I have been a member at my local CU for 8 years. I have had a very strong relationship with them during that time. I had my personal accounts along with several business accounts through the years.

On my personal account I have a $500.00 courtesy pay for overdrafts. I had some overdrafts come in and they were paid by my CU. I have been dealing with a business failure on my one business and also a foreclosure at the same time. I received a letter stating that I would be turned into Chex and the 3 credit bureaus if not paid. I called the manager the day I received the letter and told her that I would be in first thing in the morning to take care of it. I also explained my situation to her and she was very nice about it and said that my account was closed that morning but once I paid the money owed she would re-open it with no problems.

The next day I walk in pay my debt and she told me that she would open up a new checking account for me. I asked why she couldn't re-open my old one and she said that it was closed yesterday and had already been turned into Chex Systems. She said that she felt bad about it but there WAS NOTHING THAT SHE COULD DO ABOUT IT. I pleaded with her to remove it and she said that she couldn't. The thing that is killing me the most is that I am the Treasurer for our youth football organization and we are planning on opening up new checking accounts. She then told me that since it was paid there really should not be a problem. But she is missing the point that I can not be humiliated anymore. Between my home and my one business I can't take anymore embarrassment. She once again offered to open up another personal account for me but I declined. I have always had more that one checking account. PLEASE KEEP IN MIND WHEN READING THIS THAT I KNEW ALL OF THESE PEOPLE BY A FIRST NAME BASIS FOR YEARS.

Believe me I accept responsibility but can I please get a break somewhere?

Is there anything that can be done to remove this record from Chex? If there isn't I think I will just resign as Treasurer, I have had enough.

I ordered my Chex report and low and behold it was reported that day I initially spoke with her for overdraft protection abuse. Is there anything that can be done?

PLEASE HELP.

Write a polite letter attaching a copy of the letter saying that if you didn't pay the arreages then you would be sent to Chexsystem. Point out that you immediately paid it and therefore the CU should remove you from Chexsystems. I pleaded with her to remove it and she said that she couldn't. The CU manager apparently is unaware that Chexsystems entries can remain for 5 years AND even if paid can adversely impact your ability to open another account. Was she the manager of the credit union? Complain to the manager/president of the CU. Send all letters certified mail. Also make a complaint to the OCC. Here is a SAMPLE letter for the bank as well ( you can switch it around a bit to suit your situation)

But basically let them know that this is going to unjustly hinder your banking abilities and you were told in good faith that you would not be reported to chexsystems if the situation was taken care of .

Chexsystems allows the vague "NSF" "ABUSE" AND "SUSPECTED FRAUD" flags because they are harder to dispute and remove. There are no clear standards for what is considered NSF, ABUSE, or FRAUD. They can mean anything a bank wants them to. What proof do they have to flag an account NSF, ABUSE, or FRAUD?

TO: Whom It May Concern:
I am writing regarding the account # [account number], which I dispute.

Please be aware that any negative mark on my Chexsystems report for a debt I don't owe is in violation of the Fair Credit Reporting Act (FCRA). Therefore, if you cannot validate the debt, you must request that all credit reporting agencies that you have reported to delete the entry. In addition, until I have received and reviewed any evidence you provide me, I ask that you take no action that might damage my credit reports.

If the debt described above has been resolved, I ask that you remove, or have removed, any derogatory marks from my Chexsystems, and Credit reports per the FCRA and send me confirmation that you have done so.
Please note that if you fail to respond within 30 days of receipt of this certified letter, I am prepared to take legal action against your company for causes of action including, but not limited to, defamation, fraud and violations under the Fair Credit Reporting Act.

By sending this letter, I am disputing both the validity of the alleged debt and the validity of your claims. This is my attempt to correct your records. Please be aware that any information I receive from you will be collected as evidence should any further action be necessary.

One more thing..also let them know that you have spoke to chexsystems and you are aware that they ABSOLUTELY CAN REMOVE YOU FROM CHEXSYSTEMS. Let them know that chexsystems has informed you that the reporting credit union is the ONLY one that can remove you.

Thank you all so much for this great advice. Should I send a letter to the president of the credit union first and ask him to be decent and have this deleted or should I unleash the certified letter similar to the example that you posted for me first?

Just a quick note... When I went in to talk to the manager last week she told me that this would be on my Chex report forever. I looked at her and said no you are wrong!!! It is for 5 years only. That goes to show you how much she knows about her own industry.

You can try asking nicely first but I don't think it will help at all in this situation. I can not tell you how many banks and credit unions have told me wrong information when it pertains to chexsystems. The same as many of them believe that if you pay the debt owed, you are automatically removed.
