I have been paying into a Chapter 13 for three years and received my discharge March 21, 2008. Yeah for this part. So, I have two student loans which I knew I had to repay and they were in my plan and receiving monthly payments from the trustee. I checked the government loan, and all looks good with that and I start repayment the end of April.
The other student loan was originally with AES. When I declared bankruptcy, TERI took over the loan and has been receiving monthly payments from the trustee. I called TERI to find out how to begin my payments, and was sent to their recovery department which is run by Marblehead Bank. I was told that my loan is being "outsourced to collections" because they consider bankruptcy to be defaulting on the loan. At this point, the woman did not know what collection agency will be receiving my loan because they work with several agencies, and my loan hadn't been assigned, yet. This is making me really nervous. Can anyone give me some advice how to handle this? This loan was always paid on time before the BK, and as I mentioned, the trustee has been paying TERI monthly for the past three years. The lady from TERI said the I should be receiving some information this week, but if anyone has any advice, I would love to hear it. I am trying so hard for a fresh start, and this just seems to put a major ding it that... or maybe I am over-reacting?
