If anybody could help me, I would appreciate it greatly. I have searched your website for hours for answers to my credit report problems but am unable to find a definite answer.
I have 2 collection accounts from 1 student load debt back in 2001. The first one is from the Dept of Ed. The 2nd is a collection company they sold the debt to. The first collection is listed COLLECTION/PAID, but the collection co they sold it to keeps listing me as 120 days late on equifax, making my EQ score 20-30 points lower than the other 2. I've never communicated with and never made a payment to the collection account or agreed to pay them in any way (due to their dirtbag collection tactics), but they are listing my account as 120 days late every month for years it seems. I'm thinking this is lowering my EQ score since it is in the 575 range despite never missing a payment on anything in 4 years.
I am trying to find an easy answer (because I've already dozen of pages on this site) as to what form to send or what to do when collection accounts out right lie about status to try and damage your credit.
Also, if my student loan was opened in 2001 and became derog in 2002, isn't it due to come off my report in 2009? The collection they sold it to has 2003 date of last activity in attempt to stay on my report another year. What if anything can I do about that?

Open dates and DOFD mean nothing for student loans. The 7 year reporting SOL goes from the date that the claim was paid.
You defaulted. The department of ed requires valid lates and defaults be reported until they naturally age off.

It will fall off 7 years after it was paid?

It never got paid and never will. They took $400 out of my taxes one year, but never deducted that amount on my CRs or the bill they kept sending me. As a matter of fact, they added on $300 for their "collection fees". I only owe $1400 on it but they called and harrassed my family and called everybody on my street and asked them if they knew me, so on moral basis alone I'd rather die than give them my money since this seems to be a legal corruption allowed here in the US.
So when would you say it will fall off my credit report if I never paid on it and never will? Where would I look to see my state's SOL laws? I live in GA. Thanks.

In that case, I *think* it would fall off 7 years from the time it was assigned to the Secretary of Education for collection, however, there will never be any SOL on collecting it as the laws are written now.
If you can prove a collection agency violated FDCPA in attempting to collect you have a claim against them, and possibly against the entity that hired them.
If you can prove the holder of the loan did not apply a payment to the account you are entitled to an adjustment to the account, and an adjustment to interest and fees retroactive to the day the payment should have been applied. An involuntary payment would not entitle you to any credit reporting other then an adjustment of the default balance they are collecting.
None of the above abrogate your responsibility to repay your public debt; again, there is no SOL on collecting it. They can continue to charge interest and collection costs until the day it's paid in full.

Have you read this forum??? There is no SOL on student loans. They will seize your tax returns, garnish your wages without a court order and then if a balance is remaining, they will garnish your social security. Your taxes where applied to your balance..however you have daily accruing interest not the mention the collection fees which you agreed to pay if you defaulted on your loan.
In your prom note, you agreed to keep your lender informed of your contact information. Obviously you didnt so they are calling the references you listed on your original prom note. Nothing corrupt or illegal about this.
You will pay this debt whether you like it or not. In the meantime you are ineligible for FHA/VA mortgages, FEMA benefits and certain jobs. So when would you say it will fall off my credit report if I never paid on it and never will? Where would I look to see my state's SOL laws? I live in GA. Thanks.

You asked if I read the forum, so I must ask YOU if you have READ MY POST? Please do not make assumptions about my situation as you do not know me. I had to move inbetween states after college and was all but homeless for a couple of years so I COULD NOT BE CONTACTED. Thanks for not assuming that I was just dodging my student loan for the sake of it and trying to preach to me the promises I made on my "prom" note! Not that it's any of your business, but they didn't just call the references once every now and then to find out if they had heard from me but they called them 3-4 times a day. Let's not be ignorant and say that's perfectly acceptable. I don't give a rat's @$$ if the laws of this country say that it legal to harrass people in this manor. IT IS NOT ACCEPTABLE TO ME. Nor is calling complete strangers on the same street who have nothing to do with the debt, who don't even know me. I'm pretty sure if this isn't in violation of some kind of privacy act in the U.S., with all the pointless laws we have, IT SHOULD BE. Well if you kept in contact with your lender, you could have gotten 3 years and probably then some in hardship deferments. Then they would not have had to coming looking for you.
The point is, you WILL pay it, whether you like it or not.

To the OP... Lynn knows. Perhaps the assumptions are harsh, but I think you'd do well to listen. You asked and are being given correct answers, even if you don't like the answers.
The right thing to do would be to work out whatever you can with them to get the balance you owe down before you end up with a really big problem. It's up to you to do the right thing, and remember... two wrongs will never make a right, and they will always end up right on a public debt.
Please for your own sake get you head out of... the sand.

The question you should be asking yourselves is "in a hundred years when I'm dead and gone and nobody remembers me, did I occupy the time in my one and only life with credit status?"
You can't take credit status with you when you die, nor money. My suggestion to all these stressed out people on here....find more joy in your lives and love what you have instead of trying to live beyond your means. God will take care of the rest.

You were the person who didn't keep your student loan servicer knowing how to contact you and not the other way around. Did you ever even try to contact the servicer and make them aware that you were having problems? I strongly doubt it. That just wouldn't fit with your whine. Wow, I won't tell you what to do with your money, but I must say that I hope you don't end up on the other side of the stick. Considering you own your own business, I would assume you hope to be paid as well. That's how the government and others feel. Sorry you don't consider credit scores all that important (considering what your scores are, I can believe that you don't) but for some of us, moral and honor mean a lot.

Nub, your tax refunds, wages, etc will pay for the claim that covered the amount you borrowed plus 98% of the interest and fees while we had your loan. Thanks to ED, the guarantors, and their collection agencies it's pretty hard for us to lose money. Since the CAs and guarantors turn a pretty good profit on morons like you, I'm all about them doing their thing. Helps my stock options:P

Some of us get paid to help people finance another dream: higher education.

I think maybe Fla-tan did not read far enough back to see what all was said to him. He's a busy man.
Needless to say, people who talk to our moderators like that are no longer welcome at CB. If obewon comes back as someone else, or you suspect that he has, please use the report button or PM an admin or mod and let us know.
