Hello, I'm the husband of Nevar and I'm having trouble accessing this site so, she allowed me to use her screename.

Well here's my situation:

As the title of the thread shows my student loan is in default. My loan is a Stafford Loan. I don't doubt that but, the agency Account Control Technology has been very difficult. First they called my house under a blocked number, the messages they've left NEVER addressed WHY they're calling and to just call them back AND they've claimed to have sent me several letters about my account (they've only sent one which I got 2 weeks ago). I've asked for proof in writing that they are legitimate since she was calling under a blocked number. She asked for my wife's SSN and checking account as well as my checking account. I told her that I don't have one and I didn't feel comfortable with giving my wife's PERSONAL info over the phone. She then proceeded to raise her voice and threaten to garnish my check. I told her I'd be happy to send the money to her since I didn't have a checking account and can't get one until I clear up the matter with Bank of America (that's ANOTHER STORY). Since she was yelling which in turn was pushing me to the edge, I asked to speak to her supervisor who would only give her name as Lauren. THe supervisor pretty much did the same thing as she did. So when they finally sent the letter verifying the information, I called back and spoke to a man name Jason Primo (sp) who told me the same thing and begin to abuse me as well over the phone. He told me that I needed a checking account OR a Telephone number.

At this time, there's NOTHING I can do as far as getting a checking account because they said I had to do it by 11am today. I told them the situation and was screamed on again and in so many words called a dead-beat. Since I left college, I haven't been able to hold a job for very long because I've worked as a temp which isn't as easy to find a position. Since landing steady employment, I'd love to get my business in order and get my loan out of default. I don't WANT my wages garnish because I'm not sure that would get me out of default but, if I can't do it any other way, it seems that I'm stuck.

Is there anything I can do?

Without a phone number or checking account, they are not guaranteed monthly payments. If I had been the collector in this case I probably demanded one or the other. Without one or the other, I would immediately have forwarded the account to wage garnishment.

When I obtain a checking account can I go back to them and rehab to keep them from doing anything and if they do it will I be able to get them to stop?

You'll have the opportunity to rehab the loan, yes. You're entitled to that under law.

If you get a AWG notice appeal it, and be prepared to give evidence of income and expenses for your household to the administrative official. You'll have to prove garnishment would cause an undue hardship to you and your dependants, so you will need to provide documents, SSNs and written authorization for ED to investigate records with IRS, social security, etc.

If they have started AWG when you get a checking account you would still have the opportunity to rehab, but it may mean making voluntary payments in addition to the garnishment. You would still be able to appeal garnishment, but it won't generally stop until ED has made a determination about hardship.

Based on what's happened so far I think there is a pretty good chance your employer may hear from ED in the next few months.
