I will try to keep this short. DH had student loans, defaulted, was turned over to a collection agency who obtained a judgment. Have been making regular monthly payments and they have taken our tax refund for two years. This year our refund was $1000 more than still owed on loan. However I received notice from the Dept. of Treasury that they sent the whole refund to them because ISAC (Illinois Student Assistance Commission) has never updated their records and still showing that he owed $3000. Called the Ombudsman who checked it out an agreed that the loan is paid and that ISAC actually owes us the $1000. He said it was not unusual because ISAC has such a poor record keeping system and people have trouble with them all the time. He said I shoulde get my money by the middle of April!! My question is this....it does not show on my husbands credit report that the collection agency (Wexler and Wexler) obtained a judgment. All it shows is ISAC, Collection Account, Collection Services, $5250. Is there anyway I can get this off his record? It looks like it is still unpaid and that no payments have been made althought we have been making payments for three years and it is now actually paid off. Or will I be opening a big can of worms since the judgment isn't showing? Will they put that on if I dispute it? I feel like they owe us something since they have free use of our money for two months and their record system is so bad. Thanks

the can is already open. why not just go for a simple dispute with the CRA's now while they owe you money. maybe they are more likely not to answer since its a closed case. if the judgment isnt on the CR by now, it probably wont ever go there. not that its really much better but if they dont delete, they should at least update to paid. that might help you in getting credit that would have made you pay the collections first.
