Full Version: Whychat process - next steps

I have been working on the Whychat process since early May on three different collections. It has basically been a waiting game now and I need to know where to go from here. Pleae tell me what I should do now on the foloowing three collection accounts:

1) Unpaid $50 ER co-pay

- Sent the pre-dispute letters to the CRA's. All came back verified.
- Sent letter to CA with no response from them. Sent follow up letters to CRA's. Still verified.
- Sent the Hipaa Letter to the OC with insert A and a $50 bank check. This was cashed a week letter.
- Sent the followup letter to the OC with copies to the CRA.
- On July 30, 2008, I got a letter from the CA saying they have gotten notice from the OC the bill has been paid and they will have the account removed from all credit reporting agencies. As of 9/6/2008, it has not been removed. What should I do now to make sure this is removed?

I am on hold here and want to know what steps I should take now.

Before you send this out make sure you have looked at an updated copy of your reports. You need to wait at least 60 days before re-disputing because of the volume of your prior disputes

How should I habdle disputes #2 and #3?

You can include a copy of the letter from the CA in your next dispute if you wish, however I suggest you include ALL your medical disputes in the SAME redispute letter.

I didn't have time to go back to the beginning of your posts, however, as I remember you did NOT do a "hand written" certified not CMRR dispute initially. Plus if you wait until November, preferably mid November, you will be getting into the Holiday Season where it is somewhat easier to get deletions.

I did do the hand written letter originally for all three of my disputes back in late May of 2008... used the yellow legal pad and purple ink.

So let me make sure I understand correctly. In mid November, send all of the dispute letters I have sent since the beginning (copy of the original pre-hipaa CRA dispute, CA letter, OC hipaa letters, copy of the cashiers check and follow-up letters and the copy of the letter from the CA approving deletion). Send these copies with a new pre hipaa dispute letter written on yellow pad with purple ink. Is this correct?

Do I do the same thing with the the other 2 disputes that I asked about? These I have went through the whole process and still have heard nothing. My last letter to the OC was the follow-up letter after they cashed the cashier's check and the letter with insert B for the paid item. The last officail thing I sent was the copies to the CRA and they verified. I should send another letter to the CRA's again?

No, all I am suggesting is that you re-send the "pre-HIPAA" letter again,( mid-Nov.) and as you did the "hand written" thingy the first time, I suggest you properly type this one and send it CMRR as follows;

Dear CRA,

My name is xxxxx xxxxxx , my SS # is xxx xx xxxx.

I am sending this dispute certified mail return receipt # xxxx to make sure you receive it.

I have no knowledge or records of account # xxxxx from xxxxxx on my report # xxxxx.List ALL remaining medical accounts, paid or unpaid

Please advise me as to the names and addresses of the medical providers, the dates and types of service,and to whom the services were provided, as any accounts I might have had would be obsolete.

If you can obtain this information, I also would need the names of the persons providing this data, and the manner in which it was provided in order that I may pursue additional legal remedies.

Please note that these accounts have been properly disputed before and your agency has failed to investigate or correctly process the disputes. I am enclosing a copy of the response from ( name of CA) that verifies the fact that their entry is fraudulent and should be deleted in its entirety.

Since I have complied with all the required FCRA and FACTA rules and conditions for disputing, this is my last attempt to obtain a correct and proper response from your agency to delete these accounts from my report before I seek legal action to recover damages caused by your non compliance.

Got it... thanks! My concern is the Collection Account I paid. I know the check was cashed but the CA has not marked it as paid on my credit report. Should I go back to the OC and get this updated or just stick with the single letter to the CRA in mid November?

I am hoping to not have to wait 2 more months as early nex year I want to get a home. This will cut the time for disputing this that I have.

I am sorry Bubba, but I can't keep track of everything every one is doing!!

If you paid the OC with the HIPAA letter insert "a" AFTER obtaining a response from the reporting CA from your initial medical dispute letter to the CRA, then you need to follow the regular HIPAA letter program to the end, i.e. follow up dispute with copy to OC, Courtesy letter and complaint to the OCR on the OC's HIPAA violation.

If you paid the OC without establishing that they were in a current relationship with the reporting CA then all you can do is keep disputing and hope the CA will eventually stop verifying.

Dispute #2: On the dispute that was unpaid, I believe I went to the end already without establishing a relationship. I sent the predispute and the Hipaa letter with insert "a". I also sent the bank check that I know the OC has cashed. Over a month ago, I sent the HIPAA follow up letter to the hospital legal department and the CRA dispute. I never heard back from the OC and the CRA has verified. Even though I paid, the CA never updated the account to "paid". So I guess a relationship was not established. Am I stuck now? I think the CA should at least update it as paid.

Dispute #3: This dispute I paid several years ago and it is marked "paid" on my credit report. I sent the predispute and the Hipaa letter with insert "b". After I got the green card, I sent the followup to the hospital legal department and CRA dispute letters. I have heard nothing from the OC and the CRA has verified. The credit report still is marked as paid. Who do I continue to dispute with, the OC or the CRA?

You have involved the OC without ANY basis on BOTH disputes. Forget about any letters to the OC, they are NOT in the picture, and likely have never been. Your payment to the OC with the HIPAA letter insert "a" only gave you a tax deduction, and nothing else.

On Dispute #2 send the reporting CA this;

2) How do you prove a connection between the two if the account has been paid? I understand you can prove it if it was unpaid then paid to the OC and they CA updated it. How do you prove it if it is paid?

Almost ALL of reported medical collection accounts over 2 years old are from CA's who did not get their data directly from the OC. Most are from data miners who scavenge data files from legitimate 1st line medical in house collection departments or 1st line CA's. Some are from CA's who purchased "block" data files from collection departments of OC's or CA's. These include written off "discounted" bill balances after insurance has paid, bills that were paid late by insurance Companies, and accounts that were paid by WC or some other State or Federal agency.

I don't know why the HIPAA DISPUTE letter system hasn't worked for you, I do know that any correspondence to the OC is a waste of postage as there is apparently NO relationship between them and the reporting CA.

1) How can there not be a relationship? A CA cannot have it on my account without getting it from the hospital correct?Incorrect, they get it from data miners

2) How do you prove a connection between the two if the account has been paid? I understand you can prove it if it was unpaid then paid to the OC and they CA updated it. How do you prove it if it is paid?Not easy to do, especially if it is several years old and the reporting CA has no relationship with the OC

Almost ALL of reported medical collection accounts over 2 years old are from CA's who did not get their data directly from the OC. Most are from data miners who scavenge data files from legitimate 1st line medical in house collection departments or 1st line CA's. Some are from CA's who purchased "block" data files from collection departments of OC's or CA's. These include written off "discounted" bill balances after insurance has paid, bills that were paid late by insurance Companies, and accounts that were paid by WC or some other State or Federal agency.



The collection accounts in question are 4 years old. SO it may be data miners. Is there anyway to get these guys? I have paid it, if I cant get it off my record, I at least want it updated to paid! I plan on buying a house next year thru FHA and dont want any unpaid collections.

Bubba-- I have been doing my best to help you get these off your reports, you do NOT want them "updated" to paid, that will cement them to your reports and DECREASE your score.

Please just try to redispute them with the medical dispute letter, you can TRY using the "SOL" letter instead, but in any case you should wait until mid Nov.

Whychat... we went thru this during the summer and I was able top get most of the collection accounts removed. I have 1 paid collection left from a CA. Your last bit of advice was to wait until mid Novembe and start over. I want to make sure this gets done right.

I sent the initial dispute letter to Exp & Eq, both of which have verified. What should my next step be?
