Full Version: Student loan options after CH13 BK?

Back in 2005 my DH and I both lost our jobs for the entire year and could not find work until 2006. We managed to salvage his credit, but mine did not make it. Everything has defaulted/charged off, and after agonizing months of research, I think CH13 BK is my best option. I wish I knew then what I know now, because I could have filed CH7. Now we make too much and I will have to file CH13. We are looking to buy a house next spring, as well. I will be 24 in August.

I want to go to back to school Fall 2008. I'm not sure what I could get from FAFSA. DH makes 55k, with a raise to 65k starting in June. I make 30k, but if I go back to school, it will be full-time, and I will either not work or work very little part-time (going for DVM ulitmately). He is willing and able to cosign for me. If I file CH13 BK this summer, what, if any, are my options for student loans?

In my experience, you would still be eligible for a Stafford loan through the school (they do not check credit) and private education loans (they do check credit). I have a discharged chapter 7 and used Sallie Mae one year to supplement because my income is too high to receive a pell grant. Check the terms for any loans, because if I remember correctly (would have to look at the paperwork), Sallie Mae had something like a 8% interest rate and direct Stafford is a better way to go, imo.

A stafford loan is a stafford loan, regardless of who lends it to you. Sallimae, Direct Loans...the terms are identical with the interest rates being set every July1. Also, who your lender is depends on what program the school participates in...FFELP or DL.

Correct there is no difference in Stafford loans, however, where I should have perhaps clarified is that the Sallie Mae was not under Stafford terms, but a private, credit based loan. To further clarify, I used the private loan as a supplement to subsidized and unsubsidized stafford loans.

Also wanted to add, you have options and don't let a few potential obstacles discourage you.
Do your research now for backups, but once you receive the financial aid offer from your school, go from there with knowledge that there are resources available. cool.gif

If you are doing a chapter 13 this summer, you will not be able to get any private loans. No lender will touch you with an active bankruptcy.
