My wife and I don't know what to do next. I thought I would post our situation and see if anyone knows what we should do next. Here is the story:
My wife is a doctor with substantial student loan. While in school, she took out a total of 19 different student loans, which is normal. Once she finished school, she consolidated all her loans into one loan, again, which is typical. When we pulled her credit a year ago, her lender showed 19 delinquencies at the time the loans were consolidated. They were also each reported 90 days late for one month, which is impossible. Here is what her report looked like for 19 separate loans:
June 06 - OK July 06 - 90 days past due August 06 - OK
Anyone can see that it is impossible to have a 90 days past due in a 31 day time period.
So, we contacted her lender and asked about the past due reporting and they informed her that she had never made a late payment. They provided us with a letter stating she had never made a late payment to send to the credit bureaus. After the investigation, the credit bureaus said that the late payments were verified.
After many arguments with the lender, we finally found out that the letter had account numbers from the new consolidated loan, not the initial 19 loans. So, we got another letter with the old account numbers stating that they were never late.
The lender is saying that all they can do is provide letters for us to send to the credit bureaus and the credit bureaus will not take the delinquencies off because they say they verified the information.
What do we do next. We are trying to get a home loan, and obviously 19 delinquencies is killing her credit. She has never made a late payment in her life.
Is there legal action we can take against the credit bureaus or lender. we are just at a loss of what to do next. We keep trying to talk to the lender, but only get an outsourced answering services that has pre-written answers, so she just ends up in an argument back and forth. This has been going on a year now.
