Full Version: Parents (as co-signers) are filing bankruptcy

Hello:

My parents are filing bankruptcy (not sure if Chapter 7 or 13 as of yet). I have federal and private student loans that my parents co-signed for. I solely make the payments for these loans and will continue to do so. How does it affect the loans? I'm assuming my interest rates will skyrocket, but what else happens now? Thanks.

It shouldnt affect them at all partly because they are nondischargable in BK. (Plus your parents dont cosign for federal loans.) Once the BK is discharged, they will still have the same obligation.

i have a private loan that my mom co-signed for and she filed for bk. it didn't effect negatively on my credit report..or anything to do with the loan. What it did was knock her name off the loan and made me the only one responsible for it

Unless she had a special hearing, she is still legally responsible. Private loans are also non dischargeable in BK and as a cosignor, she would have a difficult time proving hardship if you were making the payments.

umm im not sure the whole process...but i know her name is not on my student loan anymore...because when she called the company to ask about the loan AES told her that they can no longer give her anymore info about the loan because she is not affiliated with it in anyway...

So, it's Chapter 7. I understand that student loans are impossible to discharge. I will continue to make payments on it as I have been, so that isn't the issue. I'm just trying to figure out if it'll negatively affect my credit rating/report by linking a BK to my loans.
