Full Version: Wage garnishment

Ok, before I even had a chance to call today about rehabbing my loans, I received a letter in the mail about them garnishing my wages. So I called and the guy I talked to was very nice, I assume because I'm being cooperative. I asked him about rehab payments and he said 15% of my take home pay and said I could fax my last two pay stubs. My question is......my last several paystubs have been obsenely low. I had two surgerys in 6 weeks and was hardly at work. Last week was my full week back. He said that as long as my payments qualified, we could set it up and avoid the garnishment. My kids were being a bit crazy so I didn't get to ask him what qualifications my loans needed to make. I'm a bit worried that they'll get my fax and basically laugh at me because the payments would be so low. My last two paychecks were 81.85 and 173.78

I suppose if they say I don't qualify (which I think is bad info?) I can always consolidate, but I'd rather rehab.

For starters, make sure you return the garnishment letter. If you don't, you would still be garnished. It is a technicality, so please return it!!

Did he ask you how many hours you are now working?? Basically he can take your hourly wage and do any calculations to figure out a payment. DId you also do a financial statement??

Payments are a minimum of $50 and for a regular plan, should be 1% of your current loan balance. If you cannot afford the regular payment, you can ask for "reasonable and affordable" payments based on your financial situation. It is not that hard to set up. Just be honest and open...sounds like you got an ok collector!!

You have to return the request for Hearing Form.



Ok, now I'm really confused. At the bottom of my Request for Hearing form, it says "If you wish to arrange a voluntary agreement for payments in amounts equal to 15% of your disposable pay, do not use this form. Instead, call the Customer Service Number at 1-800-621-3115"

So do I send it in or no? I don't see how they could continue with the garnishment with that statement printed on the bottom of the form.
