I have a two medical bills from Central Financial Control. one from 2003..and the other from 2005. I know for sure the one from 2003 is not mine. Before I knew about the Hipaa. I have been disputing almost every month and they come back verifies. I sent a DV on April 2oth. I check today and they update one of the accounts 5/15/08. I have not received anything regarding a DV.

Anyway, the OC, Kenner Regional Medical Center, went out of business after Hurricane Katrina. What do I do?

Keep all records and correspondence.

Find out who has access to original hospital billing records, who owns them and can they
collect on them.

Find out who will ultimately be paid on them.

What documentatation does the collection agency have ?

You may also want to check with the local better business bureau and/or the
chamber of commerce to see if they know who has access to records or
ownership of them.

At any rate, if records were destroyed after Katrina, I certainly would use
that as a dispute mechanism with the credit bureau and the collection agency.

Also, this might be a good one for a newspaper or other media to investigate.

Well, the hospital has new ownership. I don't know who to send the Hipaa letter to. Every time I dispute through the CRA, it comes back verified. They just verified one on the 15th of May. I sent them a DV on the 20th of April, and have not gotten ANYTHING back.

I'd start with the new owners of the hospital. Did they buy the financial records, as well ? Do they still have them or access to them ?

If so, explain the situation,perhaps you can work out a settlement.

Every business entity that goes out of business or changes hands devolves every asset it owns to some person or some other business entity. Accounts receivable (debts owed to the business) are assets. The defunct hospital's accounts receivable might have been part of the package sold to the new operator, or they might have been sold to a JDB (junk debt buyer), to name two of the likeliest possibilities.

It's important to know who you're paying because it's important to know that they have a right to the money. Pay the wrong party, and the right party might make you pay again. And you might not be able to get your money back from the wrong party.

Before I knew about the Hipaa process....I sent a DV to them at the end of April...they sent me a letter saying they would be investigating...and would cease all collection activity will investigating...that was the end of April...but turn around May 15th...they reported to the CRA...I guess to update...they are in violation...they have not sent me any kind of validation...but they keep on updating...they reported one account to the CRA on the 15th...but not the other...I know for sure...that is not my account...but again..I have not heard anything from them...also...I CANNOT access the Hipaa letter process....I tried everything...also...what department do I sent the Hipaa letter to:...
