normal SOL?

Perkins are federal loans administered by the school, so no SOL. Call RCS and ask them what type of loan they are collecting on.
