If I am the primary borrower and hisband is the cosigner and he alone files ch 7 BK is there any possiblity the judge will let him off the hook as cosogner. I am not asking if they will be discharged, I know they won't. I will still be paying them back when they come out of deferment ( i have a year left of school to be a teacher)

I am praying for congress to pass legislation on private student loans such as mine, because I think 50% of my paycheck will go towards paying them back for the rest of my life ( or 30 years i guess) I hope I can get some debt forgiven after ten years of teaching public school.

Private student loans are NON dischargable under the BK code so he will NOT be released as a cosignor.

A follow-up question to this one; I am a co-signer on 2 SLs for my daughter, which we are now repaying. I am beginning to gather the papers for filing Ch. 7. I know you can't include SL in BK proceedings, but what will this do to her CR by my filing? Someone told me as long as the loans are kept current, there should be no adverse effects on her CR. True or not?

To answer that question I need to know what kind of student loan you cosigned.

If you can't figure that out, what is the interest rate, and whose name is on the bill?
