Full Version: Can I call OC before Officially filing HIPAA Infraction

So, before I file for an HIPAA violation can I call the OC (who I payed via the whychat method and sent all applicable letters to) and just try to reason with them to instruct the CA's to remove their accounts from the CRA's? I hate to seem pressed for time here but I'm supposed to be buying a house within a month and really really need to take care of this as expeditiously as possible.

can i have any success with this if I run into a sympathetic worker? (ps, if it makes a diff it is a paramedic company)

And if I do call, do I ask for billing?

I did call.....talked to a real nice lady that told me they did in fact receive funds.....but once received they then sent a check in their name to the agency they sold the debt to. I emplored with her to help me get them off my credit and she said she'd see what she can do and call me back today. Throughout the converstaion she had told me that it is in reality out of their hands though. I didn't want to argue with her about the HIPAA laws and why they are liable for the CA but I did mention that what the CA's doing are illegal and they may be. She was aware of the laws but did not know that part of it.

She was extremely nice however and is apparently trying to help. I now have two CA's on all 3 beaureaus reporting this same debt that won't go away. The second CA just showed up on TU yesterday as a matter of fact.

She has numbers to both of them so I believe she intends to call.

If she cannot accomplish something can I ask her for a letter that I can send to the CRA's or something that can get this removed? what should it say?

If none of this works I guess I will have to continue with the process and file a complaint against them with the office of civil rights. I have done all the steps before this by the book of what you have described whychat.

The woman from the OC just called back and said there is not much she can do since they (the OC) sold the debt and are not the one's reporting on my credit report. She said after they deposited the funds they sent out a check to PFC Funding who owned it after them. She then said that this new one that just came bought the debt from PFC AUG 8th of this year and that's why they are reporting. I have made no contact with the CA's. The woman from the OC however did give direct contact supervisor names and numbers at each one of the CA's that she spoke with. She is unclear what will happen to the check that they sent to PFC, she thinks it may be forwarded to Anderson Crenshaw (the new one).

this just really sux....My lender wants these gone, especially now that I have another recent one on all (TU, EX, EQ) within the last month.....I've been working on my credit for years and thought I had all this crap cleaned up...I'm really nervous here... sad.gif

what should I do why chat? I have a sinking feeling that if left unattended there will be no delete, but just rather show payed....

I am almost hesitant to write this because I think it may go against everything that is recomended here......so feel free to remove this if it will in fact be detrimental to others.

I commited the cardinal sin of calling the collection agency. I got the contact the OC gave me, and his number. I found the gentleman very pleasant to speak with over the phone and very very helpful. He was completely understanding of my situation and told me that within an hour he would fax me not only a letter from his company, telling the CRA's to delete, but one from the other credit agency that they passed it on to that is reporting on me right now as well! I couldn't believe it!!! and sure enough, it showed up. Turns out he was the vice president of PFC funding.

He truly couldn't have been any nicer I was very suprised. I am now overnighting these to all the CRA's and I will have squeaky clean credit....yay......

I will be VERY surprised if your letter from the CA will get you a deletion, it is POSSIBLE that you will get your report changed to a "paid" collection, which is just as bad for your credit scores as an unpaid one.

Your contact to the CA has negated your ability to get a deletion using the HIPAA process. If you had wanted to, all you had to do would have been to provide your lender with a copy of the money order paying the account to the OC.
