Full Version: Is this a violation?

I hope this is an answerable question for credit boards...
Ok here it goes, So my son was taken to the ER by his grandmother and I never knew this until I got the bill. Here is the thing though the bill was originally sent to her at her address and with her info as the responsible party but she had no guardian rights or anything. Is this a violation of my rights for her to have taken these actions without my consent and have access to my son's med info? And is this disputable? Any advice would be greatly appreciated.

Your child was in the care of a grandparent who took him to the ER and signed the required papers so he could be treated and you are complaining about YOUR rights?? Where were YOU when he needed medical attention?? Pay the bill and be thankful for having a family member who cares about your child.

My mother had to take MY child to the ER before when she was babysitting (I was WORKING). Didn't know that was a CRIME.

The same thing happened to me and my mom told me about the bill and I called the hospital and gave them the insurance information and they then billed my insurance.

To the OP...Have you tried to call the hospital and explained?

Unlike YOUR situation the OP was UNAWARE that her child had been taken to the ER until she received a bill. As a Guardian Ad Litum this to me was a RED FLAG. wink.gif

Im sorry perhaps I didnt make myself clear enough. If I leave my son in the care of a grandparent and something happens to my child while Im at work than I should be at least notified that he was seen at the hospital and all of his medical needs should be addressed to me not done in secrecy and than land a 1600$ bill without even knowing that he had been to the hospital. That to me doesnt even seem very responsible and caring at all. IN most events when a child is taken in by a school or daycare they notify the parents of the emergency.

Im sorry but I dont really think thats a fair response. Like I said before when a child is hurt in someones care they should notify the parent so the parent can be involved. A bill that should have gone to me in the beginning and something I should have been informed of from the beginning was not. I feel like that's wrong. See your mom told you that something happened while in her care and didnt try and redivert the mail to her so as to keep it a secret and then just let the bill go to collections. I checked in with her and she never told me there was a reason to be concerned. I know for a fact that grandparents need written consent to take kids to the dr, and i beleive its a federal offense to open other peoples mail.

The child wasnt in need of medical attention. I personally know the OP and know that the grandmother had ulterior motives, which is why the mother wasnt notified and the bill was diverted by the grandmother.

This forum is for credit repair and assistance on getting medical bills properly paid to the OC and off one's reports. It is NOT a family counseling forum. If the OP has an issue with the grandparent it should be dealt with in whatever manner is appropriate. If there is an issue of child abuse or a family squabble or anything else like that it should be dealt with somewhere else.

It is , IMO ,COMPLETELY INAPPROPRIATE for the OP to turn her personal family dispute into an attempt to discredit the hospital/health care provider or to try to use an imagined HIPAA violation to get out of paying her child's bill. dry.gif

Im asking for credit repair assistance. When I intentionally posted for help I was asking for advice, not a way to get out of paying for the bill. I never had the chance to address it appropriately because of outstanding circumstances, had i been informed and had my mail not been rediverted I could have made payment arrangements with the health care provider and not had such a huge neg go against my credit. I think it more inappropriate to cast judgement against with having all the details of the situation and to stray from the initial credit related topic. This was not intended to get personal, and not meant to discredit the health institution. I just want to have the neg removed and a chance to pay the bill off as I believe I should have in the first place.

Send the CRA's where it is being reported the medical dispute letter.

You dispute medical accounts this way:

Dear CRA,

My name is xxxxx xxxxxx , my SS # is xxx xx xxxx.

I am sending this dispute certified mail # xxxx to make sure you receive it.

I have no knowledge or records of account # xxxxx on my report # xxxxx.

Please advise me as to the name and address of the medical provider, the date and type of service,and to whom the service was provided.

If you can obtain this information, I also would need the name of the person providing this data, and the manner in which it was provided in order that I may pursue further legal options .

Very truly yours,

Make sure you HAND ADDRESS the envelope, use personalized stationery and purple or teal font, ( preferably italic).

DO NOT send it RR

IF YOU ARE STARTING THE HIPAA LETTER PROCESS-WAIT FOR THE FULL RESPONSE FROM THE CRA BEFORE
SENDING OUT ANY HIPAA LETTER


Upon verification, i.e. the correct date of service and your child's name as patient, send the payment to the OC with the HIPAA letter insert "a".

Use the follow up dispute letter and cover letter to the OC after your money order has been deposited.

Make sure you follow directions.

( Find another babysitter)

Next time you have a credit problem, ask for help in solving the problem instead of asking if the OC had " a violation". wink.gif

that sounds like something you need to take up with the grandparent that didn't tell you about what happened...seems to me that it's a communication problem between you and your parent (or in law, or whatever)

Did the ER have your contact information? IF so, where did they get it from? They don't keep it on file for every person in the area...it was the responsibility of the grandparent to notify you (And if MY mother was watching my child and that happened...and she didn't tell me about it...that would be the LAST time she ever saw my son without me there the whole time...until she DID learn)



I would contact the hospital...provide them with the appropriate insurance information...and deal with the communication issues within your family...

Why Chat- I mean this with the utmost respect because you are a wealth of information and have helped so many on CB including myself.
Your reply was totally off-base. OP wasnt using this forum for personal issues and neither was I. You jumped to conclusions (and made it personal) which made it obvious you didnt understand the situation. I purposely didnt elaborate too much because this is a credit board. Perhaps the OP didnt phrase the situation exactly so to get the desired results, but as a newbie that is to be expected-we have all done it.

In the end-thanks for helping direct the OP,which was the desired result.
