Full Version: Completed rehab but they took my taxes

Yes, I read the other thread on this board and I know the lists are compiled in Nov or whatever but I have already completed rehab and I just called the offset number and they are taking my taxes again.

Last time they did this, they didn't even take my taxes amount off my balance. They just said it went to collection fees and interest. It was a rather large payment, so you can imagine how frustrating it was to see they just kept my money as free money.

My question is this. They are just taking my tax refund and I am getting NO credit towards my balance when they take my refund. First of all this seems really illegal and if its not, it seems like the govt makes things legal to make themselves money which is immoral. This seems very WRONG and unjust, especially since Ive now completed rehab. Is there nothing I can file or ask the CA to do or a way I can get my taxes this year? Or does the whole CA get dinner on me for free another year?

I am thinking this is why so many people hate the govt. I am quickly becoming one of them.

The easy, unpopular answer is that that is how it is. You have to play ball when you owe the government money... having been there, it's why you always see me say I'd rather owe the mob than owe the feds.

As to your issue, again, the easy answer is to wait till your name clears off the offset list. Last year, I didn't file till November. I completed rehab maybe 90 days prior to that date, and I was still coming up on the offset list. It took some emails back and forth with Ed to get the removal expedited.

Have you already filed? If so, you may not get that refund, but I am far from completely sure on this. Either way, challenging it may not be worth it, but I am always one to say you never know till you try.

You made your final rehab payment in March which means when the offset list was submitted you had made 4 or 5 payments. You were still in default and taking you off the tax offset list is not a right, but a courtesy. There is nothing written into federal law that requires them to allow your taxes to be returned because you are making payment. Each guarantor sets a payment requirement or a dollar amount paid requirement. You may not have met that thresshold. Or they simply may have chosen not to take you off.

Are you kidding? Did you not read my post? Where did I say I was against paying the balance? I am not against paying interest or fees but it was total and complete BS because my balance never went down. NOT PRINCIPAL BALANCE. The balance PERIOD, with the fees and interested already added, never went down. I know this because I had a bill from them before they took my taxes last year and had a bill after they took the taxes and IT WAS THE SAME AMOUNT that never changed months later.

I'm 100% sure that taking someone's money and not applying it to their balance IS immoral AND illegal and I'm going to talk to a lawyer to see exactly what measures I can take.

I would also like to add that, this is my 2nd thread to which you have supplied NO help to. If it were not for Stryker and Helcat, there would be no point to this forum, due to the fact that you don't give any helpful advice and seem to have a bit of an attitude. I've read a lot in this SL forum and your responses seems to cut people down rather than to help. I've gotten ten times the amount of helpful advice from those 2 members than I have from you. That is, when you do respond at all....

Who is THEY? The CA? The guarantor? For starters, tax offsets can take up to several months to post to your account depending on when you file. For the actual tax offset to trickle down to the CA's system takes even longer. Did you ever ask for a statement or payment history from the guarantor to verify credit? All you have to do is ask the CA for an update.

Much as I'd like to enjoy the praise, the honest truth is that Lynn is the hands-down expert here. Her advice is given bluntly, but is is almost always on point. No need attacking a member who truly goes out of her way to volunteer time to helping people. I am sure if you think about it, you'd agree.

As with everything, YMMV, so there is no problem checking your options.

My aggravation with this collection agency that handles my student loan has been building up over the past week with the reaging my account and now taking my taxes again this year. They hit me where it hurts on both ends and I was upset when it seemed like you were telling me to accept it. Its not your fault and I directed my anger at the wrong person. I am sorry, and I hope you will understand that your advice is very much appreciated. I shouldn't have posted the last one.

Then that is probably who Im going to have to have a talk with. It wouldn't seem like the CA would have any power but after I arranged rehab with the CA, the original SL TL updated and reaged as if the CA had the ability to update the OC and thats baffled me as to why they're doing all this to me and that along with the taking of my taxes has made me a bit depressed. I'm going to take some time off and read up on things and will update in the future if I can make any headway in getting things fixed. Thank you for understanding and thank you for your help.
