Why chat sorry to bother you.. tried to just send a pm but did not go through. I have reviewed your personal site and all the info here and want to see if i am correct. I have a medical bill from a hospital... it is mine and no i do not have the funds to pay. Now it's with a ca.. so do i
1. send medical dv letter to CRA with CMRR or send to CA
2. Once CMRR is recvd' wait about a week and send CMRR to CA--
now this is where i get confused do i send the actual CMRR to them or just a copy and what do I say when I send it to them..
3. Now what if they do provide a copy of the signed release and prescription stuff etc.. than I am just stuck not able to continue to dispute right? BUT does that mean they will go after me even harder?

and what if it is with the OC like for instance the hospital.. where do i begin?

Thanks so much for your help i know you get hammered daily with question.. but i really appreciate it..

and anyone else who knows is more than welcome to jump in wink.gif

If you have a medical ( or any other bill) on your reports that is within the legal SOL for being sued, and you can not afford to pay it, my advice is to LEAVE IT ALONE!!

The ONLY thing you should do is to opt out, and once that is done wait a few Months and try to get old addresses deleted.

You should NOT dispute with the CRA's or send anything to any CA if you are in danger of being sued.

hi whychat.. thanks so much for your response... but now if i could ask rolleyes.gif where do i find what the sol are for medical debts.. i know them for the other stuff. one other thing... if it is past the sol... than where do i start with the process that i have indicated in my first post? this medical rules and regulations and dispute process is confusing... thanks again.

The LEGAL SOL for being sued on ANY "service" type debts is 4 years under the UCC ( Uniform Commercial Code).

HOWEVER, in practice, if you have a HOSPITAL or CLINIC or AMBULANCE bill, and are sued and have as your ONLY defense the fact that it is "time-barred" you will lose in Court because THOSE services are generally REIMBURSED by TAXPAYER $$ for their "no-pays".

IF your accounts are past the legal SOL, you start by opting out, deleting old addresses and sending the "medical dispute letter" to the CRA's ( from original reports directly from each CRA).

You can come back and POST ON THIS THREAD with your results for further directions, which are dependent on exactly what you have done and what your results have been. Read the other posts for insights and information, but PLEASE keep your specific questions within THIS thread.

thanks why chat.. I took a look and it has not past the sol yet so I will wait.. but i did notice that under the OC section they listed "MED1 & the name of the hospital" is that considered medical information or it that legit? Thanks again for all your help.

The medical data YOU get on YOUR report is not what other people see, they only will see "medical account"

Hello WhyChat biggrin.gif Ok so I sent a medical dv letter to the CA and a dispute letter to CRA... nothing back from CA but I got a new report from CRA stating "new information below" however there is nothing new, updated or anything.... should I wait for CA to send something or send letter to CRA asking how and who they verified with? and out of curiousity if CRA reports back as verified but w/ no concrete proof.. should i go into the HIPPA process? I am really confused too because it has been stated to not dispute with "not mine" but if you dispute with "I have no knowledge of this account" won't they still put it in as a "not mine" dispute? thanks again

Which CRA?? Is the account on only one report??

Check the report on line, especially if it is TU as they frequently send out a report that does not actually reflect the deletion or correction.

You have already disputed this and apparently received a "quicky" response from 1 CRA, you need to wait the full 35 days and recheck your reports.

Saying you have "no knowledge" of an account is NOT the same thing as denying the account is yours.
