Full Version: I Won My AWG Hearing!

Of course my letter with the results of my AWG hearing came while we were away in Pennsylvania for Thanksgiving, and I had 5 days of sweating it out before getting home yesterday.

According to the letter from the DOE, they found in my favor that garnishment of 15% of my wages would create a financial hardship for me, and suspended the garnishment order. They then go on to say that they will reevaluate my situation in 6 months.

Nowhere in this letter does it say that they accept my proposal of payments in the amount of $200/month. They DO provide the name of the CA (CBE) and give a phone number "..if you wish to set up voluntary repayment", but when I went that route before appealing the garnishment order, they refused my offer. Will they accept it now that that garnishment has been suspended?

If I call CBE and they tell me they won't take $200/month, should I just send the payments to DOE directly? When the 6 months is up, I would like them to see that I have been making the payments I proposed at the same time each month.

I also had received a letter stating that my tax refund will be seized next year - did the suspension order affect that as well? If not, will they continue to seize my refunds until the debt is paid? If I am making regular payments will they still take my refund to get additional money towards my debt each year?

This is not uncommon. 75% or more of appeals do go in the borrowers favor.

You need to contact the CA. They can access the DOE notes that the garnishment appeal was approved.

They basically have to take your $200/month. All payments for DOE accounts go to the DOE anyways.

AWG hearing has no bearing on tax offsets. You need to contact the CA to find out what the requirements are to be taken off the list, although it might be too late. With a lot of my old clients, we got tax offset lists in August and they had to meet the requirement by mid November. Call and ask.
