Full Version: Garnishment/Rehab with GRC

Hi all, i am new to this board but have been reading tons. I contacted GRC and they informed that they sent a garnishment request to my employer. Becaus i am in rehab, i will pay $50 a month on top of the garnishment.

is all standard procedure? what should i do next?

I contacted my employer, and they stated no garnishment was in place....did i just screw myself?

They said they went forward with the garnishment after you started rehab? How long have you been in rehab? I find that really odd. I'm curious to hear what other people have to say about it, because going into rehab was how I got out of being garnished.

i called them this morning, i just have to sign a couple papers and ill start the process. the thing is , the documents have no indication of garnishment. and my employer has no record of it. by signing these docs, does this give them permission to start the garnishment?

They don't need permission to start a garnishment. However, it does sound like they are BS'ing you! Did you receive a 30 day garnishment notice?? Did they have your correct mailing address??

Payments made through garnishment cannot be counted toward rehab. The voluntary payments of $50.00 per month can be counted. Seems to me that this arrangement can save them the trouble of negociating "reasonable and affordable" payments with you.

I used to work at GRC, you really need to find out if indeed they have a garnishment pending against you. Just because your employer hasn't processed it yet doesn't mean they didn't do it. Contact your local courthouse, they'll know for sure. In regards to your rehab, they may or may not accept these voluntary payments towards rehab. Whatever you do, you need to work quickly and if they decide to let you go for rehab, get something in writing about them NOT garnishing you as long as you keep up with your payment arrangements.

Obviously you didnt work student loans at GRC. Student loan garnishment do NOT go thru any courthouse. AWG is authorized by congress and requires NO court order. You would also know that they will not put anything about NOT garnishing wages.

ACTUALLY I did collect student loans at GRC, was I in the legal department NO I was not. Will they put something about NOT garnishing wages? YES GRC will. That I do know from my days there and from those that I know that are still there. Thank you for correcting me on the things that I had incorrect. I may not be correct on this either but the "happy" in your siggy, I think not. Could you not have posted in a different manner???

Legally, they can send something that says "If you _____ we will not garnish." They are NOT required to send anything of that nature as part of a rehab agreement. They cannot legally waive their right to AWG; they cannot send anything in writing that violates HEA.

Lynn is nice enough to share her not-always-appreciated inside knowledge here in this forum. As she stated, you are incorrect in advising to check the local courthouse about pending garnishments as no judgment is needed for AWG.

To add my two cents of what I have learned. I am in my first month of rehab- just making first of my payments all this week. Any federal loans are subject as has been said to AWG, and they are meant to replace the need for court action. Indeed, as I have discovered the garnishment supersedes state garnishment laws when the federal and state law conflicts.
