Full Version: Can't get this Paid Medical Collection off my reports

Okay Why Chat..

Long story short - had a $100 copay for my emergency appendectomy. Was kept in the hospital for 3 days, however not formally admitted, thus I got charged a $100 copay for the ER. I tried fighting with hospital and insurance, neither would budge. Ended up paying the hospital directly on 5/15/08, they cashed check on 6/14/08 (and they were the one's that endorsed it.

All old addresses have been deleted, opted out already.

See collection account from CA pop up in June. I immediately sent medical DV to CA, and Pre-HIPAA letter to the CRA's. CA verified, and sent me a letter stating they were reporting it as paid since hospital has been paid.

I sent letter to HIPAA compliance officer at hospital, another HIPAA dispute letter to CA stating that they have never been a party to this, that the hospital, not them, were paid and cashed the check, and they are reporting private health info with no permissable purpose too. They haven't budged, although I managed a deletion from TU. It's still on EX and EQ tanking my scores.

I've now filed a complaint with the Ohio AG (the state where the CA is) and the BBB for their area.

Any other suggestions on how to handle this or go from here?

When you paid the OC, was this before you found the HIPPA Process?
Or was it after you had sent the Pre HIPPA dispute with the CRA?

Did you used the inset "a" letter along with the restrictive endorsement on the Bank cashier/Money order
Then disputed again and copied the OC on your CRA disputes.

If the medical collection still doesn't get deleted then, you send the courtesy letter to the OC, documenting all your correspondence with the OC and you let them know you will be filing a complaint with the OCR in 10 days.

What Hippa letter did you send the CA?
If you have a Medical collection reporting as paid than the CA
(You first dispute with the Pre Hippa Dispute with the CRAs) if it is not deleted then you send the CA this

It is very hard to tell if you have gotten mixed up on the steps, or maybe you started this before you found the HIPPA Process. Hopefully the complaints your have filed will help get this off your CR, but if you have missed a few steps, than try to pick up the process at that point. The BBB is pretty quick, maybe a 30-45 day turn around time, but the two AGOs that I have worked with were so over worked that it took them nearly 90 days to get my complaint to the company.

Nope, been doing the HIPAA wink.gif process a long time. Already had paid OC, TL shows up on my report a week later. Sent pre-HIPAA letter to CRA's, disputed with CA's, sent in letter to OC.

It's still there.

Do you have results back from your last dispute from the CRA that shows the CA still verifying the account?

When you disputed with the CA did you re-dispute the CRA too?

Then your next step is to send the courtesy letter to the OC

Already re-disputed, they verified again. Already sent a courtesy letter. Haven't heard anything.

Your problem is, as I see it, that you paid the $100. co-pay WITHOUT THE HIPAA LETTER and then tried to "enforce" the HIPAA privacy rules with the follow up letters and complaints.

The HIPAA letter program was designed to follow certain steps, it is sort of like the "no trespassing" laws, you can NOT get someone arrested for trespassing unless you have PREVIOUSLY posted a "no trespassing" sign on the property.

I can't believe that a "paid" medical collection is "tanking" your scores.

If you have opted out and deleted old addresses and sent the medical dispute letter

then I think you should let it alone for 3 Months and do it over during the Holiday season.

You have NO grounds for a HIPAA complaint or any other complaint to the FTC or the BBB in my opinion.

The only thing is, it WASN'T reporting on my credit reports when I paid the hospital. It reported AFTER I sent the check in to the hospital. I had received nothing from the CA in regards to this. I was waiting to hear back from my insurance company regarding my appeal. I did send in insert a with my payment.

Once the CA appeared on my reports is when I started the letter writing.

And according to Scorewatch, it tanked my EQ score from 559 to 509, I'm guessing due to the newness of it.
