I have read several posts for the last week regarding student loans and let me tell you they have been really helpful. Last week I was so frustrated because TGSLOC started garnishing my wages at 15% with no notice. Here is the short version of this long, long story. My hubby and I just recently had our bankruptcy voluntarily dismissed because we were in desperate need of a car. All of our creditors (including TGSLOC) were notified and updated. I called TGSLOC in December to give them my new address and home phone and requested information on my student loan since during bankruptcy our attorney told us to not pay the loans.

On March 28, I called because I received no paperwork and was told I was under AWG. A representative told me a letter was mailed on January 5 informing me that my AWG was in process unless I request a hearing. I ask her to verify the address and she told me it was mailed to a PO Box. I told her I've never owned a PO box and she told me it was my responsibilty to call and inform them when an address changes (which I did call in December). The PO Box they mailed the information to was the lock box for the trustee's office and it was mailed under my maiden name.

After 15 minutes of yelling on the phone with these people and getting nowhere I requested they mail me forms for financial hardship because 15% of my income is costing me $378 a month. All paperwork was mailed. Today I receive a call stating the AWG will stay at 15% because of my husband's income. I have two children and the cost of living isn't getting cheaper and these people are giving me nothing but hell.

My loan is for $3,141 and I want to pay them $100 a month until it is PIF but $378 a month will throw me back into BK. I have called the Ombusban(sp??) office to seek help because I feel there are no other options. I have also requested a hearing and a copy of my original loan paperwork from TGSLOC. I can't get a personal loan from a bank due to my credit and before filing BK I made timely payments to these people and paid it down from $8K to the balance it is today.

Is there anything else I can do?

When was your BK dismissed?? Did you start making payments on the loan??

This is the big problem that I see....when a BK is dismissed, it immediately goes back to the status where you were before you filed BK. If you didnt immediately start making payments, you left yourself wide open. Depending on the dates when your BK was officially dismissed, TGSLP might have still been in the BK loop when you called to update your address. When a student loan is in BK status, it is basically locked down.

That is where the problem lies....you didnt start making your payments, BK really has nothing to do with it.
Even if you had completed the BK, whatever balance remaining on the BK would have become due and payable.

Why didnt you apply to have your loans consolidated with Direct Loans like your husband did???

That is where the problem lies....you didnt start making your payments, BK really has nothing to do with it.
Even if you had completed the BK, whatever balance remaining on the BK would have become due and payable.

Why didnt you apply to have your loans consolidated with Direct Loans like your husband did???
He didn't apply...TGSLC sent a letter in March stating his two loans were sold to Direct Loans. He filled out the paperwork the same day I discovered I was under AWG. I only have one loan for $3141 and I have applied with Direct as well but have not heard anything from them. Trust me when I say I've researched and read everything you've sent to others on this board and well as TXQuiltGrls regarding student loans. I just don't know if Direct will approve me if I'm under AWG or because I have one loan.

Student loans CANNOT be sold to any consolidator without an application. So somewhere along the line he authorized the guarantor to start a consolidation for him. Texas probably did the app for him but he had to authorize it.

Have you followed up with Direct Loans on the status of your application???

You are correct...they did the app for him and Direct Loans notified him via mail that his loan would be consolidated upon his approval. The type of loan he has is an ICR which means it increases with your income. I will check with Direct tomorrow and let you know the outcome. I'm keeping my fingers crossed and praying to GOD that they approve me. I still have a hearing coming up but have not been notified by Texas when it will be since I disputed the 15% garnishment. The Ombusban office was really helpful and told me to make sure I send in the additional expenses I may have before the hearing.

Lynn, I called Direct Loans and my application is still under certification. I then called the rep handling my case at the Ombusban office and she informed me that as long as I am in active AWG, Direct will not consolidate my loan. That was disappointing but it is reality. I have exhausted all of my options and will wait for a hearing which is still up in the air. She did advise me to try and convince the hearing officer that I can pay at least $100 or $150 a month on the loan, have the loan setup direct debit out my checking and hopefully he or she will agree with it. If they do, this will take me off of active AWG and then I will be able to consolidate.

This has been a lesson learned. I will NEVER EVER[u] get another federal student loan as long as I have tuition reimbursement I will stick to that option.
