I entered into the rehab program in Feb. The lady at ECMC told me to file the injured spouse form with our taxes so that DH would get the tax returns since I don't work. I did that and we finally got our money back 2 wks ago.

The IRS kept telling me that we would only get HALF of our rebate since the other half would go to my SL. Well, I just got a letter today saying they took the whole $1500. I am trying to figure out how and why that happened. I don't think that that is right when DH is the one who worked and I didn't. Is he going to have to claim this on his tax returns next year? We don't plan on putting me on them since I won't be working.

Should I contact ECMC to find out why they get the whole check when my husband isn't responsible for any of my student loans?

Did you send in the injured spouse form with your tax return or after the fact? If you sent that in after your tax return, that's probably why this happened. I'm guessing you'll need to send in another one.

A. In this situation, you are considered an injured spouse. To get your share of a joint income-tax refund, as well as your share of the stimulus payment, you can file Form 8379, Injured Spouse Allocation. You will get your share of these payments, and your spouse’s share will be applied to his or her past-due federal or state income taxes or non-tax federal debt such as student loans and child support. Your allocation request will be processed more quickly if you attach Form 8379 to your regular 2007 federal income tax return. [New 3/25/08]


FWIW, ECMC has no control over how much of your stimulus check is offset.

I sent it in after I filed and the IRS told me that it would be good for both for the refund and the rebate. So it should already be noted with our filing. (esp since we just got the refund back 2 wks ago instead of Feb 15th when I would have originally gotten it)

I wish the govmt would decide what the real deal is here. This is so confusing to everyone. They never told me I had to file 2 of the same forms.

I'd guess the IRS figured out your stimulus payment and offset before they processed your injured spouse form. Whatever happened, how very frustrating. Maybe a call to the IRS is in order?

Ya, I tried calling the IRS today and am getting the too many phone calls right now message. Call another day.
