Full Version: Quick Question about NYC SOL

Hello All,

I received my first medical collection from National Recovery Agency for a visit to the local hospital from June 2005 for $225. I first found the CA on my credit report on last Wednesday and immediately sent a 'PRE HIPAA MEDICAL DISPUTE LETTER' on Thursday to all three CRA's. I have not received any written communication from the CA but I have began to receive voice mails from people sounding like collectors. I have already OPT'd out; however, I have not moved in the last 15 years to remove any old address. I am just waiting on a response from the CRA's regarding the disputes.

I've read a few threads that have dealt with this CA lately and they seem to disappear quickly with a DV letter.

Here is my question (I apologize if this was posted somewhere but I did search): What is the SOL for New York City (Queens) for medical collections, 6 years or 4 years?

The SOL in your case would be 4 years, however in addition to the legal SOL for being sued BY THE HOSPITAL you are probably talking about a "garbage" JDB collection as if you have not moved you would have received bills from the hospital if there actually WAS any left over balance.

Have you received any response yet from the CRA's you sent the dispute to??

If it is verified, send the reporting CA this; ( one for each CRA who verifies in the same envelope, because this also includes a cease and desist and taping release it SHOULD prevent further calls, in the event the account is deleted because of your dispute, send it anyway but eliminate the extra letters for each CRA)

I just pulled my EX CRA and National Recovery Agench made the following change:

Account Name: NATIONAL RECOVERY AGEN
Account Number: 826XXXX
Acct Type: Collection Department / Agency / Attorney
Acct Status: Closed
Monthly Payment:
Date Open: 1/1/2009
Balance:
Terms: 1 Month
High Balance:
Limit:
Past Due:
Payment Status: Paid, was a collection account, insurance claim or government claim or was terminated for default
Comments: Account in dispute-reported by subscriber

My FAKO jumped from 591 to 673. Should I still continue to get this off? I sent a DV letter which they received on March 3rd. The reports as in good standing; however, I would like to purchase a home next year and I dont think this will be good to have on my report.

I would like to wait until April 8th and then send a letter to the PA & NY AG office if I do not receive a letter in the mail from them.

Please advise me on the right direction with this collection agency.

If so, and the account is not deleted by your dispute to the CRA,
send this;

You might also wish to file an FTC complaint as well as the Pa and NY AG complaints against this CA for fraudulently reporting and "re-aging" on a time barred account.Print out the complaint before clicking enter and send a copy to the CA along with your medical DV

Hello,

I mailed the CMRR letter as suggested by Why Chat today and included print outs of complaints I made to the PA and NY AG, and the complaint to the FTC.

I pulled my credit report today and found that National Recovery Agency updated Equifax and Transunion to show the account as a paid collection.

Is this some type of violation to report a collection as paid when I have not received any type of response from the CA? As you can tell this is really starting to bother me.

I guess I will play the waiting game for now until I hear from someone.

I have not received any type of response from the CRA's or the CA. However, to make the situation even worse, GEMB closed my Rooms to Go account due to 'past or present delinquency.' This was a $1700 account that is now gone.

Anymore advice anyone can give me??

medical collection SOL is 4 years in NYS i gather from this

therefore, do medical collections get removed after 4 years?

I am sorry about your GEMB account, however credit card accounts are being closed left and right for ANY reason they can dig up.
Have you sent the copy of the medical DV to the CRA's together with the cover letter??

Yes, I sent the letter to the CRA's with a cover sheet and it is still under investigation. I found an old email address for a representative from TU and I sent an email to her last night. She replied back a few minutes ago stating that she called NRA and they verified my name, address, and last four digits of my SS over the phone with her. The CA also stated that they are still awaiting a response from the original creditor in regards to verification which is the reason why that have not contacted me as yet.

Need fast help!

I mentioned before that I sent an email to a contact person at Transunion and here is there reply:

Good Morning Ryan,

We contacted National Recovery Agency this morning (717-540-5605) and
spoke with Liza. She verified your name, address and the last 4 digits
on your social security number. We advised Liza that you were
requesting validation of the debt and she informed us that they were in
the process of obtaining that information from the original creditor and
would forward the information to you once they receive it.

We have placed the account under investigation for the accuracy of the
information being reported and you will be notified of the results
within thirty days.


My question is if they verified the debt originally with Transunion when I sent dispute letter, is this considered a violation since they have no proof of the debt? Only my name, address, and social validates the debt Would Transunion be at fault as well?

Usually that is all that is required when the debt is verified between the creditor and CRA in this situation you can't shoot the messanger so to speak.

Your complaints with the AGO will probably get you a deletion unfortunately, they are overworked and under staffed so it may take longer than you like.
In regards to your GEMB account being closed, there is huge thread in the Credit forum that has inside contact info for many creditor. I would see if there is one for GEMB and consider send them

The FCRA requires that any deletion of a derogatory entry that "triggered" an adverse action by anyone MUST be reported to that party. If you send the dispute to the CRA's and it gets deleted, they are required to send that information to any one that had been sent the derogatory data.

Just as an update on this. I still haven't heard anything from the NY AG, PA AG, BBB, or FTC on the compliants I made. However, I did receive another call from someone at the executive office of EQ after I sent an email to a few people. The basically told me the samething as TU: the CA validated the debt but they are still awaiting paper work from the OC but they are reporting the debt as Paid with a $0.00 balance. What bothers me even more how can they prove the debt is paid with a zero balance with no proof?

Both TU and EQ still have the dispute in progress. No luck with Experian.

Update - I got a letter in the mail today from the PA AGO stating they received my complaint and will contact me if they have any questions while they investigate.

Dear BBB,

This letter is in response to your letter dated March 30th, 2009 regarding the above referenced case.
The account discussed in Ryan's complaint has been removed from his credit file reported March 20th, 2009 while our agency was waiting for the validation as requested. In light of Ryan's complaint, however, I have closed the account and returned it to our client, AR Assist. Since the item has already been removed from Ryan's credit file, no additional reporting is necessary. Should you have any questions or concerns please feel free to contact me directly.

The problem is it is still reporting! I've been checking daily! The email from the CEO to the BBB is dated April 15th, 2009. Should I give it a few more days??

I'd give it to the end of the month - maybe they run their updates in batches.

Today I made a round of phone calls to TU and EQ and both deleted the NRA account from my credit report. dance.gif

I am sending a letter to Experian CMRR with all supporting documents because I do not trust this CA and also do not trust the CRA's.
