Hello all,
Is there any type of letter to send to a CA before wage garnishment of a defaulted loan? My husband has received a letter saying they were going to start garnishing his wages. I'm not sure they even have his correct job. It doesn't have the full name of his place of employment. He called and he was told that it may start his next check, this was a month ago. Nothing has started as of yet. He has not received anything from his job about the garnishment. Should he receive paperwork? He has been dragging his feet about calling the payroll dept to see if they have had any communication with the CA.
He asked how much they would take and he was not given an exact percentage. Also, the rehab extra payment was extremly high but I've read he can try and get that down.
So my question, as I asked earlier, is there anything to do in writing? Like ask for exact figures of garnishment and/or give an amount he can pay above the garnishment if and when it starts?

You have to have a judgement against you before they can get a garneshment. You have to be served papers for the judgment trial. After they get the judgement they have to wait a certain amount of time (30 days I think but not sure) to allow you time to pay up. If not they go back to the judge who will issue the garneshment and serve it to the employer. Thats the way it works in a nutshell, at least here in Georgia.

He definately needs to contact his payroll dept. I got garnished one paycheck after receiving the letter, and I did not know when it would start. Payroll never told me, and they also told me that they were not obligated to tell me. Anyway, look at consolidating to avoid the wage garnishment. They may take one or two while waiting for the consolidation to go through, but it's better than every paycheck.

The payroll department let him know. The only way to get out of garnishment, at this point, is to pay almost $300 over the garnishment. We are going to try and at least get it lowered by showing all of our bills.
